HomeMy WebLinkAboutminutes.council.19640309 Mayor Pabst called the meeting to order at 7:30 P.M., with Councilmen Barnard, McEachern and Stapleton, and City Administrator Kerrigan present. Members of the Aspen Planning and Zoning Gon~nission present were Jack Walls, Richard Lei and Francis Whitaker. The Notice of the Zoning Hearing and Ordinance No. 2 Series of 1964 - pro- hibiting any facility in the tourist area from dispenming or selling fermented malt beverages or malt, vinous or spirituous liquors- was read by the Clerk. Mayor Pabst then read a resume' covering attributes of the City of Aspen, in- crease in population, speculators and quick turn-over, lfquor licenses now in ef- fect and comparison with other cities of similar size. He asked about the advisa- bility of passing Ordinance NO. 2 on an interim basis, until the long range plan has been adopted. He said the tourist zoned area would allow for about 15,000 maximum, but this area is primarily a r~sidentiat area. Council asked that those talking on this matter put aside personal feelings, and express constructive opinions based on what they feel is best for Aspen. Zoning- Councilman Barnard referred to the proposed zoning for the Riverside annexed lverslde, area and suggested using R-6 Zoning, as he feels the City does not need R-15 Zoning. The meeting was then opened for discussion. Mayor Pabst referred to cost of entertainment - and requirement that there must be a restaurant if liquor is served, Mike Garfish - former Mayor of Aspen - electrician and property owner in the tourist district - feels the ordinance would be discriminatory - and'said County Commissioners had told him they have no liquor policy. He referred to congestion in the business ames, and to the good quality of the present outlets. He also mentioned growth of Aspen and he feels planning should keep the distinctive at- mosphere. He referred to problems in Grand Junction, and their need to provide more parking space. Petition Harry Poschman - lodge owner - referred to the 2% Room Rental Tax being collected Opposing by all rooming house operators, and he presented a petition opposing the Ordinance, Ordinance bearing 109 signatures, and referred to private enterprise. Mrs. ~Ria Beyer, lodge and ski shop owner - feels there are no problems in the tourist area due to licenses already granted. Steen Gantzel - lodge owner - feels operators of liquor establishments have a responsibility to control "drunks" and referred to responsibility of citizens. He asked about Council-policy in connection with new applications, and was re- ferred to the resolution recently published. Mrs. Beyer - referred to competition and feels this would be discouraged. Mr. K~pelli - Bell Mountain Lodge owner - feels Ordinance is not fair and. that it would discoumage expansion. Hans Gramiger - Realtor- feels any well run restaurant would be an advantage to the community. Me inquired abou~ liquor policy, and referred to non-conforming use, and needs of the tourists, and he does not feel there is a surplus of liquor licenses ak this time. Councilman McEachern - said Ordinance No. 2 had been thrown out to get constructive criticism. Riverside- Mayor Pabst then suggested consideration of the zoning ofthe Riverside annexed Zoning. area. Jack Walls - Chairman of the Planning Commission showed plat and said land use survey had been run, one area had been given use variance, and the Commission recommends that the entire area be zoned the same as it had been by the County. He referred to area Zoned R-15, which the Commission approves. Discussed - R-15 Zoning. Anthoney Berumen referred to planning so close to town and need for pta ctical approach due to need for housing for working people. Jack Walls - referred to need for interim zoning pending reevaluation of zoning in connection with the long range plan, about July of this year, Mrs. Walter Stroud - feels zoning at this time would give property owners protection. Richard Lai- said this is why Commission recommends interim zoning for protection. Jim Blanning - favors R-6 Zoning for entire area annexed. Tom Corcoran - would like to have zoning continue the same as the County. M~s. Bibbig - was not prepared to express an opinion. Mrs. Virginia Blanning - favors R-6. The hearing on the zgn~ng affecting liquor licenses was then resumed. Waddy Catchings stressed need for supervision. Dr, William Comcowich - Asked - 1. Whether licenses can be restricted due to "needs" of communityU. 2. Whether such zoning would hold up in Oourt. 3. He suggested denying licenses because the needs of the community have been ~et. Wolf Beyer - owner- Vagabond Lodge and Winter Shop - this zoning would tend to drive ~usiness into the County. Beverly Emmerton - owner - Buckhorn Lodge - feels this zoning should not be ad- opted. Bill Dunaway - Editor - Aspen Time~ - feels this should not be pegged to zoning. 31~ Blanning - said people get drunk in private places as well as in liquor out- lets, and referred to help problem due to lack of housing. Hans Gramiger asked if any consideration had been given to expanding number of liquor licenses. Roy Reid- Realtor - He questioned whether such~zoning would not be discriminatory; he feels liquor is here to stay; this zoning would permit drinking only in the business area. Jack %~lls - plan~ing Commission - was concerned about congestion in business area with proposed zoning- also that this would have a tendency to force other businesses, and residents - out of the business area. Bill Dunaway - felt that zoning should start with planning. Francis Whitaker referred to statutes requiring that Planning Commission must make recommendations; He is .skeptical of zoning in areas were the State has given Council certain powers, and feels that Council should set certain regulations. Ken Moore - feels zoning should be pr~dicRble - and based on planning, with co- ordination of planning, zoning and growth. Mike Garfish - said he felt liquor licensing consumes too much of Council's time- but We does not feel proposed zoning would solve the problem. Discussed - whether there should be re~ision of State Liquor Code State require- ment that meals be served - more effective policing; drinking by minors and need for strict%r enforcement ; parent responsibility and better cemmunity spirit. Jack Kane- Attorney - feels this is a problem for the State, and that economics tend to be a leveler. No one spoke in favor of the zoning amendment. The meetinl was adjourned at 9:52 P.M. upon motion made and carried.
