Those present were Bernie Popish, Norris Taylor, Mayor Garfish, Councilmen Bey?r, Braun, Anderson
and James, Attorney Stewart and Mr. C. H. Anderson.
Before the meeting was formally opened~ there was an informal discussion regarding the City's Water
rights and the problems involved in selli~ water rights.. Mr. Les Finley, Commission er of District Les Finley

cussion. The issues discussed were possible loss of water rights in the future by abandonment through
non- use, the ~roblems involved in trying to sell water rights locally and probable reaction from
Denver Transmersion Diyersion. A suggestion to trade water for p~,er was discussed. To a question
regarding change of point of diversion, Mr. Finley replied that all landowners in the area would have
to be notified, and that there would probably be a protest from the Eastern Slope.
The drilling of wells was also discussed and Mr. Finley said it is permissible for the driller to

get the permits ~and that drillers logs should be filed with the State Engineer. In reply, .to a question
as to how far from creek a well should b~ drilled, Nr. Finley stated he co~ld not tell exactly, but
if claim wa.s made that water was being drawn from the stream into the well, the burden of proof would
be on the Cmty. Mayor Garrish thanked Mr. Finley for coming to the meeting. ·
In the absence of Chairman Broughton, Bernie Popish opened the regu~ar meeting with old 'business.
Flume Stein, Marolt and Arlene bill discussed and consensus was that the flume should be repaired by them.
Regarding liability for damage caused by wat&r in the Knight house, C. H. Anderson has written
to the insurance company. ~
Postmaster Ware is looking further into the single billing o~ the Electric and Water Department bills.
Skating Rink Attorney Stewart has written to the attorney for the Aspen Skating Rink, and has not yet received
Rob Roy a reply. He also talked with Attorney Petre regarding the Rob Roy claim, and has heard no further from

Regarding the .term "Irrevocable" in Utility BoArd Ordinance - no reply received from Tallmadge
and TAllmadge- table.
The minutes of the meetin~ of of March 14 were read and accepted.
The bills of the Electric and Water Departments were read and will again be read for approval
of payment at the next regular Council meeting.
To be referred to Council - having Mr. Handy bill the City for all services with a breakdown as
to each department.
Water Company Dale Rea has bough~ the water system map from Hendy and has offered a copy to the City for $250~00.

Motion hy Popish seconded by Taylor - that the Utility Board go on record as approving the drilling

Well Drilling
Mr. Stewart ~aid that Mayor Garrish as ex-officio member of the Board would have the right to
vote as he is designated "ex-officio" in the Ordinance.
Cl~aning up of the lots next to the Fire Station was discussed, and C. H. Anderson said the
Electri6 Department is paying rent to the City for the privilege of storing lumber thereon.
Slim Anderson reported on the work on the well now being drilled. They have gone down 45 ft.
and water is 15 ft. from ~he top.
