Undergrounding District
This matter is on your agenda for Council's August 30, 1999, meeting. Please note that although I
am attaching an ordinance for your consideration and review, the normal process for adopting an
ordinance has been changed slightly. On August 30, a public hearing will need to be held before
considering the adoption of the ordinance. Following the public hearing, you may consider the
adoption of the ordinance on first reading. (There will be a second reading and public heating to
consider adoption of the ordinance on September 13 - that will be a different public heating than
the one scheduled for the 30m. The public hearing on September 13 is for second reading of the
ordinance. The purpose of the public heating on August 30 is explained below.)
This memo is to suggest a format for the scheduled public hearing on August 30.
1. Introduction
On August 9, 1999, City Council adopted Resolution No. 65, Series of 1999, declaring its intention
to create an underground improvement district for the Smuggler Area, and .to schedule a statutorily
required public heating for August 30, 1999. A public notice was ordered to be published .in a
newspaper of general circulation and copies of the notice were mailed to the last known address of
each owner of land within the proposed district, as well as all current residents. Certified mail was
sent to not only the physical address of each home in the proposed district, but to the last known
address known to the County Assessor' s Office.
A public hearing is required pursuant to Colorado statutes. That statute requires the City to "hear
all objections to the creation of the proposed district, the making of the proposed improvements,
and the benefit accruing to any tract, block, lot or parcel offand therein." If a petition is signed by a
majority of the property owners owning at least a majority of the assessable land of the proposed
district protesting the proposed improvement is presented to the City at the hearing, and such
petition is still outstanding at the close of the heating, the district and proposed improvements shall
be abandoned. At the conclusion of the public hearing, and assuming that no abandonment petition
has been submitted, the City is required to either (a) abandon the proposed district, or Co) "consider
the arguments put forth and make such changes in the area to be included in the district as [the
Council] consider desirable or necessary," and thereafter adopt an ordinance establishing the
district and authorizing the project.
2. Preliminary Matters Before opening the public hearing:
a. Confirm with the City Engineer that notice was published in newspaper of general
circulation.
b. Confirm with City Engineer that notice was mailed to all property owners.
c. Confn'm with City Clerk and City Engineer that no formal petition or remonstrance
has been filed with either the City Clerk or City Engineer's Office.
3. Public Hearing

Decide whether to abandon district, or
Decide whether Council wishes to proceed, make any changes to district it deems wise
(including the inclusion or exclusion of property from the proposed district).
5. Ordinance
Adopt ordinance on first reading should Council decide to proceed with proposed district.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, TO
CREATE A LOCAL IMPROVEMENT DISTRICT WITHIN THE BOUNDARIES OF THE
CITY OF ASPEN FOR THE PURPOSE OF CONVERTING EXISTING OVERHEAD
ELECTRIC AND COMMUNICATIONS FACILITIES TO UNDERGROUND LOCATIONS;
AND ADOPTION OF DETAILS AND SPECIFICATIONS THEREFOR.
WHEREAS, the City Council adopted Resolution No. 65, Series of 1999, in which it
determined that the removal of all or a part of the existing electric and communications facilities,
including but not limited to, overhead electric, television, or telephone communications facilities
and the replacement thereof with underground electric and communication facilities will promote
public convenience, necessity and welfare; and
WHEREAS, pursuant to said resolution, notice of a public hearing concerning the
creation of the district and the removal of all or a pan of the existing electric and communications
facilities and the replacement thereof with underground electric and communication facilities has
been given by publication in one (1) issue of the Aspen Times, a newspaper of general circulation
in the City, at least twenty (20) days prior to the date of the hearing, and in addititon, notice was
mailed by first class on or about the date of publication of the notice, to the owners of all real
estate within the proposed district who are to be assessed for the cost of the improvements; and
WHEREAS, on the day and at the time and place specified in the notice, the City Council
conducted a public hearing for the purpose of considering the desirability of and need for the
proposed improvements; and
WHEREAS, following the hearing, the City Council determined to proceed with the
creation of the proposed improvement district.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ASPEN, COLORADO:
Section 1. Creation of District. That a special improvement district for the purpose.
of removal of all or a part of the existing electric and communications facilities, including but not
limited to, overhead electric, television, or telephone communications facilities and the
replacement thereof is hereby created and established in accordance with the City Charter,
Article VII, Chapter 19 of the Municipal Code, and Section 29-8-101, et seq., of the Colorado
Revised Statutes; subject, however, to the approval by the electors of the City of Aspen to an
election to be called by the City Council at a future date in accordance with Article XX, Section
20(3) of the constitution of the State of Colorado, as amended, authorizing the issuance of special
improvement bonds as hereinafter described. The special improvement district shall be known
and designated as the "Smuggler Area Underground Improvement District". All proceedings
heretofore taken and adopted in connection with the district are hereby ratified, approved and
confirmed. .
Section 2. Approval of Engineering Plans. That the Engineer's preliminary plans,
specifications, estimates of cost, maps and schedules for the proposed improvements, are hereby
approved and adopted.
Section 3. Boundary of District. That the real property to be included within the
district and bene~ted by the proposed improvements, includes the property within the boundaries
as depicted in the attached map appended hereto as AppendiX "A" and by this reference
incorporated herein as if fully set forth here.
Section 4. Assessments. That the costs and expenses of the district created are,
except as otherwise provided for, to be levied and assessed upon the abutting, adjoining and

adjacent lots and lands along or upon whose improvements are to be made, and upon lots and
lands benefited by such improvements and included in the improvement district created. The
method of assessment shall be as follows:
a. . All secondary service connections attributable to Holy Cross electrical
facilities shall be assessed the actual costs direc~y to the owner of the
property upon which such work is performed.
b. All costs attributable to the conversion of U.S. West facilities shall be
assessed equally to all owners of either property upon which actual
physical conversion work is performed or property which is adjacent to or
across the street from the conversion of primary communication facilities.
c. The cost attributable to acquisition of access easements for electrical
facilities shall be assessed equally to all owners of property who are
subject to assessment under subsection a above.
d. Bond issuance costs shall be assessed equally to all propen'y owners who
chose to finance their assessments.
e. The costs attributable to administration of the project shall be assessed
equally to all owners of property within the district.
f. Engineering costs shah be assessed to owners of property subject to.
assessment under subsection (a) above in proportion of the individual
secondary costs to the total costs for all secondary work.
Section 5. Improvements. That the improvements shall consist of removing
overbead electric and communications facilities, including but not limited to, electric, television,
and telephone communication poles, lines and other equipment, and replacing the same with
underground electric, television, and telephone communication facilities, except certain terminal
and utility boxes or pedestals, and electric power transformers, which will be above ground, and
including all necessary changes to the service entrance equipment of each structure and residence.
The lines will be installed in trenches and ditches which will be placed across present easements
and across those lots and tracts of land as the public utility companies shall determine necessary
and feasible for the location of such underground lines, and as shown on the reports presently on
ffie with the City Clerk.
Section 6. Cost of Improvements. That the present total estimated cost of the
proposed removal of all existing overhead electric and communication facilities within the
District, and the replacement of the same with underground eleeU:ic, television, and telephone
communication facilities is the amount of One Million Three Hundred Sixty-Five Thousand
Dollars ($1,365,000.00), not including any bond interest cost.
Section 7. . Payment of Assessments. The assessments to be levied for the cost of the
improvements shall be due and payable within thirty (30) days after adoption and passage of the
assessing ordinance. However, all such assessments may be paid, at the election of the owner, in
not more than ten (10) installments of principal with interest in all cases on the unpaid portion of
such assessment, at a rate as shall later be determined by the City Council and set forth in the
assessing ordinance. The installments of assessments shall be due and payable at such times as set
forth in the assessing ordinance.
Section 8. Special Improvement Bonds. Subject to the election provisions of Article
X, Section 20(3), of the Constitution of the State of Colorado, as amended in the general election
of November 3, 1992, and pursuant to the City Charter, Article VII, Chapter 19, Of the
Municipal Code, and Section 29-8-129, C.R.S., local improvement bonds of the City shall be
issued for the purpose of paying all or such portion of the cost of the improvements to be
cons1~cucted, as may be assessed against the property specially benefited. The bonds shall be
issued based upon estimates or contract amounts approved by the City Council, and as authorized
by an election held pursuant to Article XX, Section 20(3), of the constitution of the State of
Colorado, as amended.
Section 9. Records of proceedings.That a copy of the cost and feasibility

reports, and all resolutions and proceedings are on f~e and can be seen and examined by any
interested person in the office of the City Clerk, City Hall, 130 S. Galena Street, Aspen,
Colorado, during normal business hours, Monday through Friday exclusive of legal holidays.
Section 10. Findings of City Council. The City Council hereby finds and determines
that the improvements proposed to be constructed and installed will confer a special benefit upon
the real property within the district. The City Council further finds and determines that the
improvements were duly ordered after notice duly given and after the hearing was held by the
City Council pursuant to Article VII, Chapter 19 of the Municipal Code, and that protests were
not presented by the owners of a majority of all property benefited and constituting the basis of
the assessments.
Section 11. Repealer. This ordinance shall not have any effect on existing litigation
and shall not operate as an abatement of any action or proceeding now pending under or by virtue
of the ordinances amended as herein provided, and the same shall be construed and concluded
under such prior ordinances.
Section 12. Severability If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held' invalid or unconstitutional in a court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent,provision and shall not affect the validity of the
remaining portions hereof.
A public hearing on the ordinance shall be held on the day of ,1999, in the City Council
Chambers, Aspen City Hall, Aspen, Colorado.

To Whom It May Concern:
This note is my written objection to any public utilities entering my property for
digging or back filling of a trench. I do not grant any easement through my property to
any public utility or consent to any of their officers, agents or employees to enter upon
my property for such purpose.
Also, I would like to request for inclusion within the contemplated costs outlined
in the city's Notice of Intention to Create a Local Improvement District the cost of con-
version of utility facilities upon my property.
I reserve the right to amend the requests made in this letter subject to future
clarifications and explanations made by the city or any involved utility companies.

Dear Mr. Adeh: , CITY ENGINEER
I am responding (objecting), in writing, as requested, to'your letter of August 17, 1999,
specifically to item (j) page 2. An exact copy of this objection has been delivered to
the City Clerk betore the August 30, 5 pm deadline.
Today I have called 920-7476 as indicated on your letter to find out exactly where,
when, and how deep and wide the trenches should be so that I can decide to be or not
to be responsible for providing and backfilling a trench which is in accordance with
app!icable rules etc. referred to in paragraph (j). I have not yet had a response.
Concequently, my objection and inclination to do our own trench work is not based on
current knowledge of exactly where trenches are proposed and is submitted only as
an objection to meet the August 30, 1999 deadline if later information would provoke
this decision. Digging our own trench would only be our choice were the proposed
trench to pass through our fences, near trees, storage sheds and/or water or gas lines,
and require open gates (dog escape), or were there to be unspecified dates for
workers to occupy our property, especially in our absence. if, as I proposed to Banner
Engineering last summer, the trenches were to be dug, for the most part, on the street
side of our fence, I would be ever so grateful and would be less concerned about the
above.
We have had unfortunate experience in the past when the City widened Gibson
Avenue to our front door and when a new phone pole and box were installed on our
property in our absence. We 1. Lost our curb cut 2. Had our fence and gate
damaged 3. Needed to have large protective rocks installed to prevent cars from
hitting our house 4. Needed to have a unsightly 3 foot curb installed on Gibson to
protect our barn which ended up literal inches from the road. 5. This winter a car
skidded up the high protective curb and ran into our barn. 6. 2 1/2 feet of dirt were
piled up against the barn exterior wall on the street side causing 3 feet of the exterior
wall and building support system to completely deteriorate from moisture and rot. We
have just finished replacing the walls and supports with treated green wood layered
over with a 4 foot high piece of sheet metal to restructure and help protect the building
from this unavoidable problem.
In this historic vein, it is our request that trenches be planned and dug, for the most
part, safetly outside the fence line and that any necessary entry through a fence or
digging close to structures, trees or gates be brought to our attention early. We
request to be informed in advance of specific wo~:k dates so that, if we are not on
vacation, we can be here to supervise the utility company's work. If this is not feasible,
we would request that we be responsible to dig and fill any areas in which damage
might occur.
Thank you for your consideration of our objection and for any reply that would help us
to make an informed decision.
