Present were Councilmen Barnard, Kuster, McEachern and Stapleton, City Treasurer Lum and City Attorney Balcomb. The accounts payable of the City were turned over to Councilman McEachern for review. City Adminis- Mayor Pabst then introduced Mr. John Kerrigan, the new City Administrator, trator The minutes of the regular meeting of January 20, 1964 were approved as read. Pending liquor licenses: Mayor Pabst referred to application of Independence Restaurant Company - that Motion-Liq plans are being revised for more adequate kitchen facilities. Mr. Robinson has Lic. Ind. Co. been contacted and he is willing to have this matter tabled. A motion was made by.Councilman Barnard, seconded by Councilman Stapleton, to table the liquor lic- ense application of the Independence Company, until satisfactory plans and speci- fications have been received. Motion carried with all Councilmen voting "aye". Glenrose drug- Mayor Pabst then read letter from Glenn Anderson requesting withdrawal of the liq. lic.appl, liquor license application for Glenrose Drug. Council authorized the Clerk to withdrawn, return to Mr. Anderson the application-and the plans submitted. Discussed- whether to continue to table the application of the Smuggler- Smugger- No. 1 Number One Main Corporation, and Councilman Kuster made amotion to continue tabling Main- appl. this application. It was decided to instruct the Clerk to inform them that this application would be heard at the first regular meeting in April, at which time Council will hear all applications in at that time, and Councilman Kuster withdrew his motion. Bills- Councilman McEachern said the accounts payable of the City were in order. Blue Flame Discussed - bill from Blue Flame Gas Company for installation of heaters in the ~ Gas. power plant. A motion was made by Councilman Stapleton, seconded by Councilman Barnar4 to suspend Rule 19 and to allow the several amounts, including a payment of $600.00 on the bill from Blue Flame Gas Co. Motion carried unanimously with all Councilmen voting "aye". Ord. 1, 1964 Ordinance No. '1, Series of 1964 - annexation of portion of Block 2, Eames tabled Addition - a motion was made by Councilman Stapleton, seconded by Councilman Barnard, to comply with request from Mr. Wendt that this be tabled uptll the meeting of February 17, 1964. Carried with all Councilmen voting "aye." Discussed- request of Independence Company for canopy over entrance on the west Ind. Bldg. side. Council has looked at site. A motion was made by Councilman Kuster, seconded Canopy by Councilman Bernard - to.permiT a canopy.on the west side of the ~ndependen?e Bui%ding according to specifications - sub3ect to the right of the City Council to Motion direct the removal thereof in the event said structure shall subsequently be found to interfere with the health, safety and welfare of the inhabitants of Aspen. Motion carried with all Councilmen voting "aye,~. ~ Mr. Vernon Konkel, Kethh~m, Konkel,~yan and Fleming, addressed Council on the Konkel- advsability of retaining an engineering firm to act as counsel~on City problems, with engineering retainer agreement, and he outlined the qualifications of his firm. Discussed- fees firm and service available, and Council is to consider this m~tter. Mr. Cornell of Pprtland Cement was present. Attorney Balcomb: Second reading -Ordinance No. 2, Series of 1964 - hold until after hearing on rezoning. Ord. No. 2 1964 Ordinance No. 3, Series of 1964 - AN ORDINANCE AMENDING CHAPTkR 2 of TITLE VII 0~. 3,1964 AND SPECIFICALLY SECTIONS 8-2-1 and 8-2,2 OF THE OFFICIAL CODE OF ASPEN, COLORADO, ~ead for the second time by Attorney Balcomb and finally adopted upon motion by Councilman Bernard seconded by Councilman Kuster, and carried on roll call- Councilmen Barnard aye: Kuster aye; McEachern aye; Stapleton ~ aye. Sales Tax - Mr. Balcomb is getting sample ordinances that have stood test of Sales Tax' Supreme Court, and he will draft City Ordinance to be presented to ~ttorney General f~r opinion. Dog Control Ordinance re'raft discussed - with provision for rabies vaccination Dog Control to continue. Attorney Balcomb to redraw, ordinance. Dog pound - after discussion a mo%ion was made by Councilman Barnard, seconded Dog pound. by Councilman Kuster, to ~nstruct the City dmznzstrator to build a dog pound. Motion carried on roll call - Councilmmn Barnard aye; Councilman Kuster aye; Councilman McEachern aye; Councilman Stapleton aye. Attorney Balcomb referred to hearing on the Molly Gibson for failure to provide Hearing- adequate food facilities. Roger Walker, Liquor Inspector, wants to file complaint Molly Gibson, before Council. Discussed- and earzng set for 3:30 PM on Monday, February 10~, 1964. h ' Discussed- False I.D.s - Attorney Balcomb advised Cnuncil that this is covered False I.D.'s by State statute and draft cards are a Federal matter. If a driver's license has been changed this should be referred to City Police or County Sheriff~ Mr. Baloomb does not feel this should be handled by City ordinance. Liquor License . Heinz ~olf dba Buffet Room - Attorney Balcomb advised Council that he had reviewed the minutes of the ounc~l meetings and the only grounds for .iq. lic. He does not feel City coul~ make revocation stand up in court. After discussion, Council agreed that there is to be no action. New well - Mr. Kerr~ia~ to get written r~port. Councilman Bernard asked them if they would pay the tax for 1963 if this provision of the Municipal Code is repealed and they indicated they would. Smuggler Tr. Ct. Smuggler Trailer Court - Water rate - turned over to City Administrator. water rate ~ Agreement with Benedict Land and Cattle Co. on waterline in Riverside Annex and water rates discussed, and turned over to the City Administrator for review. Payment-Benedict A motion was made by Councilman McEachern seconded by Councilman Kuster to Land & Cattl~ Coj suspend Rule 19 and to allow the initial payment of $2,500 on the Benedict Land and Cattle agreement as provided in this agreement. Motion carried on roll call- Councilmen Barnard aye; l(uster aye; McEachern aye; Stapleton aye. Improvement District No. 1 - bill to the ~ity of Aspen for $3,306.00 . A City bill- motion was made by Councilman McEachern, seconded by Councilman Kuster, to suspend District No. 1 Rule 19 and to pay the assessment of $3,306.00 to Improvement District No. 1. Resignation Resignation of Police Chief Baker read and accepted by Council who appointed Police Chief Glen Ricks as acting police chief. Jerry Hobgood said Aspen Civic Association has been formed and representa- Aspen Civic Ass' tive will attend all meeting with the purpose of assisting' ' in the procedures. Council requested that they arrange to be placed On the agenda. Don lelsher referred to problems in connection with Galena Street East, and Galena St. East the possibility of his applying for a full liquor license. He was advieed to file ~ application for the hearing at the first Council meeting in April in accordance with procedure recently adopted by ~esol6~ion. with Councilman Kuster said he would like to me&t/all the City employees. Discussed- replacement of trees, and possibility of opening irrigation ditches. The meeting was adjourned at 6: PM upon motion by Councilman McEachern, seoonded by Councilman Barnard, and carried.
