J ? o ~ 13 1!!l .., I?iP II o I I!I MEMORANDUM Xp TO: Mayor Klanderud and City Council Julie Ann Woods, Community Development Director r Sarah Oates, Zoning Officer...s~ THRU: FROM: DATE: May 25, 2004 RE: Temporary Use of Sandwich Board Signs on Public Right-of-Way SUMMARY: In the spirit of loosening up our regulations in the downtown area, staff is seeking Council's approval to allow businesses to place sandwich board signs on the public right-of-way with certain restrictions on a trial basis. Staff requests that sandwich board signs be allowed on the right -of-way for a trial basis of three months (June, July and August 2004). In connection with this, staff will develop a permit that must be filled out by businesses, which will be free of charge, so that staff and businesses can agree on the size and location of the sign as well as have a sign-off from the business indemnifying the City of Aspen from any liability. Staff will also require of applicants that signs not be left in the right-of-way overnight. In addition, these signs would be permitted for retail and restaurant businesses only and limited to the Commercial Core (CC) and Commercial Lodging (CL) zone districts. The code states: 26.510.110 Signs on public right-oj-way It shall be unlawful to erect or maintain any sign in, on, over or above any land or right-of-way or on any property, including light posts, belonging to the City of Aspen without the permission of the City Council. However, this section shall not be deemed to apply to signs posted by any duly constituted public authorities in the performance of their public duties, or to specific circumstances otherwise provided for in this Chapter. ApPLICANT: City of Aspen. PROCEDURE: City Council may grant permission to place signs on public right-of-way as outlined in Section 26.510.110 (see citation in italics above). RECOMMENDATION: Staff recommends approval of the proposed request finding that said request is consistent with recommendations made by our retail consultants and is in the best interests of the downtown businesses. Staff finds the proposal will allow staff to relax some of the regulations prior to formal code amendments to change the sign code. Also, this temporary allowance will allow staff to make modifications to effectively and efficiently handle a modified sign code. RECOMMENDED MOTION: "I move to approve Resolution fIli$ 2004 granting approval for retail and restaurant businesses located in the Commercial Core (CC) and Commercial Lodging (CL) zone districts to place sandwich board signs in the right-of-way adjacent to their property with the following conditions: 1. Sign must be made primarily of wood or metal . Chalkboard <lud ffiy ~.uo~ insets are acceptable . Signs may be two sided (9 sq. ft. per side) . Business name is permitted on sign but sponsor advertising is prohibited . Signs cannot be illuminated or have lighting on them . Each business is permitted one sign which must be located adjacent to the business . Staff is to approve location through the permitting process . A liability release must be signed as part of the free sign permit application we are requiring all businesses obtain which want sandwich board signs . (Series 2004) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, GRANTING TEMPORARY APPROVAL TO ALLOW RETAIL AND RESTAURANT BUSINESSES TO PLACE SANDWICH BOARD SIGNS ON CITY OF ASPEN PROPERTY WHEREAS, a request was received by the Community Development Department from the Downtown Catalyst to temporarily allow businesses to place sandwich board signs in the public right-of-way; and WHEREAS, the Aspen City Council may approve signs on public right-of-way per Section 26.510.110 which states: It shall be unlav.;[ul to erect or maintain any sign in, on, over or above any land or right-of-way or on any property, including light posts, belonging to the City of Aspen without the permission of the City Council. Businesses shall apply for a free sign permit at the Community Development Department to determine the size and location of the proposed sandwich board sign. All other signs shall be subject to the requirements and fees in Sectioin 26.410 and the fee schedule. 2. Signs must be removed from the right-of-way and placed inside the business every night. 3.
