Present were Mayor Garfish, Councilmen Beyer, Newell and Moore, City Administrator Humphrey, City Attorney Stewart. Also present were Jim Blanning and his attorney, Mr. ~Jack Kane, Walter Huber, Police Chief Baker, and Officers Ricks and Whitmire. Mr. Kane asked if they~could have a court reporter, and Mayor Garfish and Attorney Stewart agreed to this, but said Mr. Kane and his client would have to pay all costs for the reporter - not the City. Mayor Garrish read notice of hearing served on the Mollie Gibson. Mr. Kane asked if Council would continue this matter and specify conditions, and if complied with, Hearing- hearing would be reconvened. Mayor Garfish asked Council if hearing should be held, or if stipulations should be set and the hearing reconvened. Mr. Kane asked postpone- Jim Blanning merit of one hour, to bring in court reporte~. Council agreed that hearing should be dba held at this time, and there was a postponement of one hour to await arrival of the ~he Mollie courtreporter. Gibson Mayor Garfish re-opened the hearing at 6:15 PM. He referred to complaint filed against the Mollie Gibson by Walter Huber, and admonished Council to be~fair and to con- sider all the factors in this case. He then turned the hearing over to Attorney S~ewar~. Documents presented were 1. Complaint filed by Walter Huber-Police Magistrate 2. Complaint to City Council from walter Huber 3. Notice of Hearing - Aspen Unlimited dba Mollie Gib on. Mr. Kane objected to #1 because it is a complaint filed in the Police Magistrate's Court, and it was withdrawn from evidence. Mr. Huber was questioned regarding his complaint- Wi~esses we-me questioned regarding noise, .and s6ated either that Jim Blanning had closed doors of Mollie Gibson when requested~ or that they had not been disturbed. Police officers were questioned about meports on police blotter - no evidence presented that liquor had been served to minors. Jim Blanning assured Council that there would be no further~dancing on the bar, and that he would enforce the under age 21 provision, also that he is learning and trying to run the business well. He also said the front of the Mollie Gibson is being remodelled and that doors would be kept closed; also that he had been advised by State liquor inspectors to lower the sound of the music. Mr. Stewart advised Council that the matter at issue is Paragraph ~ - Regulation No. 19, of the Colorado Liquor Code, and he read this. Council concurred with recommendation ,of Councilman Moore to postpone decision until 7:00 PM, Monday, July 15, 1963 - regular meeting of the City Council. Mr. Kane said Council decision must become part of proceedings. The hearing was adjourned at 9:PM.
