HomeMy WebLinkAboutminutes.council.19600815 The meetin~ was called to order by Mayor Garrish at 7:30 PM with Councilmen James, Braun, ~ Anderson and Be~er, City Administrator Wurl, City Attorney SteWart and Treasurer John Hall present. The minutes of the regular meeting of August 2 were read, and a motion was made by Anderson, seconded by Beyer, to accept them. Carried unanimously. The ~lty s accounts payable were read and discussed. A motion was made by Anderson, seconded by James, that Rule 19 be s~spended and the bills approved for payment. The accounts payable of the Special Water Fund were read, and a motion was made by Beyer, seconded by Braun, that Rule 19 be suspended and the bills be paid. Appro~d unanimously. The accounts payable of the Electric and Water Departments were read and discussed and a motion made by Braun, seconded by Anderson, to suspend Rule 19 and pay bills as read, carried unanimously. Otto Haerdle Otto Haerdle was present and referred to a letter he had r~cei~ed from Attorney Stewart regarding land claim deeds to three lots, and he outlined the b~sis on which he is claiming the lot which is also claimed by Luther. Considerable discussion fqllowed, with reference to maps. Attorney"Stewart said the City should decide whether it has an~ interest in the land in~ol~ and if not, it is a private matter, and he expressed the opinion that.a private right is paramount to a publice right. A motion~was made by Beyer, seconded by Braun, that the City withdraws all interest in West End Sotion-West ~ Street between blocks 26 and 27, and that there is a conflict and that the City will issue deeds to St. the one the Court decides i~ the owner; also {he previous motion rsgarding Luther is withdrawn, and the City directs that notice be given to the last filing applicant that a conflict exists with respect to said West End Street. Carried unanimously. Attorney Stewart will give notice to last filer. Jim Snobble asked about his water bills, as he felt they were very high. Discussion followed, Snobble- in which Snobble asked that rates be reviewed and that auy adjustment be made retroactive. It was water bill suggested that meter be checked and Wurl will handle this. Mr. Lesch asked about the water connection for the new addition at the bus station. After dis- Waterline cussion it was suggested that a larger pipe be laid in Mill Street,i Wurl will handle. bus depot Council expressed appreciation to'Attorney Stewart for providing a vacuum jug for coffee.. Wurl will look into matter of monthly statements from the Electric Department. The Mayor said that Ken Moore had asked permission to use lots next to fire station for a party. City Administrator Wurl's report. Health ins. A meeting of the employees was held to discus~ health and hospital insurance,-no decision, al- though they seemed to favor White Cross, and the~e will be another meeting.. ~ Main St. Street Improvement - should City join with County in the paving of Main Street between Galena and Paving Hunter - from curb to curb. A motion was made by Anderson, seconded by Braun, to work with County on such paving, carried unanimously. Curb and gutters were discussed, and the Catholic Church is willing to pay 1/2 of the cost in their area. Discussed - need for gravel and source. Oiling streets Condition in which contractor for waterinstallation should leave streets. Correspondence. Copy of letter from Attorney Delaney to Mrs. Bissell regarding well- site. Ord. Codifi- Copy of letter to Councilman James from William Field regarding check for $~OO.00 in payment of cation pledge of aspen Field Fund, Inc. towards ~xpense of ordinance codification. Mr. James will reply in ~00.00 appreciation. ~ield Fund Letter from Attorngy Stewart enclosing decision from the Department of Interior that no rental Re~t. Int. will be charged for right-of-way. Right of way Copy of letter from Trafto~ Bean to Planning Co~misSion - ~w~ - Commission is to submit suggestions to Council for action. The question of having the Board of Adjustment inform Council of any variances granted was dis- cBssed and this will receive attention. Matter of printing of o~dinance codification discussed, alsb having complimentary copies for Ord. printing the Fiel~ Foundation, the Chamber of Commerce and other civic organizations and possibly the State Archives. Bonding of police force discussed and Attorney Stewart will handle. Bill James and Fred Braun are following up on dog pound. Wagner Park Wagner Park agreement discussed and County resolution thereon read, also inclusion of maintenance in budget. Councilman Braun is following up on trails. He said Bob Marsh of the Riding Club would like to [ Trails t~ have one north-south and one east-west bridle path ~through the City to take riders off main sfreets. Well sites Councilman Beyer reported on well sites, particularly one on Water Street. Attorney Stewart is ~ to check to see if City owns property. ~lso discussed - Spring· Street location and payment of $2~.O0 to railroad. Letter has been sent to Grand Junction on this. ~l~ory Hole Beyer also reported on Glory Hole - description of property needed before apprai~ment can be made. Mayor Garrish reported on purchase of pump needed as an emergency existed. Morion by Anderson, Motion - pump seconded by Beyer - due to lack of water in Hunter Creek and emergency existed and the purchase of the pump is approved. Carried unanimously. Aspen 9olorado Regular Meeting~ Aspen City Council AUgust 15, 1960 continued. Aspe~ Skating Rink - Councilman Braun reported that he had spoken to Judge Shaw and that depositions Skating Rink are to be taken. East Aspen Patent - Information has gone out to the railroad - Attorne~ ~tewart is awaiting further East Aspen survey. Discussed - Baltizar claim a private matter - claims of Deacones's Crowe and Bob Card, also Cleve- Patent land Street. Attorney Stewart said that Ken Mo~re and George Mitchell inquired about Ute ~enue - closing and Ute Ave. replatting~ as they would like to present to Council preliminary plans for a subdivision. It was suggested they present plans. Liability for~playgrounds still pending. Discussed - obligation of Howard Lee on Si Johnson Ditch - also agreement on Villa LaMarr. It Was reported that City had Treasurer's deeds to all but two lots in City Park and Attorney Stewart City Park lots will follow up on acquiring the other two. ~ob Marsh had called Mayor Garrish about dedication of City Park as Walter Paepke Park. The Ceuucil is willing thane go ahead. Memorial for minutes to be prepared. Paepke Park Councilman James is to look into ~Improvement'Tax for Flora Dora. Attorney Stewart s~ggested withholding further action on the Paint Brush Chalet 2% Tax until after codification is eompleted, due to clarification of "places" in ordinance. The matter of the Roy Claim on the flumes has been turned over to the insurance company. Councilman /Rob Roy Braun drew attention to hole in road near Castle Creek Flume. Flume The Mayor has talked to Ski orporation abcut tower to use as fire tower in WestEnd, but they had none available. Whip Jones may have one md will find out cost. Fire tower Attorney Stewart is handling bill from Buchanan for marker survey. He will also trace field notes that belong to the City. surveys Mr. Wurl had received bid from Shelton on well drilling. This will be discussed further. Hatfield indicated he could not take on the job. Well drilling The next regular meeting will be on Tueaday, September 6, 1960. Councilman Braun drew attention to the fao~i~ that the City was not listed in Music Associates Pro- gram as having donated. Nate Feinsinger is looking into this. City Administrator Wurl is to contact Bes%WaybCleaning Service about dumping on the cleared space Dumping at the dump. Motion to adjourn - made by Braun, seconded by Anderson.
