Present were Councilmen Barnard, Kuster and Stapleton, City Sttorney Balcomb and City Admini~brator Kerrigan. The accounts payable were given to Councilman Stapleton to check. The minutes of the regular meeting of Feb~aary 1, 1965, were approved as read. City Administrator Kerrigan referred to clai~ from Jim Hayes and Brian Murphy; Impounded cars Hayes stolen battery and Murphy damage to impounded car, and after discussion, a claims, motion was made by Councilman Kuster to suspend Rule 19 and to pay to Jim Hayes Hayes $20.6D for batter~ and to pay to Brian Murphy $10.20for claimed damage to car. Murphy Motion was se9onded by Councilman Darnard. Roll call vote - Councilman Barnard aye; Kuster aye; StapletoD nay. The motion carried. A motion was made by Councilman Kuster, seconded by Councilman Barnard - to confirm employment of Neale McCord as Assistant Building Inspector at Motion-con- $200.00 a month. firmation to confirm employment of' Frederick Mackintosh as police officer at $435.00 of a month. employment to change status of police officer Brooks from temporary to probationary employment. Roll call vote: Councilmen Kuster aye; Barnard aye; Stapleton aye. Husted's Discussed - Husted's leaving so suddenly - that he was on vacation from previous resignation job - his saying that people had stopped him on the street and had told him the position would be temporary and possible other reason such as shortage of housing. A motion was then made bY Councilman Stapleton to suspend Rule 19 and to allow the accounts payable as listed. Motion seconded by Councilman Kuster. Roll call vote Councilman Bernard aye; Stapleton aye; Kuster aye. Improvement Improvement District No. 2 - Mr. Kerrigan said Joe McAllister had agreed to District No. 2 work on the initial phase - and a motion was made by Councilman Stapleton - to hire McAllister at $400.00 a month, for one month, to handle the preliminary phase McAllister. of Improvement District No. 2. Motion seconded by Councilman Baranrd. Roll cal% vote: Councilman Stapleton aye; Barnard aye; Kuster aye. Stolen skis. Gale Spen~e referred to stolen skis - and estimated about $20,000 worth~ Dis- cussion - that ski areas are,not within City limits using road blocks; tourist re-action ; asking assistance from Glenwood Springs; Mr. Kerrigan is to follow up. Mr. Spence said there is a reward of $500,00. for conviction. Buchanan demand for deed - East Aspen Patent - Attorney Balcomb said there is no report as yet. Humble Oil suit - brie~s have been filed. Molly Gibson Inc., - Richard Podmore and Bill Clark were present. Mr. Clark said suit is being filed against th~ present stockholders for b~each of contract Molly Gibson and money due Podmore. Discussed - license is in the name of the corporation- citizenship of mmx~ma~im~ stockholders - and Attorney Balcomb advised that Council Hearing can arrange a hearing on suspension or revocation of license - that Council should be aware of ~ny change in stockholders. Councilman Bernard then moved to have a hearing at 3:30 P.M. Tuesday, February 23~ 1965, to consider suspension of the liquor license of the Mollie Gibson, Inc., with a court reporter present. This Motion motion was seconded by Councilman Stapleton and carried on roll call - Councilmen Kuster aye; Stap!eton ~aye; Barnard aye. Attorney Balcomb will prepare^necessary papers and arra~e for the court reporter. .Dean Avenue - Ken Moore request for vacation - Mr. Moore showed plat and asked for passage of ordinance to vacate part of Deane Aven~ue to clear title. Discussed- 'Dean Ave. whether set-back s~ould be included - whether he should reimburse City for land vacated - Mr. Balcomb said there should be no compensation for vacating streets, Moore request as City would be putting them on tax rolls - Councilman Bernard expressed opposition for vacation, to vacating set-back area. Motion. A motion was then~made by Councilman Stapleton to go ahead on the Planning Commission's recommendation. This motion died for lack of a second. Council then instructed Attorney Balcomb to prepare an ordinance to provide for an easement so long as the building remains standing. Walt Connolly referred to his ca~- stolen Jan ~ - found January 2 - and reported stolen to him on January 5, and from which he claims were stolen a tape recorder, ski boots articles- and polaroid camera. He felt these could have been protected if he had been told Walt Comnolly earlier that the ca~ had been found - and this matter ~§ to be investigated. Mr. Kerrigan referred to the bids on the 3/4 Ton, 4 wheel drive chassis and Chassis and cab, and said he feels that, although Gibson-Gorman can handle warranty repairs in cab- Aspen, this does not justify accepting their bid, and he recommended acceptance of the lower bid of W~Rrn Slope Auto Company of Grand Junction - net $2,880.11. cancel Discussed, and a motion was made by Councilman Stapleton, seconded by Councilman %-~motio~ Bernard, to cancel the motion made at the meeting held FebrUary 1, 1965, and to accept the bid of Western Slope Auto, -(net $2,880.11) on the 3/4 ton Chassis and New motion. Cab. Roll call vote Councilmen Kuster aye; Barnard aye; Stapleton aye. Water meters. Water meters discussed, and Mayor Pro-tem McEachern read a letter from Guido Meyer on this matter. Council feels ordinance should be enforced- and paying for meters in installments will be considered. Mr. Kerrigam referred to the water system of Fritz Benedict- Aspen Grove and Benedict- Riverside sub-division - which he said would be sold to the City for $1.00 and water system Aspen Colorado Regular Meeting Aspen City Council February 15, 1965 continued guarantee on the upper system for one year,- tank would need fixing and pump would be required. Discussed - and Council authorized Attorney Balcomb to draw up a con- tract, upon motion by Councilman Barnard, seconded by Councilman Stapleton. Roll call vote - Councilmen Barnard aye; Stapleton aye; Kuster nay. The motion carried. Sales and Use Tax (Ordinance No 13, 196~)~ discussed - ~o~ing mill levy Sales Tax and Council's promise to. do so; immediate enforcement of Ordinance if upheld at election; that Grand Junction is being sued on similar ~ax; Council not instigating a suit, but awaiting developments. Statement from John H. Tippit for legal work in connection with E~st Aspen Tippit~ Patent - and a motion was made by Councilman Barnard seconded by Councilman Kus~er motion to to suspend Rule 19, and to pay the amount of ~35~.35 to John H. Ti~pit. Roll call allow bill vote - Councilman Stapleton aye; ~ Barnard aye; Kuster aye, A motion was made by Councilman Kuster, seconded by Councilman Barnard, to Mlec~ion approve the final appointments of judges and clerks for the special election to be judges and held February 24, 1965.
