HomeMy WebLinkAboutminutes.council.19640921 Aspen~ Colorado Regular Meeting Aspen City Council September-21, 1964 Mayor Pabst called the regular meeting to order at 3:45 PM with Councilmen Kuster, McEachern, Stapleton and Bernard, and City Administrator Kerrigan present. City Attorney Balcomb was absent. The accounts payable were given to Councilman McEachern to check. The minutes of the previous meeting of September 8, 1964, were approved as read. Liquor license Don Fleisher was present in the interest of the liquor license filed by application him for Galena Street East, which had been tabled. He said he did not wish to apply for a full liquor license at this time and would like to have the Galena St. East application tabled for one year if possible. He said he is developing the withdrawn club and explained his present operation. Discussed, and Council felt the application should be withdrawn rather than again~ tabled. Fleisher asked about refund of the $200 application fee less costs. Policy on refunds discussed, and a motion was made by Councilman McEachern, seconded by Councilman Kuster, to Resolution adopt a resolution providing for the refund of the $200.00 application,f~e~less refunds costs, in those cases where the application for a liquor license has not been acted upon, and application is withdrawn by applicant% Roll call vote: Councilmen Bernard aye; Kuster aye; McEachern aye: sta~i~toh~ aye. Deed-Block 20 Quit Claim Deed - Block 20 to be referred to Attorne~ Balcomb. Overhang- Overhang o~er sidewalk - Aspen Lumber Co. - Mill Street - Mayo~ Pabst read sidewalk letter'from Planning Commission dated September 15, 1964~ recommending that covered Mill St. sidewalk be permitted as shown on-drawings. A motion was made by Councilman Stapleton, to approve the covered sidewalk on Mill Str:~et at Aspen Lumber Co. ac- cording to the plans submitted, subject to removal upon order by the City Council at any time it interferes with the health, safety, and welfare of the inhabitants ~' of Aspen. Motion seconded by Councilman Barnard. Roll call: Councilmen Barnard aye; Kuster aye; McEachern aye; Stapleton aye. Councilman McEachern said the accounts payable were in order and moved that Rule 19 be suspended and the amounts paid. Motion seconded by Councilman Stapleton and carried on roll call: Councilmen Barnard aye; Kuster aye; Stapleton aye; McEachern aye. Ordinance No. 14, Series of 1964 - Sales and Use Tax - oversight in second Ord.14-prin~ti~g printing requiring re-printing discussed with Bill Dunaway. He feels cost should be shared by bonding attorneys, and City Attorney Kerrigan will refer this matter to them. Budget for 1965 - Councilman Step,eton referred to lack of contingency fund - Contingency Fund · - Mayor Pabst read letter from County Assessor, indicating the assessed valuation for Assessed ~.~ 1964 to be $4,736.9~0.00. valuation Jack Walls said he felt there should have been discussion with the heads of departments regarding the budgets submitted; also that there will be much higher expenditure by the Planning Commission in 1965 due to review of the Zoning Code. Mr. Budget.Planning Walls said he had not received a copy of the proposed budget - that this had not been discussed with him - that he was out of town at the time of the special meeting of September 17 - discussed, and he was informed that if the Commlssion's budget is overdrawn, funds may be available by transfer from other accounts.~ Bill Dunaway drew attention to the City Clerk's and City Treasurer's Departments - Budget-City not indicated in the budget. Mr. Kerrigan said they were covered under "Finance and Clerk & Treas, Accounting." Dunaway felt that departments of elected officials should be so in- dicated, for the benefit of the electors. The City Clerk said she had not been con- sulted regarding her request for a deputy, as to whether or not such additional help ~as required. She also felt the budget should have indicated the departments as they appear in the Municipal Code of the City. Contingency fund discussed - Mr. Kerrigan said adjustments could be made in the Contingency budget through transfer of funds, so no contingency fund had been provided. Fund Considerable discussion followed on whether a new police car is needed - and Police car Chief Hennig expressed the opinion that the present car is not adequate - he feels this car should be held as an auxiliary vehicle. Also on consumption of gasOline "walking policeman" - two men in police car; - Hans Gramiger said Police Dept. should-have a camera and "drunk" testing equipments Ken Moore felt there should be broader coverage in the budget. Bill Dunaway asked about the sales and use tax ordinance - No. 13, of 1964 - Sales tax ord. Discussed - and tabling of this ordinance is to continue. Tabled Mill levy for 1965 - after discussion - Ordinance No. 17, Series of 1964, pro- ** riding for the mill levy for 1965 (17 mills for General Fund, and none for the 1938 Ord. 17,1964 Refunding Bonds) was read for the first time in full by Councilman McEachern and it was ordered published upon motion by Councilman Bernard, seconded by Councilman Kuster and carried on roll call: Councilmen Stapleton aye; McEachern aye; Kuster aye; Barnard aye. Mayor Pabst read letter from the Chamber of Commerce re flower boxes and benches to beautify the city - and this was given to Mr. Kerrigan. Ordinance No. 18, Series of 1964 - An ordinance adopting the budget for~the City Ord. 18,1964 of Aspen, Colorado, for the fiscal year beginning on the first day of January, 1965, and ending on the last day of December, 1965, estimating the amount of money necessary to be raised by tax levy based on the said budget so adopted, estimating the amount of money to be derived from other revenue sources; and setting forth the total esti- mated expenditures for each fund. - to adopt the annual budget for 1965, was read in full for the first time by Councilman McEachern, and after discussion, this was ordered published upon motion by Councilman Stapleton, seconded by Councilman Kuster and carried on roll call: Councilmen Kuster aye; Stapleton aye; Barnard aye; McEachern aye. Closing of street during school hours to provide more play space - discussed - Closing Hallam contacting property owners - and a motion was made by Councilman Kuster, seconded by St,-school Councilman Stapleton, that Hallam Street, between Center and Aspen Streets, may be closed off during school~hours to provide play space. Motion carried with all Councilmen voting aye. Mr. Kerrigan to handle. Bill Dunaway asked if portion of Mill Street could be closed so that the AsPen Closing Mill Sports Car Blub can use it for the technical inspection of cars, as this is Of interest St- Spor~s to the public. Council concurred to.the closing of Mill Street between Cooper and Cars Durant Avenues for 1/2 day - Saturday the 26th. Mr~ Kerrigan to handle. Mayor Pabst referred to the beautiful desk given by Mr. and Mrs. William Stevenson Desk-gift to the City of Aspen, and a~motion was made by Councilman McEachern, seconded by CouncilmaB Barnard, to instruct the City Administrator to acknowledge and send thanks for this gift. Motion carried with all Councilmen voting aye. Discussed - possible sub-leasing by the Aspen Institute, of the Opera House to Opera House William Rubey. Lease to be reviewed.
