(ncreinafu:r APPLICANT) AGREE AS FOLLOWS:
I. APPI.ICANT has submitted to CITY an application for

(hereinafter, THE PR01F.CT).
2. APPLICANT lIndcrslamls and agrees that City of Aspen Ordinance No. 57 (Serles of
2000) eSlabli.,he. a fee structure [or Land Use applications and the paynlent of all processing fees is a
cOlldirion precedem to a determination of application completeness.
3, APPLICANT and CITY agree tbat.because of the size, nature or scope of tbe proposed
project, it is not possible at tbis time to ascertain the full oxtent of the costs involved in processing the
application. APPLICANT and CITY furlhcr a6'1'ee that it is in the intertst of the parties that APPLICANT
make payment of an initial deposit and to lilereaftcr pemlit addition.l costs to be billed to APPLICANT on
. monLhly basis. 'APPLICANT agrees addirional costS may accrue following lheir hearings andlor
approvals. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make
additional payments upon notification by the CITY when they are necessary as costs are incurred. CITY
agrees it will be benefited through the greater certainty of' recovering iI'S full coSIS III process

4. CITY and APPLICANT further "6'1'ec that it is impracticable for CITY staff to complete

unless cUItent billings arc paid in full prior to decision.
5. Therefore. APPLICANT agrees that in consideration of the CITY's waiver of its right 10
collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial
deposit in the amount ocs.iJ.L which is for hours of Community Development STaff
time, and if actual Iecorded cos!.' exceed the initial deposit, APPLICANT shall pay additional monthly
billings to CITY to reimburse the CITY for the processing of the .pplicalion mentioned above, including
post approval review at" rate of$205.00 por planner hour over lhe initial de'POSil. Such periodic payments
shall be made within 30 days of the billing dare. APPLICANT further agrees \hat [ailure to pay such
accrued costs shall be grounds for sllspemion of processing, and in no case will building permils be issued
until.1I costs associated witll case processing have been paid.
