The meeting was called to order by Mayor Garfish at 7:30 PM with Councilmen Ander- son, Braun, Jsmes and Beyer, City Administrator Wurl and City Attorney Stewart present. Reference was made to contract with Mills on street work, which was discussed. Scavenger Mayor Garfish said that Victor Goodheart is taking over the scavenger service con- contract tract from Benboe, and Attorney Stewart suggested that contract which Benboe held be examined by Council~ to arrange for any desirable changes. The closing date for bids on the bridge on Rt. 82 has been changed from February 1 to February 7. Councilman Anderson is working to procure field notes. The minutes of the meetings of January 17, 19 and 23 were read, and~the following changes were noted: Bill~Dunaway did not get letter from Bob Kirchner at that time but a copy'has since been given to him. Regarding ~he motion for iBcrese in wages, a review of the records shows that Elbert Wages Tacker has been receiving $2.05 an hour, and a motion was made by Anderson, seconded by Elbert Tacker. James, that this amount of hourly wage is to be continued and previous action of Council is approved. Carried unanimously. A motion was made by Anderson, seconded by James, to accept the minutes with these changes noted. Carried unanimously. The Treasurer's report was then read by Treasurer John Hall, and Wurl is to look into the matters under discussion, and approval was withheld until next regular meeting. The City's bills payable were read, and also the accounts payable of the Special Rater Fund. Bill from Herlad ~otors on Ford Truck to be held for further information. A motion was made by Anderson, seconded by Beyer, to suspend Rule 19 and allow the other amounts. Carried unanimously. ~John Doremus outlined to Council the experimental plan of the Planning and Zoning Commission for parking and sidewalks. For sidewalks in business area they recommended a Parking- 7 foot walk with planter and 1' 6" outer edge. Discussed - plowing, planter holes rather sidewalks. than strips. Jchn referred to curb and gutter program, on which a decision has not yet been made, and said ~hey would like the opinion of the Council on this. The Planning Commission would like to go ahead on two programs for parking, on Cooper land Hunter,- by making Cooper between Galena and Mill a one-way, street with angle parking S~eets on both sides-East to West, and making Hunter a dead end streeT. It was decided to take Oneway. no action on Hunter until feasibility had been demonstrated. ~6hn~asked approval of ~ouncil to take action on Cooper. He presented plan and said the 4"foot_green strip would be deleted. Attorney Stewart said plan should be filed with Clerk. A motion was made by James, seconded by Braun, to make Cooper between Mill and Galena one-way West, and Hymen between Galena and Mill one-w~ East, on an experimental basis according to plan filed wit! City Clerk. Wurl will talk to businesses on Cooper about this. Carried unanimously. Poremus said they were working on~ plans for residential district but these would take time. Mayor Garfish auggested special meeting with Planning Board on street and parking problems. Louis Sparovis again inquired about getting m deed to~i~ property. Mr.' Stewart read Louis a letter from Attorney Ma~sen regarding Henry Clay Lode. Reference was made to East Aspen Spmmvic plat, and Mr. Stewart said obligation to identify land is claimants. He. believes there East Aspen should be a survey of land west of Henry Clay Lode. Louis asked what he would have to do Patent to prove that the Herron's have no claim to land he claims. M~. Stewart said that the engineer making the survey should certify to Council that there is no conflict on the land claimed by Sparovie west of the Henry Clay Lode, bef6re issuance of deed can be considered Also, Attorney Melman should be consulted on this. Jim Moore and Mr. Norton were present to ask about the 18foot strip for access as requested by Bob Card, and the~ part of Cleveland Street not owned by Deaconess Crow. Afte B1 25 & 26 discussion a motion was made by Anderson, seconded by Braun, that Lot S, Block 26 and 18' strip- ClevelardStreet to the northerly line of the south half of said Blocks between Blow,ks Crow/ 25 and 26 and Lot K, Block 25, East Aspen, be conveyed to Deaconess Crow, and that the west 18 feet of Lot L Block 25 be reserved by_the City of Aspen for future determination; and Deaconess Crow be required to convey said 18 feet of Lot L to the City of Aspen; that said 18 foot s~rip is reserved by the City for access to the alley in Blocks 25 and 26, subject to the rights of individual claims. Carried unar~nously. Mr. Miller of the Blue Flame Ga~ Company said they were working on a deal to deliver natural gas to Basic Chemical Plant in Glenwood Springs. He said the company could furnis! propane to Aspen this coming Fall and that if they can have a 30 day option on a fran- Blue Flame chise,will furnish a $200,000 performance bond and a commitment from Moab on field. Dis- Gas Co. cussion covered reserves and possible cost. Mr, Miller said that as yet there is no fixed contract with Basic Chemical. He plans to talk with Glenwood Springs Council on Tuesday. It wBs suggested that they present a proposal to Aspen based on cuFrent developments, outlining financial responsibility and reserves, and ability of company to furnish gas through life of franchise. Attorney Stewart said road in question is not the property of the Roy's as their access is the upper road - that the City does nnt conceed that the road in question is the property of th~ Roy's. Diversion Jim Moore referred to water that has been ajudicated and which is overflowing. This was deemed not to be the City's responsibility. Diversion into Castle Creek put on agenda for Spring. Wurl will present proposal for outsider water users at the Feb. 20th Meeting. He will write to Highway Dept. about speed reduction signs and grade on Highway 82. FBI Course. Council approved sending Officer Glen Ricks to the FBI Course. Rocky Mtm. Mr. Porter of the Rocky Mountain Natural Gas Co. came in say that they ~re still Nat'l Gas. interested in franchise and that he expected to meet with Glenwood Springs Council soon. He also told Council that no one as yet has a contract with Utec Gas. Glory Hole Attorney Stewart is in process of contacting the people involved in the matter of land the land at the Glory Hole, having arrived at an average of the Bppraisal rates. Jim Moore asked for more informatio~ on this and Council outlined the problems involved, i.e. squaring off property of Emmerick's and Larkin's. His appraisal of the land involved was 45 to 50 cents a square foot. City Dump He asked if if was necessary to burn at the City Dump, and offered to exchange land under the shale bluff between the river and the road in exchange for the present dump property. Ford Truck Mayor Garrish said the Kopp o{ ~Herald Motors had t~ld him that the new Ford Truck Year is a 1960 model and not 1961 as bid. Wurl will look in~o this. Contractors' There will be a meeting with the contractors about,the proposed'licensing ordinance ord. on Wednesday, February 8, and Markalunas will inform them - time - 7:00 PM. Wurl's report continued: Police and Fire calls still pending. No. 2 ~Series 1961 Ordinance No. 2, Series 1961, An Ordinance Vacating ~he Alley in Block 66 of the Alley B1 66 Original Townsite and City of Aspen and Reserving an Easement for Public Utilities, was read in full by Attorney Stewart for the first time. A motion was made by Beyer, sec- onded by Braun, to adopt the ordinance and order it published. Carried unanimously. Ord. 11, Series Ord. No. 11, Series 1960, general business licensing - to be discussed at con- 1960 Gen'l tractors' meeting. Bus. Lic. ~ttor~ey Stewart referred to the .deed of Trueblood and Minor, Lots T and U, Block 34, Deeds signed. East Aspen, also to the deed clearing title for Pastore's and Council agreed that it was in order for Mayor Garfish to sign these. Stewart also referred to the Rio Grande RR deed, Rio Grande RR and said the Railroad has recommended the right-of-way, and that everything has been Deed resolved, and he would like to issue deed. This was approved by Council. Mayor Garfish read the following letters: From Peters, Writer and Ch~istensen, re confirmation and purchse of power refunding bonds. .About meeting of Colorado River Basin in Phoenix. Flora Dora 2% The Clerk informed Council the the Flora'Dora Lodje has not remitted the 2% Improve- Tax. ment Tax for !960, and she was instructed to hold up motel license until received. Attorney Stewart presented petition from Fritz Benedict on behalf.of George Mitchell Petition- for the vacation of a portion of Ute Ave., from the intersection with Original Street Vacation of Northerly and Westerly to the intersection of Spring St., and the Southl line of Block 102. part of Ute Ave. It was suggested that this be given study and that plans be submitted. Bill Dunaway said that one of the police officers had stopped a young man, reported- ly without cause, and questioned him. Mayor Garfish will ask the Police Chief about this.
