HomeMy WebLinkAboutminutes.council.19631223 Aspen~ Colorado Special Meeting Aspen City Council December 23~ 1963 The meeting was called to order at 7:30PM by Mayor Garrish, with Councilmen Beyer, Braun, Melville and Newell,~City Administrator Humphrey and City Attorney Stewart present. Quit Claim deed ~ a motion was made by Councilman Beyer, seconded by Councilman Deed-Bi t00 Newell, to authorize the Mayor to sign quit claim deed to Olivia C. Dunaway to Lots Lots ~ and E D and E Block 100, in~and to the City and Townsite of Aspen. Motion carried un- animously. East Aspen Patent deed - duplicate - A motion was made by Councilman Beyer, East Aspen- seconded by Councilman Braun, to authorize the Mayor to execute a deed to Martin Deed-lots Q,R,S Mishmash to Lots Q, R and S, Block 34, East Aspen Additional Townsite,~as the Block 34 cost has been paid, and the original deed has been lost. Motion carried unanimously. Attorney Stewart referred to Herron vs City - East Aspen Patent - the Henry Herron- Clay matter has been settled - and he referred to the second suit, and said Mr. East Aspen Patent Herron has chain of title to certain mining claims - he pointed out un'map land claimed by Herron. Discussed that area claimed by Erickson should be excepted, also area claimed by Robert Kopp, and all public roads now in use. Mr. Stewart said only unpatented land in that area is concern of City, and he feels there is a basis for settlemen~of the second suit with Mr. Herron. --' Discussed- area claimed by G. E. Buchanan. Dr. Barnard had come in and Mayor Garfish explained this issue to him, as it still remains to be resolved. Council agreed in the opinion that Mr. Buchanan does not have a claim. Mr. Stewart expressed the opinion that Mr. Herron has a better claim, and that Mr. Buchanan has no claim to substantially any of the area lying north and east of Aspen Colorado Special Meeting, Aspen City CoUncil - December 23, 1963 the Roaring Fork River and shown in red on Plat No. 1 reviewed by Council at the meeting of December 23, 1963, on file in the office of~the City Clerk. Buchanan's only claim is based on leasing of ground from Herron from whom City is receiving a deed or disclaimer. i Deed- Mr. Stewart read ietter from George Petrie - Octobeu 24, 1963 - requesting a i ~Ed Smith deed for the heirs of Ed Smith. Mr. Stewart said no application had been filed and he feels Council is not involved. He will handle. Gary McFadden is to prepare description-based on fence lines- on claims of Anthony Harmon, John Harmon and Erickson, and small p6rtion of public land quit claimed to the City by Herron. Eb Tacker - if he was there before September 1958, Mr. Stewart feels he is entitled to consideration. This matter was tabled. Deeds- k motion was then made by Councilman Bgyer, seconded by Councilman Newell, Erickson and to authoriZe the Mayor to execute deeds to Erickson Tract John Harmon Tract, and Hannons Heirs of Anthony Hannon Tract, so long as same disclose description of land as shown on plat. Motion carried unanimously. Discussed - the piece of public land'- and Attorney Stewart said City is ob- ligated to retain for public purposes or sell at public auction, pursuant to statutes so made and provided. (Land between Sparovic's and road). DiScussed- that City is not obligated to survey - tha~ a man cannot be"platted" out of his land - and length of time land has been ~sed should be considered. Summons- Dr. Discussed- Summons served on City and Mr. Humphrey - Claim of Dr. Bernard - Bernard Attorney Stewart is to ask~ for postponement for obtaining more information. Discussed~ sand spreader - A motion ~as made by Councilman Newell, seconded by Motion Councilman Braun, to authorize the expenditure of not more than $675.00 to purchse Sand spreader a sand spreader - due to. immediate emergency. Motion carried unanimously. The meeting was adjourned at 9:30 PM upon motion by Beyer, seconded by Newell, and carried. I Mc Es Ps
