Present were Councilmen Barnard, Kuster, McEachern and Stapleton, City Attorney Balcomb and City Admin- istrator Kerrigan. City Treasurer Lum came in shortly thereafter. The accounts payable were turned over to Councilman Stapleton for checking. The recently appointed Police Chief, Louis Hennig, was introduced to Council. The minutes of the previous regular meeting of August 3, 1964, and the recessed Minutes meeting of August 4, 1964,~ were approved as read with the following correction - the question on Ordinance No. 7, Series of1964, is "Shall the ordinance, notwith- Correction standing the Mayor's objectipns, be passed?" A motioB was made by Councilman Stapleton, seconded by Councilman McEachern, to suspend Rule 19, and to allow the account~ payable. Roll call: Councilman Barnard aye; Kuster aye; Stapleton aye; McEachern aye. Ordinance No. 15, Series of 1964 - Providing fo~ the annexation to the City of Ord. No.15 Aspen, Colorado, of that certain territory or real estate particularly described in Series of 1964 this ordinance, lying outside but adjacent to said City ~f Aspen - was then read in .full for the first time by Attorney Balcomb - and a motion was made by Councilman Barnard, seconded by Councilman Stapleton, to order the Ordinance No. 15, 1964, published. Roll cal~- Councilmen Barnard aye Kuster aye; McEachern aye; Stapleton aye. Ordinance No. 8, Series of 1964 - Density control - remove from agenda. Ord. No. 8 1964. The Treasurer's report for July 31, 1964, was read by Mr. Lum, and after dis- cussion, was approved upon motion by Councilman Barnard, seconded by Councilman McEachern. Roll call- Councilmen Barnard aye; Kuster aye; McEachern_ aye; Stapleton aye. A motion was made by Councilman Kuster, seconded by Councilman Barnard that- Council because Monday, September 7, is a holiday, the regular meeting of the City Council meeting-Sept.8 will be held on September 8, 1964, at the usual hour - 3:30 PM. ~ Ail Councilmen voted aye. Discussed- increase in water bills due to resurvey and advisability of in- Inc. in water cluding covering notices in future, bills. Mayor Pabst referred to request from Hubert Erhardt for a loading zone on Mill Request for Street The Golden Horn;- discussed - and a motion was made by Councilman Barnard, loading seconded by Councilman McEachern, to deny this request. The Mayor then referred to requgst of Rob Roy - (who has no~carriage right Roy- Castle in the Castle Creek Flume) to tap on to water pipeline system. Discussed - pro- Creek Flume blems involved in future requests, and that Yale Rea does not favor such tap~. A Motion motion was made b~ Councilman Barnard, seconded by Councilman Stapleton, to notify Rob Roy that the oity~ will not allow such tap on. All Councilmen voted aye. Attorney Balcomb said he understands that Roy has been using water leaking from the flume, and that he has never tapped on to it. Then discussed - Jim Moore's request for deed or quit claim from City to com- pensate for money spent on Maroon ~reek by users. Attorney Balcomb referred to Mar~on Creek agreement with Mrs. Paepcke on =arrying water in flume. He does not feel that they Flume have any carriage rights in flume, and they wo~ld have to establish such rights. He feels the agreement with Mrs. Paepcke is a good one. Councilman Stapleton sug- gested turning this matter over to Attorney Balcomb and Mr. Kerrigan, and Council concurred. Mrs. Larkin's request to buy land at Glory Hole to square off her property - Land at Clerk to follow up ~eference to Planning Commission. Glory Hole Luke Anthony was present regarding his request for water for houses moved to Water - vicinity of the Smuggler Trailer Court. Councilman Barnard referred to Gity's "out Luke Anthony of town" policy. He feels first responsibility is to citizens of Aspen, and water should be used as %ever for annexation, and he referred to Benedict's Aspen Grove and Riverside Subdivision lines. Councilman Kuster opposed taking ovem the Benedict lines. Councilman Barnard suggested putting a meter on Benedict line and charging according to ordinance. Mr. Kerrigan said Davis Holder, the City Engineer, Waterline will be able to come up with rules for annexation. After discussion, a motion was Benedict made by Councilman Barnard, seconded by Councilman Kust~r, - to meter the Benedict Land and Cattle Co. and charge according to ordinance rate, and to suspend Rule 19, and to pay money due Benedict according to the Riverside annexed addition contract. Motion Then Discussed - the agreement now in effect between the City and Benedict Land and Cattle Co.; Attorney Balcomb read from the State Statutes regarding charging "according ~to ordinanceU; need for uniform policy outside city limits. Councilmen Barnard and Kuster then withdrew their motion. Motion withd~ ~ni Councilman Barnard then moved thmt, regarding the contract with the Benedict Land and Cattle Company, the City comply with Section II, and after suspending Rule 19, purchase the Riverside Addition Water Main. The motion was seconded by Councilman Motion Kuster. Aspen, Colorado Regular Meeting Aspen City Council August 17, 1964 Cont'd. Luke Mayor Pabst then referred to the June 15 meetiDg regarding Luke Anthony's Anthony request for water service. Anthony referred to provision in ordinance "to hook ~ Waterline onto neighbor's line" and said he had be~n working with Earle Jenkinson 6f~'the Water Dept. 9n this; and that agreements are in preparation. Attorney Balcomb readSection 3-3-8 of the Official Code - City Administrator Kerrigam referred to permission implied in the minutes of the special ~eeting of July 3, 1964. Earle Jenkinson said he had been given to understand that permission had been given for Anthony to tap onto the Smuggler Trailer Court line, and he had re- fer~ed this to Mr. Kerrigan and to Attorney Balcomb, and the latter instructed him to draw up an agreement. This was done, and Mr. Jenkinson said he had ex-. plained to Mr. Anthony requirements re tap fees, valves,etc; M~ also said tap was not made by City, but was inspected by Teleo Caparrella. Mr. Anthony said he had been working with Mr. Jenkinson since the beginning; Mr. Kerrigan felt in- stallation should ~have been approved and inspected by the City. After further discussion - a motion was made by Councilman Stapleton, seconded Motion by Councilman Barnard, that Luke Anthony's water ~rpbl~m be handled as an admin- istrative problem betwmen the City Administrator and the Manager of the Water Dept. Mr. Anthony asked whether permission was granted at the meetingof July 3, and Councilman Barnard said. this matter was turned over to the City Administrator. Rezoning- Jerry Hobgood submitted an approval of Council action in rezoning the west approval end business district to tourist - signed by 56 persons. A motion was made by Councilman ~arnard, seconded by Councilman McEachern, Moving expense to suspend Rule 19, and allow $100.00 moving expense to Police Chief Hennig. Motion- Bonus A motion was m~de by Councilman McEachern, seconded by Councilman Barnard, to to Ricks. suspend Rule 19, and to allo~ to Glen Ricks a bonus of $120.00 for service as Acting Police Chief from ~eb. 1 to August 1, 196~. Mayor Pabst asked Series of if there were any comments from the floQr. No comments, and after brief discussion 1964 on the hearing of August 13, a motion was made by Councilman .Stapleton, seconded by Councilman Kuster, to table this ordinance until the meeting of September 8,196~. He is on a meter and pays much.larger bill than a similar laundry which is unmetered. DiscUssed - the City Engzneer to make rate s~ey; City Administrator Kerrigm~was ~ instructed tq enforce the ordinance regarding meters for all establishments after January 1, 1960. Ord. 16, 1964 Ordinance No. 16, Series of 1964 - providing for the regulation of hauling of asheS, trash and garbage read in ful~ for the first time by Attorney Balcomb, Piscussed - hauling of'gravel and dirt, and this is to be referred to the Police Dept. A motion was made by Councilman McEachern, seconded by Councilman Barnard, toorder Ordinance No. 16, Series of 1964, published. Contract- It was then moved by Councilman Barnard, seconded by Councilman McEachern, Bookcliff- to authorize the Mayor and the City Clerk to execute the contract with Bo~k~tfff Motion Construction, Inc., aS recommended by the emgineer, Dale Rea. Mr. Kerrigan then outlined a contract with Davis Holder and Associates, Con- Holder- Enginee~ sulting Engineers, for services on street i~provements and storm sewers, and a motion agreement-motion was made by Councilman Stapleton, seconded by Councilman Barnard, to authorize the Mayor and City Clerk to execute the agreement. Roll call - Councilmen Barnard aye; Kuster aye; McEachern aye; Stapleton aye. Motor cycles. Mayor Pabst read letter from Wemdy~orse, dated AuguSt 5, re motorcycles, and this is .to be refermed to the Police Chief by ~4r. Kerrigan. The Ma~or also read letter from Jack Walls, Chairman of the Planning Commission, Planner- long asking permission to start interviews with planning consultants. Hans Gramiger feels range plan. the contract should require that the planner live in the community. Discussed, ~nd Mr. Kerrigan was instructed to answer the letter, on motion by Councilman Kuster, seconded by Councilman Barnard- to authorize the Planning Commission to start interviews, subject to the conditions as outlined in the City Administrator's let- ter. All Councilmen voted aye. Council wants Chairman Walls to make reports to them on this matter. Anthony Council then discussed annexation and water policy. Ken Moore referred to need City Street to have preliminary plans submitted. He informed Council that Luke Anthony has changed Cit3 Streets and filed such changes in-the County Courthouse, and he re- ~ Dean St. quested that Council hold up water service to A~thony. Discussed- that City Streets may not be changed by him. Hans Gramiger requested that the City make formal dedi- ~ cation of Dean Street to the City, as this should be kept open. Req. for water Tony Berumen referred to his request for water service, which will come under Berumen "out of City" policy, A motion was then made by Councilman Stapleton, to adjourn the meeting -at 7:00 P, M.
