A RESOLUTION OF THE ASPEN CITY COUNCIL, GRANTING A
TEMPORARY USE APPROVAL TO ALLOW FOR BICYCLE RENTAL IN THE
PARKING LOT OF THE ASPEN RECREATION CENTER, 861 MAROON CREEK
ROAD, ISELIN PARK PUD/SP A, CITY OF ASPEN, PITKIN COUNTY, COLORADO.

WHEREAS, pursuant to Section 26.450 of the Aspen Municipal Code, the Applicant,
the City of Aspen Parks and Recreation Department, has submitted an application for a
Temporary Use Permit to do bicycle rentals out of the parking lot of the Aspen Recreation Center
(ARC), Iselin Park PUD/SP A, City of Aspen; and,
WHEREAS, the Applicant requests the temporary use through the end of September,
2004; and,
WHEREAS, the Community Development Department has reviewed the temporary use
application and recommends that the City Council approve the temporary use permit with
conditions; and,
WHEREAS, City Council finds that the proposed temporary use is consistent with the
character and existing land uses of the surrounding parcels and neighborhood and that granting
the temporary use permit will not adversely impact the neighborhood; and,
WHEREAS, the Aspen City Council has reviewed and considered the temporary use
request under the applicable provisions of the Municipal Code as identified herein, has reviewed
and considered the recommendation of the Community Development Director, the applicable
referral agencies, and has taken and considered public comment at a public hearing; and,
WHEREAS, the City Council finds that the temporary use request meets or exceeds all
applicable development standards and that the approval of the proposal, with conditions, is
consistent with the goals and elements of the Aspen Area Community Plan; and,
WHEREAS, the City Council finds that this Resolution furthers and is necessary for the
promotion of public health, safety, and welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN,
COLORADO, THAT:

Section 1:
In accordance with Section 26.450.020 of the Aspen Municipal Code, the City Council of the
City of Aspen, Colorado, does hereby grant approval of a temporary use permit to allow for
bicycle rentals in the parking lot of the Aspen Recreation Center (ARC), subject to the following
conditions:
I. This temporary use permit shall expire on September 30, 2004.
2. On-site signage associated with the temporary use shall meet the City of Aspen
sign code regulations established in Land Use Code Section 26.510, Signs.
Section 2:
This Resolution shall not effect any existing litigation and shall not operate as an abatement of any
action or proceeding now pending under or by virtue of the ordinances repealed or amended as
herein provided, and the same shall be construed and concluded under such prior ordinances.
Section 3:
If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason
held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and shall not affect the validity of the remaining
portions thereof.
FINALLY, ADOPTED, PASSED, AND ApPROVED by a five to zero (5-0) vote on June 28, 2004, at
a public hearing before City Council.

SUMMARY:
The Applicant, City of Aspen Parks and Recreation Department, is requesting a
temporary use permit to do bicycle rentals during the summer season at the Aspen
Recreation Center (ARC). The Community Development Department has reviewed the
request and recommends approval of the temporary use permit, with conditions.
PREVIOUS COUNCIL ACTION:
There have not been previous Council actions to allow for temporary uses at the ARC.
BACKGROUND:
The Applicant would like to do bicycle rentals at the ARC for the summer season, which
is not currently allowed as a permitted use under the Iselin Park Specially Planned Area
(SPA) or underlying Park Zone District. Therefore, the Applicant has applied for a
temporary use that is not to exceed one hundred eighty (180) days. Operationally, the
Applicant is proposing to rent the bicycles out of a small, temporary structure/tent to be
erected in the ARC's parking lot and the bicycles are likely to be stored below the upper
entrance to the ARC when not in use. City Council may approve, approve with
conditions, or deny the proposed request after considering a recommendation from the
Community Development Department and after taking and considering public comments.

STAFF COMMENTS:
Staff believes that the Applicant's proposal to do bicycle rentals out of the ARC for the
summer season is compatible with the recreational nature of the facility and the Iselin
Park site. Additionally, Staff feels that the proposal is consistent with the goals of the
Parks and Open Space section of the Aspen Area Community Plan (AACP) in that
bicycle rentals at the ARC would further the recreational opportunities available to
visitors and citizemy of the community and would increase the convenience of said
opportunities.
Moreover, Staff does not feel that the proposal will have considerable negative impacts
on parking or traffic. Parking was a primary issue in the original PUD/SPA review for
Iselin, but it appears that the parking concerns associated with the ARC have never really
materialized except during special events. That being the case, the Recreation
Department has indicated that they anticipate that the existing parking lot at the ARC is
sufficient to accommodate the proposed temporary use.
ARC Parking Lot on a Weekday Afternoon
Operationally, the Applicant has proposed to store the bicycles in the unused area under
the ARC's upper entrance at night and when the bicycle rental operations are not in use.
Also, as was discussed previously in the memorandum, the Applicant is proposing to
construct a temporary tent structure in the parking lot to run the rental operations out of.
Staff feels that the proposed temporary structure is very modest in size and will not have
a considerable visual impact from Maroon Creek Road and is proposed to be removed
from the parking lot every evening to free up the two (2) parking spaces on which it sits.
RECOMMENDATION:
Staff feels that the proposal meets the temporary use review standards and recommends
that City Council approve with conditions, the proposed temporary use to allow for
bicycle rentals at the Aspen Recreation Center (ARC) until the end of September.

REVIEW CRITERIA AND STAFF FINDINGS:
26.450.030 Temporary Use
When considering a development application for a temporary use, City Council shal1
consider, among other pertinent factors, the fol1owing criteria:
A. The location, size, design, operating characteristics, and visual impacts
of the proposed use.
Staff Finding:
Staff believes that the operating characteristics of the proposed temporary use have been
appropriately considered to reduce visual impacts in that the Applicant has proposed to
store the bicycles in the storage areas beneath the ARC's entrance at night and when they
are not in use. In addition, the proposed temporary structure is modest in size and will be
removed from the parking lot every evening. Staff finds this criterion to be met.
B. The compatibility of the proposed temporary use with the character,
density and use of structures and uses in the immediate vicinity.
Staff Finding:
Staff believes that the proposed temporary bicycle rental operations are consistent in
character with the other recreational uses on the site and that the proposed use wil1
compliment the other recreational amenities that are available on the site. Staff finds this
criterion to be met.
C. The impacts of the proposed use on pedestrian and vehicular traffic and
traffic patterns, municipal services, noise levels, and neighborhood
character.
Staff Finding:
Staff does not believe that the proposal will have significant impact on vehicular traffic in
the area. The proposed bicycle rental operations are intended to be modest in scope.
Additional1y, Staff does not believe that the proposal will considerably increase the noise
levels on the site in that Iselin is a place that contains athletic fields and has traditional1y
been a noisy place during the day. Staff finds this criterion to be met.
D. The duration of the proposed temporary use and whether a temporary
use has previously been approved for the structure, parcel, property or
location as proposed in the application.

Staff Finding:
The Applicant has proposed the bicycle rentals on a temporary basis to conclude by the
end of September, which is well within the ISO-day time limit in which City Council may
grant a temporary use approval. Staff finds this criterion to be met.
E. The purposes and intent of the zone district in which the temporary use
is proposed.
Staff Finding:
Staff feels that the proposed temporary use is consistent with the intent of the underlying
Park (P) Zone District in that it furthers the recreational opportunities available on the site
without significantly disrupting the surrounding land uses. Staff finds this criterion to be
met.
F. The relation of the temporary use to conditions and character changes,
which may have occurred in the area and zone district in which the use
is proposed.
Staff Finding:
Maroon Creek Road has long entertained groups of bicycle riders during the summer
months, but the construction of the ARC as a center for recreational activities in the upper
valley makes it a sensible place to rent bicycles in an effort to expand the recreational
opportunities available to the local citizenry and tourists as is consistent with goals of the
Parks and Open Space section of the AACP. Staff finds this criterion to be met.
G. How the proposed temporary use will enhance or diminish the general
public health, safety, or welfare.
Staff Finding:
Staff does not believe that the proposed temporary use will diminish the general public
health, safety, or welfare. Conversely, Staff feels that additional bicycle rental
opportunities will promote general public health. Staff finds this criterion to be met.

Funny you should bring this up, I just finished meeting with Kevin from Aspen Bike Tours. Here is
what I have:
. they would set up at the end of the parking lot and use two spaces.
. they will set up a canopy for the (1) employee.
. they would have a small sign right there letting people know that there are bike rentals and the
cost.
. the impact to parking is almost none as we only have at most about 75 spaces occupied at once
during the day and there are about 110 spaces total.
. They are going to operate from 9am to 5pm each day and that would free up the two spaces for
softball when the lot get busy.
. They will pay the city 15% (you may not need to know this)
. they will have 10 bikes to start, 20 max if this goes well.
. they will store them under the upper entrance to the ARC or behind the shed's we have next to the
tennis courts.
. they would like approval to go through September, but if this is not working they would shut
down earlier.
This should help you to get started. I see this as a minimal impact. They are hoping to advertise that
people can ride up Maroon Creek Road and start from the ARC as many tourist would love to see how
far they can get, but they don't want to begin from town.
Let me know if you have any other questions. I will get a memo together for Council with the Contract
attached. I have a call in to GIS to get the addresses of the neighbors. When do I have to have this

BICYCLE RENTALS AT THE ARC
Summary:
Council showed interest earlier this year in the potential for bicycle rentals at the ARC.
Staff moved forward and placed a request for proposals in the local newspapers. One
proposal was received from Aspen Bike Tours and Rentals (see attached contract).
Council has the ability to approve and staff is seeking a temporary permit for the purpose
of bicycle rentals at the ARC.
Key points in trying this on a temporary basis are:
1. Aspen Bike Tours will occupy two (2) parking spaces at the ARC. This
should not be of concern during the hours of 9am to 5pm.
2. Aspen Bike Tours will operate seven (7) days a week.
3. Aspen Bike Tours will store the bicycles under the upper entry platform of
the ARC.
4. Aspen Bike Tours will pay the City of Aspen 15% of the gross revenue
they take in.
5. Any signs identifying the bike rentals will meet code.
6. They will operate with one employee and a small canopy to protect that
employee from the weather.
7. Aspen Bike Tours will operate with a minimum of 10 bicycles to begin
and not exceed 20 if the program is greatly successful.
Staff is asking that the temporary permit be granted through September of2004. If the
bicycle rentals are not successful after 1 month or so of operations, Aspen Bike Tours
would cease operations at the ARC. If this trial goes well then September would be the
latest that rentals would be available.

James, so now you want the government to go into competition
with already existing bike rental shops - this is absurd - stay out
of this kind of competition with private businesses. You folks
built a rec center that is way too big - you built it on "linear"
projections - projections that did not happen. You will never
get the number of people you projected - admit the mistake -
and now you are flushing more money down the toilet - two
new (unnecessary and very expensive) bike paths - Cemetary
Lane and Maroon Creek Road. I advocate taking away any
money from your departments - it is the only way to deal with
your ridiculous excessive spending. 1 want this letter read at
any hearings/meetings on this issue.

Rezoning or text amendment. Whenever the official zoning district map is in
any way to be changed or amended incidental to or as part of a general revision
of this Title, or whenever the text of this Title is to be amended, whether such
revision be made by repeal of this Title and enactment of a new land use

James, so now you want the government to go into competition
with already existing bike rental shops - this is absurd - stay out
of this kind of competition with private businesses. You folks
built a rec center that is way too big - you built it on "linear"
projections - projections that did not happen. You will never
get the number of people you projected - admit the mistake-
and now you are flushing more money down the toilet - two
new (unnecessary and very expensive) bike paths - Cemetary
Lane and Maroon Creek Road. I advocate taking away any
money from your departments - it is the only way to deal with
your ridiculous excessive spending. I want this letter read at
any hearings/meetings on this issue.
