The special meeting was called to order by Mayor Pro-rem McEachern at 5:00
P. M., with Councilmen Barnard, Kuster, and Stapleton, and City Administrator
~ Attorney Kerrigan present. Mayor Pabst was absent.

Humb~ Oil The matter of hiring a special attorney to represent the City in the Dikkers-
Suit Humble suit was then discussed. Zarlengo, Zarlengo, a~ Scary, Denver firm, had
been recoranended. Other firms were also suggested, and discussion covered-
need for trial la~yer, and whether City Attorney Balcomb should prepare ~sponse.
Motion A motion was made by Gouncilman Barnard, seconded by Councilman Stapleton,
that City Attorney Balcomb is to prepare answeri~ papers on the Humble suit,
within the tiw~ required. All Councilmen voted aye.
Mayor Rfc-rem McEachern said that Attorney Balcomb is doing some water decree
work for Humble Oil - strictly research- and due to the importance of the case
to the City, it would be better for him not to handle this suit~ and Mr.
Balcomb has disqualified himse~. Roger Hansen was suggetsed, and City Administrator
Kerrigan is to contact him.
Mr. McEachern said Le~tle Gross will be in Aspen this week end, and Council
will see him.
Councilman Stap~ton referred to condition of street between Galena and Mill,
and intersection at Galena and Hyman, and Mr. Kerrigan sa~ they had been sanded.
Water rate- Mr. Kerrigan sa~ Mr. Kelly had asked about water ra~e~ at new high school.
new high school Kerrigan suggested metering, md using within City rates. Discussed, a~ a
motion was made by Councilman Barnard, seconded by Councilman Kuster to instruct
City Administrator Kerrigan that water rate is to be the "in town" commercial
rate, a~ to have necessa~ ordinance prepared. All Councilmen voted aye.
Discussed - stolen skis and checks from unknown persons.
