Aspen Street Applicant: Aspen United Soccer Club Zone District: Park Land Use Request: Temporary Use request to use former "Aspen Valley Ski Club. Offices" as temporary administrative offices and storage space for the Aspen United Soccer Club. SUMMARY: The Applicant, Aspen United Soccer Club, is requesting a temporary use permit to use the former "Aspen Valley Ski Club Offices" located in Willoughby Park throughout the year as administrative -offices and storage space in conjunction with their youth soccer activities. Additionally, -the Applicant has proposed not to use the space as administrative offices for more than one hundred and eighty (180) total - days in this year. The Community Development Department has reviewed the request and recommends approval of the temporary use permit. PREVIOUS COUNCIL ACTION: This building was previously used as offices for the Aspen Valley Ski Club, but Staff has found no formal approval that allowed for .the previous office use on the site. PROPOSED OPERATIONS: The Aspen United Soccer Club has proposed to house their part-time administrative assistant (approximately twenty (20) hours per month) in the building at Willoughby Park and conduct one board meeting per month in the structure. In addition, occasionally the Soccer Club will hold a coaches meeting or workshop in the space. The Applicant has " P17S .' ~ requested approval of the office temporary use for not more than 180 days in this year, but has also requested that the City Council grant the Community Development Director the ability to renew the temporary use for subsequent years if the character and operations, of the proposed use do not substantially change from this original application. STAFF COMMENTS: The property is currently zoned Park and is leased from the City by the Aspen Historical Society. Because they are not in a position to create a ski museum at this location at this time, they have agreed to sublease the space to Aspen United Soccer. Staff does not believe that the proposed use is different than the previous office use that existed on the site for the Aspen Valley Ski Club. Staff also feels that parking will not be an issue given that there are approximately eight (8) to ten (10) parking spaces dedicated for park use only and approximately fifteen (15) additional public parking spaces in the adjacent parking lot that are signed as general 2-hour parking. Additionally, there are many unused, on-street parking spaces on the adjacent South Aspen Street that should' be . available for use by the proposed operation. Staff feels that trash disposal needs to be addressed in that unpacking of uniforms and equipment will likely take place on-site and will generate trash such as boxes and packing materials. That being the case, Staff has suggested a condition of approval in the proposed resolution that requires the Applicant to properly dispose of trash off-site and not burden the trash disposal facilities in Willoughby Park. Moreover, Staff bas proposed a condition of approval that establishes that the Applicant may not store equipment outside of tlle office/storage structure in an effort not to compromise the aesthetics of Willoughby Park as a result of the proposed temporary use. In addressing the Applicant's request to allow for the Community Development Director to have the authority to approve subsequent temporary use. requests to use this structure in a similar fashion for Soccer Club offices/storage in subsequent years, Staff feels that this provision is appropriate and will save City COlillcil review time in subsequent years. That being said, Staff does want City Council to be aware that this is different from most temporary use requests in that the Applicant is requesting not to use the structure as an office for more than one hundred and eighty (180) days out of this year, thereby making it temporary in nature. This differs from the typical temporary use in that the temporary use time period is normally a maximum of one hundred and eighty (180) consecutive days rather than the one hundred and eighty (180) aggregate, non-consecutive days as is proposed in this application. However, temporary uses have been previously granted in the manner proposed. Staff also feels that including an administrative review provision will prevent a situation similar to that that has occurred with the Colorado Riff Raft Temporary Use in past years, whereby City COlillcil reviews the saine application every year. Thus, Staff has included a condition of approval in the proposed resolution that allows for the Conirnunity Development Director to administratively approve subsequent similar temporary use .~ P179 requests for this property to be used by the Soccer Club as part-time offices/storage in future years, if allowed by the Aspen Historical Society. REZONING: Staff was asked why we are not rezoning the property at this time to accommodate the museum use that was conceptually approved for the property by voters in the early 1990's. In response to this question, Staff believes that the existing zoning is appropriate for the site in its current primary capacity as an open use recreational area. Additionally, Staff feels that if the site is to be redeveloped with a museum in the future, the, rezoning application should be considered in conjunction with such an application to make sure that the zoning to be given to the parcel adequately fits the anticipated uses, within a museum. RECOMMENDATION: Staff recommends that City Council approve with conditions, the proposed temporary use request to allow for the Aspen United Soccer Club to use the former "Aspen Valley Ski Club Offices" in Willoughby Park as part-time administrative offices and storage for a period of time not to exceed a total of one htmdred and eighty (180) days in this year. RECOMMENDED MOTION: "I move to approve Resolution No.~, Series of 2004, approving with conditions, a temporary use permit to allow for the Aspen United Soccer Club to use the structure addressed as 700 S. P183 EXHIBIT A REVIEW CRITERIA AND STAFF FINDINGs: 26.450.030 Temporary Use When considering a development application for a temporary use, City COlIDcil shall consider, among other pertinent factors, the following criteria: A, The location, size, design, operating characteristics, and visuaUmpacts of the proposed use. Staff Finding: The Applicant is not proposing to alter the structure except as is required by the building code to make it habitable as an office structure. Staff has proposed conditions of approval to regulate the operating characteristics of the proposed use. The proposed conditions of approval require the Applicant to appropriately dispose of trash off-site and to not store equipment outside of the structure to maintain the aesthetics of the park. Staff [mds this criterion to be met. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. Staff Finding: .The immediate vicinity contains a variety of uses that include lodges, restaurants, and multi-family residential buildings. In addition, in the past seasonal rafting companies have used the area as a seasonal base for their rafting operations. Given the variety of uses in the vicinity, Staff finds this criterion to be met. C. The impacts of the proposed use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. Staff Finding: Staff does not feel that the proposed temporary use will have significant impacts on traffic generation in the immediate area. Furthermore, Staff has proposed a condition of approval that requires that trash disposal as result of the proposed temporary use not burden the trash disposal facilities in Willoughby Park. Additionally, Staff is not overly .concerned about noise generated by the proposed temporary use in that the functions taking place on the site would appear to be administrative in nature, which typically . 'involve quiet, indoor actions. Staff finds this criterion to be met. D. The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. P184 - Staff Finding: . The Applicant has requested an initial temporary use of not more than 180 aggregate days in this year, but has also requested that City Council grant the Community Development director the authority to approve subsequent temporary use requests to use this structure in a similar fashion for Soccer Club offices/storage in subsequent years. Staff feels that this provision is appropriate and will save City Council review time in subsequent years. Staff finds this criterion to be met. E. The purposes and intent of the zone district in which the temporary use is proposed. Staff Finding: The subject property is located in the Park Zone District, which allows for open-use recreation facilities, parks, playfields and accessory uses and structures. Staff feels that the part-time administrative office/storage use related to the Soccer Club's operations is compatible with the Park Zone District's intent statement. Staff finds this criterion to be met. F. The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed. Staff Finding: Staff does not believe that there have been significant character changes that have occurred in this neighborhood since the Aspen Valley Ski Club operated it's recreational club out of the subject property. That being the case, Staff does not really find this standard applicable to the proposed temporary use request. G. How the proposed temporary use will enhance or diminish the general public health, safety, or welfare. Staff Finding: Staff does not believe that the proposed t~mporary use will diminish the general public health, safety, or welfare. The Fire Marshal and the Building Department have been consulted and do not have an issue with the proposed temporary use. Moreover, Staffhas proposed several conditions of approval to ensure that the proposed use does not affect the aesthetics or safety of the site. Galena Street Aspen, CO .81611 Dear James; I am writing to formally request a Temporary Use Permit in order to use the old Aspen Valley Ski Club offices as an administrative office for the Aspen United Soccer Club (AUSC). The property is located at 700. S. Aspen Street. The structure and land is currently under a long term lease by the Aspen Historical Society from the City of Aspen. The Historical Society supports our efforts to locate our organization into this site temporarily and we will enter into a lease with them. The AUSC is a non-profit organization that strives to develop young soccer players through training, practice and competitive soccer match playing. It is also our goal to engender the spirit of fun, sportsmanship and friendship to our approximately 150 youth participants. We are made up of a volunteer board, we have part-time administrative help and we hire a number of soccer coaches during the seasons. The nature of our use is very light office use. We would also store our club uniforms and equipment in an area of about 10 ft. x 10 ft. Our administrative files and records would be kept in the building. Typical usage of the building would entail one board meeting a month, usually from 5-7:30 p.m. Occasionally we might conduct a coaches meeting or workshop. The administrative functions conducted at the site would entail our administrative assistant handling paper work, computer work and phones calls for maybe 20 hours per month. .At times there would belittle use of the building when we are not preparing for or within a playing season. (AUSC plays in Fall and Spring only.) Parents would be able to hand deliver registration papers, uniforms, etc. to the site; however, most of the . registration and equipment handling is done through the mail, at practices or at the public schools. It is possible that a special meeting would be held by the club for such things as a team parents potluck, a guest speaker or other typical clubhouse activities. AUSC is not proposing any changes to the exterior of the building except for any aesthetic or repairs necessary to make the building more energy efficient. The building has been vacant for several years and is serving the storage needs of the Historical Society. It will continue to serve this storage function for the Society. AUSC will keep the building heated and lit (as needed) which will keep the building from premature disrepair and aging. We are asking that the requirement of a site improvement survey be waived in that no outside dimensional or site plan changes are being proposed. Given the non-profit status of our organization, we also ask that the City Council wajve the planning review fees for this rather straight forward application. Our Junding is raised by participation fees collected from our players. . We are respectfully seeking approval from the City Council for this worthwhile cause until such time as the Historical Society desires to use the structure .for other purposes or until AUSC finds a more permanent home. Aspen Street Applicant: Aspen United Soccer Club Zone District: Park Land Use Request: Temporary Use request to use former "Aspen Valley Ski Club .Offices" as temporary administrative offices and storage space for the Aspen United Soccer Club. SUMMARY: The Applicant, Aspen United Soccer Club, is requesting a temporary use permit to use the former "Aspen Valley Ski Club Offices" located in Willoughby Park throughout the year as administrative offices and storage space in conjunction with their youth soccer activities. Additionally, the Applicant has proposed not to use the space as administrative offices for more than one hundred and eighty (180) total days in this year. The Community Development Department has reviewed the request and recommends approval of the temporary use permit. PREVIOUS COUNCIL ACTION: This building was previously used as offices for the Aspen Valley Ski Club, but Staff has found no formal approval that allowed for the previous office use on the site. PROPOSED OPERATIONS: The Aspen United Soccer Club has proposed to house their part-time administrative assistant (approximately twenty (20) hours per month) in the building at Willoughby Park and con~uct one board meeting per month in the structure. In addition, occasionally the Soccer Club will hold a coaches meeting or workshop in the space. The Applicant has ,.... - requested approval of the office temporary use for not more than 180 days in this year, but has also requested that the City Council grant the Community Development Director the ability to renew the temporary use for subsequent years if the character and operations of the proposed use do not substantially change from this original application. STAFF COMMENTS: The property is currently zoned Park and is leased from the City by the Aspen Historical Society. Because they are not in a position to create a ski museum at this location at this time, they have agreed to sublease the space to Aspen United Soccer. Staff does not believe that the proposed use is different than the previous office use that existed on the site for the Aspen Valley Ski Club. Staff also feels that parking will not be an issue given that there are approximately eight (8) to ten (10) parking spaces dedicated for park use only and approximately fifteen (15) additional public parking spaces in the adjacent parking lot that are signed as general 2-hour parking. Additionally, there are many unused, on-street parking spaces on the adjacent South Aspen Street that should be available for use by the proposed operation. Staff feels that trash disposal needs to be addressed in that unpacking of uniforms and equipment will likely take place on-site and will generate trash such as boxes and packing materials. That being the case, Staff has suggested a condition of approval in the proposed resolution that requires the Applicant to properly dispose of trash off-site and not burden the trash disposal facilities in Willoughby Park. Moreover, Staff has proposed a condition of approval that establishes that the Applicant may not store equipment outside of the office/storage structure in an effort not to compromise the aesthetics of Willoughby Park as a result of the proposed temporary use. In addressing the Applicant's request to allow for the Community Development Director to have the authority to approve subsequent temporary use requests to use this structure in a similar fashion for Soccer Club offices/storage in subsequent years, Staff feels that this provision is appropriate and will save City Council review time in subsequent years. That being said, Staff does want City Council to be aware that this is different from most temporary use requests in that the Applicant is requesting not to use the structure as an office for more than one hundred and eighty (180) days out of this year, thereby making it temporary in nature. This differs from the typical temporary use in that the temporary use time period is normally a maximum of one hundred and eighty (180) consecutive days rather than the one hundred and eighty (180) aggregate, non-consecutive days as is proposed in this application. However, temporary uses have been previously granted in the manner proposed. Staff also feels that including an administrative review provision will prevent a situation similar to that that has occurred with the Colorado Riff Raft Temporary Use in past years, whereby City Council reviews the same application every year. Thus, Staff has included a condition of approval in the proposed resolution that allows for the Community Development Director to administratively approve subsequent similar temporary use ,I'..... "- requests for this property to be used by the Soccer Club as part-time offices/storage in future years, if allowed by the Aspen Historical Society. REZONING: Staff was asked why we are not rezoning the property at this time to accommodate the museum use that was conceptually approved for the property by voters in the early 1990's. In response to this question, Staff believes that the existing zoning is appropriate for the site in its current primary capacity as an open use recreational area. Additionally, Staff feels that if the site is to be redeveloped with a museum in the future, the rezoning application should be considered in conjunction with such an application to make sure that the zoning to be given to the parcel adequately fits the anticipated uses within a museum. RECOMMENDATION: Staff recommends that City Council approve with conditions, the proposed temporary use request to allow for the Aspen United Soccer Club to use the former "Aspen Valley Ski Club Offices" in Willoughby Park as part-time administrative offices and storage for a period of time not to exceed a total of one hundred and eighty (180) days in this year. Staff finds this criterion to be met. B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. Staff Finding: The immediate vicinity contains a variety of uses that include lodges, restaurants, and multi - family residential buildings. In addition, in the past seasonal rafting companies have used the area as a seasonal base for their rafting operations. Given the variety of uses in the vicinity, Staff finds this criterion to be met. C. The impacts of the proposed use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character. Staff Finding: Staff does not feel that the proposed temporary use will have significant impacts on traffic generation in the immediate area. Furthermore, Staff has proposed a condition of approval that requires that trash disposal as result of the proposed temporary use not burden the trash disposal facilities in Willoughby Park. Additionally, Staff is not overly concerned about noise generated by the proposed temporary use in that the functions taking place on the site would appear to be administrative in nature, which typically involve quiet, indoor actions. Staff finds this criterion to be met. D. That being the case, Staff does not really find this standard applicable to the proposed temporary use request. G. Galena Street Aspen, CO 81611 Dear James; I am writing to formally request a Temporary Use Permit in order to use the old Aspen Valley Ski Club offices as an administrative office for the Aspen United Soccer Club (AUSC). The property is located at 700 S. Aspen Street. The structure and land is currently under a long term lease by the Aspen Historical Society from the City of Aspen. The Historical Society supports our efforts to locate our organization into this site temporarily and we will enter into a lease with them. The AUSC is a non-profit organization that strives to develop young soccer players through training, practice and competitive soccer match playing. It is also our goal to engender the spirit of fun, sportsmanship and friendship to our approximately 150 youth participants. We are made up of a volunteer board, we have part-time administrative help and we hire a number of soccer coaches during the seasons. The nature of our use is very light office use. We would also store our club uniforms and equipment in an area of about 10 ft. x 10 ft. Our administrative files and records would be kept in the building. Typical usage of the building would entail one board meeting a month, usually from 5-7:30 p.m. Occasionally we might conduct a coaches meeting or workshop. The administrative functions conducted at the site would entail our administrative assistant handling paper work, computer work and phones calls for maybe 20 hours per month. At times there would be little use of the building when we are not preparing for or within a playing season. (AUSC plays in Fall and Spring only.) Parents would be able to hand deliver registration papers, uniforms, etc. to the site; however, most of the registration and equipment handling is done through the mail, at practices or at the public schools. It is possible that a special meeting would be held by the club for such things as a team parents potluck, a guest speaker or other typical clubhouse activities. We would utilize the existing on-street parking. The building has been vacant for several years and is serving the storage needs of the Historical Society. It will continue to serve this storage function for the Society. AUSC will keep the building heated and lit (as needed) which will keep the building from premature disrepair and aging. We are asking that the requirement of a site improvement survey be waived in that no outside dimensional or site plan changes are being proposed. Given the non-profit status of our organization, we also ask that the City Council waive the planning review fees for this rather straight forward application. Our funding is raised by participation fees collected from our players. We are respectfully seeking approval from the City Council for this worthwhile cause until such time as the Historical Society desires to use the structure for other purposes or until AUSC finds a more permanent home. We feel that this use is in keeping with the nature of the neighborhood, previous uses at the site and will keep the structure in good repair.
