HomeMy WebLinkAboutminutes.council.19641005 Aspen~ Colorado Regular Meeting Aspen Cit7 Council October 5, 1964 The regular meeting was called to order by Mayor Pabst at 3:40 P.M. with Councilmen Barnard, Kuster, McEachern, and StapletOn present. Also present were City Attorney BalcOmb and City Administrator Kerrigan. The accounts payable of the General Fund and Water Construction Fund were given to Councilman Barnard to cheek. The minutes of the previdus regular meeting of September 21, 1964, were approved as read. Councilman Barnard, having checked the accounts payable, moved that Rule 19 be suspended and the accounts be paid. Seconded by Councilman McEachern. Roll call: Councilmen Barnard aye; Kuster aye; McEachern aye; Stapleton aye, Treasurer's report awaiting bank statements. Liq. Lie. Mr. B. T.. Martin, representing the Independence Restaurant Company, resub- Applies,rich mitred the- application for a full liquor license, and Mayor Pabst read a letter from Mr. F. George Robinson regarding this matter (dated September 24, 1964). I nde pe nde nee Restaurant Mr, Martin said he had talked to Mr. Chilton of the Liquor Licensing ~Com- mission who had told him this procedure is entirely satisfactory, amd due to certain technicalities, Mr. Martin said he would like to have the original appli- ~' cation reconsidered. Attorney Balcomb said it would' be~ a reconsideration of ~ Council' s decision. Discussion Attorney Wendt asks d how long "reconsideration" can go on. on reconsider- ation CoUncilman Bernard said Council has not indicated that the application will be reconsidered. Mr. Martin referred to statutes, and said it would be in order for Council to reconsider by resolution iR view of technicalities, and he referred~ tO irregu- larities in "findings" and said there had been no publication of the April 6, 1964 hearing. Legal aspects were discussed, and Attorney Balcomb advised that Council may reconsider its decision. Discussed - time element involved. Councilman Stapleton questioned Whether decision Should be reversed, and went on record as opposing reversal of the decision in this case. Motion A motion was then made by Councilman McEachern that the liquor license for Independence Restaurant Company be reconsidered at this time. There was no second No second to this motion, so it died. Mr. Martin said he understands position of the Council, - that this is not a matter of questioning Council decision, but he had contacted the State authorities to determine what action they would take if Council does ~eConsider. Historical Mrs, James was present:in the interest of space for the Historical Society Society-City office and museum. Said they would like to be considered for additional space in Hall City Hall, and would be interested in leasing the building on'an improvement basis. Ord. 13- Ordinance 13, 1964 - Sales and Use Tax - discussed, and a motion was made Sales Tax by Councilman Bernard in favor of holding a special election 6n the proposed sales Tax Ordinance No. 13, Series of 1964~ Motion seconded by CounCilman Kuster. Attorney Balccmb will advise on procedure in connection with the special election. ~ Bids on ConstructiOn of Water Transmission Main and Appurtenances - Dale Rea told Bids-Water' Council that Hy~up and KidweI1 had not received the addendum to the bid specifi- transmission cations and he had asked them if they wished to change their bid and they had said "no." No objection expressed .by bidders present. Bids f~om the following were reviewed by Council, M.r. Mr. Rea said Bookcliff is behind schedule on first phase and he had warned them to get extra help - to avoid penalty. Another report on this to be made at meetin~ of October 19th. Mr. Rea explained concrete pipe and said there would be noeproblem with leakage. Ordinance No. 18, Series of 1964 - An Ordinance adopting the budget for the Ord. 18 City of Aspen, Colorado, for the fiscal year be~innin~ on the first day of January, 196~ 1965, and ending on the last day of December, 1965~ estimating the ~nount of money necessary to be raised by tax levy based on the said budget so adopted, estimatin~ the amount of money to be derived from other revenue sources; and 'settin~ forth the total estimated expenditures for each fUnd. - re~d ~ full for the second time by Attorney Balcomb- and finally adopted and approved upon motion by Councilman Stapleton, seconded by Councilman Bernard, and carried on =oil call - Councilmen Bernard aye; Kuster aye; McEachern aye; Stapleton aye. Kerrigan Electric rate is working on this. Attorney Balcomb - is working on Water Policy Ordinance - more information Water required by him. S%unmons - demand of G. E. Buchanan for deed to land claimed bY him in the East Aspen East Aspen Patent area - Mr. Balcomb is handling, and an extension of time has been G.E. Buchanan ~ranted. Mayor Pabst said he had received request from Herron and Smart to purchase Glory H°le the Glory Hole area. Discussed - assessment of land value for Larkin request. Bids - Police Radio Equipment reviewed~ General ElectricCompany $1~56~.30 Bids'Police R.C.A. 1,531.50 Equip. Motorola Upon recommendation of Gity Administrator KerFigan, a motion was made by Councilman Stapleton, seconded by Gouncilman McEachern, to accept the bid of ~otorola on the :ion radio equipmsnt outlined in specifications - in the amount of $1,274.00. Ken Moore - felt City Administrator should attend conferences, but should -delegate authority in his absence. Hans Gramiger - referred to stump of fallen tree still standing on City Tree fallen property. Correspondence - Mayor Pabst read letter from Mr, Kelly, Superintendent of Schools, expressin~ appreciation for the closing of. Hallam Street durin~ s~hool hours. Mr. Kerri~an will reply'to letter from M~s. Ella Hoagland re trees and side- walk. The Glerk will reply to her letter re interest on the ~mprovement District No. 1 installment payment. Aspen, Colorado Regular Meeting Aspen City Council October 5, 1964 (continued) George Madsen inquired about City Hall renovation. Ken Moore hopes Mr. Kerrigan will report on his trip to Chicago in the weekly newsletter. Moore also referred to need for treatment of water and planning for it. He referred to sales tax referendum, and asked about services of the engi- neer, Davis Holder, On water matters. These matters were discussed. Aspen, Colorado Recessed Meeting Cf~y Counc.il October 6t 1964 The City Council reconvened at 11:55 A.M., with Mayor Pabst, Councilmen Barnard and Stapleton, City Administrator Kerrigan and Dale Rea present. Councilmen Kuster and McEachern were absent. · ater trans- Mr. Rea said the ~ids on 6he Construction of Water Transmission Main and mission bids Appurtenances had been rechecked - and that the low bidder, without addendum, is S. F. Renaud Excavating in the amount of $65,095.80. Discussed - steel and concrete pipe, and Mr. Rea does not feel steel is sufficiently better to justify additional cost. He outlined current work of Renaud, and does not hesitate to recommend his reliability. Rea also outlined next steps in the water source development and purification facilities, and possible use of water for power purposes, and Council agreed to his consulting Public Service Co. re their use of water for power purposes in Georgetown. Motion A motion wa~ then made by Councilman Barnard, seconded by Councilman Stapleton to accept the bid, on the Construction etc., of S. F. Renaud Excavating, in the amount of $65,095.80, as outlined in ~he specifications. Roll call: Councilmen Barnard aye; Stapleton aye; Mayor Pabs~ aye.
