A RESOLUTION OF THE CITY OF ASPEN, COLORADO, AUTHORIZING LAND
EXCHANGES IN ORDER TO CREATE THE ANIMAL SHELTER PROPERTY.
WHEREAS, the City of Aspen and Pitkin County have jointly cooperated since the late
1990s to create a new animal shelter; and
WHEREAS, Pitkin County agreed to donate approximately one acre of land in the
vicinity of the Pitkin County Public Works Facility, adjacent to the City of Aspen Snow Storage
Property for the construction of the new animal shelter; and
WHEREAS, following preliminary designs it was determined that certain parcels needed
to be exchanged between the City of Aspen and Pitkin County to create a new animal shelter
parcel; and
WHEREAS, Pitkin County has completed all requisite land use approvals, including a
subdivision authorizing the creation of the new animal shelter parcel; and
WHEREAS, the City Council has been presented with four Special Warranty Deeds
appended hereto as Exhibit " A" in which the City of Aspen is either the grantor or grantee of
certain parcels of land; and
WHEREAS, the City Council desires to complete the requisite exchange of deeds to
create the new animal shelter parcel.
NOW, WHEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section One
That the City Council of the City of Aspen hereby authorizes the City Manager or Mayor
to execute the two deeds appended hereto in which the City of Aspen is designated as the grantor,
and to accept, on behalf of the City of Aspen, those two deeds appended hereto in which the City
of Aspen is designated as the grantee.

WITNESSETH, That the grantor(s), for and in consideration of the sum of TEN
DOLLARS, the receipt and sufficiency of which is hereby acknowledged, has granted,
bargained, sold and conveyed, and by these presents does grant, bargain, sell, convey and
confirm, unto the grantee(s) heirs, assigns forever, all the real property, together with
improvements, if any, situate, lying and being in the County of Pitkin, State of Colorado,
described as follows:

TOGETHER with all and singular the hereditaments and appurtenances thereto
belonging, or in anywise appertaining, and the reversion and reversions, remainder and
remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, claim
and demand whatsoever of the grantor(s), either in law of equity, of, in and to the above
bargained premises, with the hereditaments and appurtenances;
TO HAVE AND TO HOLD the said premises above bargained and described
with the appurtenances, unto the grantee( s), heirs and assigns forever. The grantor( s) for
itself, its heirs and personal representatives or successors, does covenant and agree that it
shall and will WARRANT AND FOREVER DEFEND the above-bargained premises in

Resolution Authorizing the Exchange of Parcels with Pitkin County for the
Creation of the Animal Shelter Property.
Attached for your consideration and review is a resolution that, if approved, would authorize the
Mayor or City Manager to execute two deeds conveying title of two parcels to Pitkin County and
accepting the deeds to two deeds from Pitkin County. The end result of these deed exchanges
will be the creation of the Animal Shelter Property.
The Animal Shelter has been constructed and Pitkin County has completed the requisite
subdivision of the affected parcels to create the Animal Shelter Property. The City and County
have been working cooperatively on this project since the late 1990's. One of the areas of
agreement was the creation ofthe Animal Shelter Property of approximately one acre. The land
is adjacent to the City Snow Storage property and the Pitkin County Public Works complex.
To create the Animal Shelter parcel, the City and Pitkin County need to exchange the parcels of
land referenced herein through Special Warranty Deeds.
Attached please find a number of plats that depict the parcels to be exchanged. The resulting
Animal Shelter Parcel is depicted on the final plat and is shown as Parcel #5.
· Parcel # 1 is currently part ofthe City Snow Storage property. This parcel needs
to be conveyed to the County.
· Parcel # 2 is currently part of the County Airport Parcel "D". It will be conveyed
to the City.
· Parcel # 3 is part of the City Snow Storage property. This parcel needs to be
conveyed to the County.
· Parcel # 4 is currently part ofthe County Public Works property. It needs to be
conveyed to the City.
· Parcel # 5 is the resulting Animal Shelter property that is created upon the
exchange ofthe above referenced parcels.

REQUESTED ACTION: This item has been placed on your Consent Calendar as the exchange
of these parcels has been discussed and approved by the City Council as part of the planning
process for the construction of the Animal Shelter.
