A special meeting was called for the purpose of opening bids on the second
phase of the waterworks surface supply.

bond of Emerson S. Etlett was not enclosed. Mr. Ellett went to his car, got the
bond, and handed it to Mr. Kerrigan before the meeting was called to order. No
objection to this procedure was expressed by the other bidders present.
The meeting was called to order at ~:10 PM by Mayor Pro-Tem McEachern, with
Councilmen Kuster-f and Stapleton, City Administrator Kerrigan and Dale Rea present.
Mayor Pabst and Councilman Barnard were absent.
The following bids on the ',Construction of Diversion Dam and Inlet Structure and
30" Raw Water Pipeline and Appurtenant Structures" were then reviewed and. foun~ to
be in order: Bids.

Emerson S. Ellett 86,955.90 ~
The apparent lo'est bidders - Ellett and Kidwell, were asked to return, in
30 minutes. The bidders withdrew and the bids were checked by Mr. Rea and
Council.
Mr. Rea said he ~ has worked with Mr. Ellett, and gave outline of his quali-
fications, and said he had found his work to be very satisfactory.

Mr. Dye of Bookcliff Constr~lction Co., reviewed the bid of Ellett for bid bond,
but registered no protest.
The bids of the~other bidders were then checked by Mr. Rea and CoUncil.
The meeting was then resumed, the bidders returned, and Mr. Rea recommended
that the bid be yarded to Ellett C~stru~tfon Co.
Councilman Stapleton asked if there was any protest re bid bond of Ellett. Mr.
Rea Said he felt there was nothing wrong with the bid or the bond of Ellett, as
the bond had been received before the Council opened the meeting. He said this
was a technical irregularity only, and referred to Item ~ in the specifications.
Mr. Rea wi%% recheck bids and send notification to each bidder.
Motion A motion was then made by Councilman Kuster, seconded by Councilman Staple-
ton to award the bid to Emerson S. Ellett - on the Diversion Dam and Inlet Struc-
ture, and the Pipeline and Appurtenant Structures. Roll call:
Councilmen Kuster aye; McEachern aye; Stapleton aye.
Mr. Rea said he would give award to Ellett today as time is of the essence.
Mr. Ellett said he would probably start work after Aabor Day, and Rea referred
to allowable extensions due to weather.
The meeting was adjourned at 5:05 PM upon motion by Councilman Stapleton,
seconded by Councilman Kuster and carried.
