The size of the structure will be 175 sq. feet and does not contribute to net leasable space. Staff has reviewed this proposed amendment and recommends administrative approval by the Director, with conditions. APPLICANT: Stan Clauson of Stan Clauson Associates, LLC, representative. LOCATION: Mai-oon Creek Club PUD ZONING: Park (P) PUD REVIEW PROCEDURE: Insubstantial amendments to an approved Planned Unit Development may be approved by the Community Development Director, pursuant to Section 26.445.100. Staff Finding: With this proposed amendment, the use and intensity remains the same as approved. The change does not alter the character of the development. 2. Since Maroon Club Golf Course is a frequented destination year-round, it is imperative that adequate bathroom facilities are provided for the members and guests. The Club currently rents portable toilets and does not offer a lightning protection shelter at this location. The Maroon Creek Club would like to construct a 175 square foot restroom structure, with two handicapped-accessible restrooms and an overhang for lightning protection. The proposed site for the new restroom and shelter facility will be located along the cart path on Golf Parcel D - west of the #13 Green and east of the #15 and #16 Greens. Even though the facility is located close to Tiehack Road, it will be built in a grove of aspen trees, and screened from the road. This location will provide easy access to the users along the cart path. Moreover, the necessary infrastructure to service the restroom facility already exists. Sewer service is located on the hill above the site, and an ejector pump will be utilized. (These installations were approved in BOCC Resolution 93-104, 4(d).) Once the new facility is built, the rented portable toilet facilities by the #12 and #13 Greens will be removed. A previous approval transferred the remaining floor area allocated to ancillary structures on the golf course to the expansion of the clubhouse. Thus, a part of this request is to allow the additional floor area of 175 s. f. to the Maroon Creek Club development. It is our understanding that these restrooms would not add to the Net Leasable area of the facilities and would, therefore, not require any Growth Management approvals or exemptions. The proposed facility would add minimally to the allocated floor area of the property, and at the same time, a necessary facility for the users of the golf course. Moreover, the proposed structure will not only house two (2) handicap accessible bathrooms, but also serve as a combination storm shelter and lightning protection station for users of the course. This new structure will provide a much needed facility as well as a safety improvement during inclement weather. Maroon Creek Club, Golf Course Restrooms and Storm Refuge 7 October 2005 Page 1 ........................................... Chapter 26.304 COMMON DEVELOPMENT REVIEW PROCEDURES 26.304.010 General. This Chapter sets out the common procedures for review of all development applications, unless otherwise specifically stated. Generally, all proposed development shall be subject to the following six (6) step approval process. (1) A pre-application conference between the applicant and a staff member ofthe Community Development Department; (2) Submission of the development application and fees by the applicant; (3) Determination of completeness and review of the development application by the Community Development Director; (4) Review of the development application by the relevant decision-making body; (5) Receipt of a development order or certificate of zoning compliance; and (6) Receipt of a building permit. Response: The applicant will comply with all the requirements in order to complete the six step approval process for this application, requesting an Insubstantial PUD Amendment which would allow Maroon Creek Club to build a bathroom facility on the go*Nordic ski course. PUD Insubstantial Amendments. An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director. The following shall not be considered an insubstantial amendment: 1. A change in the use or character of the development. Response: The addition of the bathroom facility on the course will not change the use or character of the golf and Nordic ski area. In fact, the proposed combination of bathroom, comfort station, and lightning shelter would enhance the attractiveness of the recreational area to all users. 2. An increase by greater than three (3) percent in the overall coverage of structures on the land. Response: The facility itself is a minimal addition of 175 s. f to the allowable floor area, and is not an increase greater than three (3) percent in the overall coverage of structures on the land. 3. Any amendment that substantially increases trip generation rates of the proposed development, or the demand for public facilities. Response: Since the restroomwillonly serve the users of the course, the proposed structure will not generate additional tra#ic. Moreover, necessary public facilities already serve the area, and demand for public facilities will not increase in any significant way withthe utilization ofthe 175 s. f. restroomfacility. Approved in BOCC Resolution 93-104, 4(d), sewer service is located on the hill above the site, and an ejector pump will be utilized. 4. A reduction by greater than three (3) percent of the approved open space. Response: The proposed structure of 175 s. f will only negligibly impact the open space of the golf/Nordic ski area. 5. A reduction by greater than one (1) percent of the off-street parking and loading space. Response: The proposed development will not reduce any o#-street parking or loading spaces. Response: Likewise, the proposed bathroom facility will not impact any pavement width or right-Of-way for streets and easements. 7. An increase of greater than two (2) percent in the approved gross leasable floor area of commercial buildings. Response: This proposal is to serve as a bathroom facility and lightning shelter, and therefore will add to the gross leasable floor area of the Maroon Creek Club facilities. 8. An increase by greater than one (1) percent in the approved residential density of the development. Response: No residential development is proposed as part of this application. 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting a variation from the project's approved use or dimensional requirements. Response: This request is consistent with the original approval creating the Maroon Creek Club Golf Course. Moreover, the proposed bathroom facility and lightning shelter will enhance the course as an attractive and safe recreational destination. B. Other amendment. An amendment found to be consistent with or an enhancement of the approved final . development plan by the Community Development Director, but which does not meet the established thresholds for an insubstantial amendment, may be approved, approved with conditions, or denied by the Planning and Zoning Commission, at a public hearing pursuant to Section 26.445.030(C) Step 3. The action by the Planning and Zoning Commission shall be considered the final action, unless the decision is appealed. An applicant may appeal an amendment determination made by the Planning and Zoning Commission to the City Council.
