Aspen~ Colorado Special Meeting, Aspen City Council, June 26, 1961
The special meeting was called to order at 7:30 PM by Mayor Garfish with Council-
men Anderson, Beyer, Braun and James, City Administrator Wurl and City Attoroey Stewart
present.
Mayor Garfish read a letter from Dr. Houston for the Aspen Citizens' Council, of-
~Armory Hall feting their assistance in City matters. Also letter from the Aspen Lodging Association
requesting consideration of the matter of making Armory Hall suitable for conventions.

These were discussed and it was suggested that Wurl check the specifications to see
just what is involved, and refer plans to each C~uncilman before the July 3 meeting~
Mr. D.R.C. Erown, Mr. Edgar Stanton and Mr. William Hodges were present for
Aspen Skiing Corporation, in the interest of the request of the Skiing Corporation for
Alley Bi 102 the vacating of the alley in Block 102 and a portion of Ute Avenue, and for the con-

Hodges will send a letter to Council on this.

Councilman Braun wants assurance that the inhabitants of Aspen will not be pro-
hibited from the use of the ski terrain for skiirgor jumping.
Mr. Braun also asked about parking at Little Nell area, and Mr. Brown informed
Council that they are building a new warehouse, and would provide about 2/3 of a block
of additional parking space.
Wurl asked if the Skiin~ Corporation would need another tap while line is open,
and he will follow up.
Attorney Stewart outlined that the aim of both the ~lty and the Skiing Corp. is to
record action re.~ardlng the access from Durant St to Ute Ave., 10 feet is to be
conveyed to the Glory Hole Motel and 40 feet to the City of Aspen. An ordinance will
be prepared covering vacati.on of alley and portion of Ute Ave.. The City will re-
lease the easement after assurance that the public right will not be affected, and the
Skiing Corporation will ~ive deed to the City covering land at location of the new well.
After careful consideration of the foregoing, the following motion was made by
Anderson, and seconded by Beyer:
Motion That after discussion by Council with the officers of the Aspen Skiing Corpo_atzon
present - D.R.C. Brown, Edgar Stanton and William Hodges - the City Council approve the
vacation of the alley in Block 102 and that portion of Ute Avenue southerly of said
Block 102 and westerly of vacated Spring Street, and that the City accept the conveyance
of a strip of land 40 feet wide extending from Durant Street southerly to the inter-
section with Ute Ave. from the Aspen Skiing Corporation, which ~0 foot strip shall be
located parallel to and 10 feet westerly of the east line of said Block 102, and that
the Uity shall accept an easement or a conveyance of that portion of Hunter Street

upon which is situate a well which has heretofore been drilled by the City with the per-
mission of the Aspen Skiing Corporation, which piece of land shall be approximately 10 ft.
by 20 ft. with the length running north and south, together with appropriate ease-
ment for connecting said well to the City ~ystem; ~
And that the City Council does hereby release all right, title and interest in and
to certain rights of way and easements dated June 11, 1938 and recorded, in Book 167~
Page 84, of the records of Pitkin County, in which the City is identified as the Lessee
and Spar Consolidated M~nes Co. is identified as Lessor, providing, however, the Aspen
Ski Corporation has hereby agreed to deliver, to the City of Aspen rights-of-way and
easements providin~ that the inhabitants of Aspen shall not be prohibited in utilizing
the ski terrain and jump~facilities of the property described in said rights-of-way a~d
easements for skiing purposes, except t~.at in the event such persons should request use
of lift facilities operated by .the Aspen Ski Corporation, then in that event they shall
liable for the payment of such charges as shall from time to time be established for
the public generally according to the classification within which any such person shall
fall. The motion carried unanimously.
Attorney Stewart reviewed the summons from William A. Russell,-an action for an Injunction
injunction against enforcing or attempting to enforce the City of Aspen Ordinance No. 7, Summons
Series of 1961, against him as an attorney and counselor at law in the City of Aspen. Ord. 7,1961
Mr. Stewart said this is based on-the fact that attorneys are licensed by the State.
He will answer the summons on July 6, 1961.
Mr. Stewart said he h~d received many comments on the proposed contractors' lic- Contractors'
ensing ordinance, and that he had explained that it is not discriminatory. Ord.
Discussed - tree trimming, and a bid had been received from MidwesternTree Service: Bid-tree
Trimming $25.00 per tree trimming
Removing 75.00 per tree in sections
" 45.00 per tree - free fall
No stumps removed.
Council asked Wurl about water in ditches and he explained the work that had been Ditches
done and the difficulty he i$~aving due to ditches having been filled in by people who
said they had received permission to do so. He was advised to rerou~where feasible
and to do the best he can at present to get the water running.
Discussed - complaint from Mrs.Wirth that at times she had no water pressure;-
getting water into tank
leaks in Aspen St., outside City limits.
Mr. Stewart and Mr. Wurl are working on policy covering maintenance areas outside '~
the City.
Upon motion by James, seconded by Beyer, the meeting was adjourned at 10 PM.
