Regular Meeting Aspen City Council November 21, 1966 Meeting called to order at 3:30 P.M. by Acting Mayor Werner Kuster with Councilmen David Stapleton, Clyde Clymer, Provisional City Attorney Gaylord, City Administrator Leon Wurl. Also present Finance Director Richard Flewelling, and City Treasurer Sam Lure. The accounts payable were given to Councilman Stapleton to check Acting Mayor Councilman Stapl~ton'moved to appoint Councilman Kuster as Acting Mayor. Seconded Kuster by Councilman Clymer. Ail Councilmen in favor. There being no corrections to the rgi~utes as submitted, they stand approved. ORDINANCE #34, SERIES 1966, AN ORDINANCE AMENDING TITLE III, CHAPTER 3, OF THE ORDINANCES Ord. #34 OF THE CITY OF ASPEN, ~COLORADo, PERTAINING TO,_~A~ER~.~, AND DECLARING AN EMERGENCY TO Water Rates EXIST was read in full for the second time by the City Clerk. Councilman Clymer moved to adopt Ordinance #34, Serlm 1966, as read for the second time in full. Second- ed by Councilman Stapleton. Roll call vote - Councilman Stapleton aye; Acting Mayor Kuster aye; Councilman Clymer aye. Renewal applications for liquor licenses for the year of 1967 were submitted, for Llq. Lic. Renewal Council to review. Public Service Representatives submitted to the City the signed modified contract. Councilman Stapleton moved to approve the bills as submitted. ORDINANCE #35, SERIES 1966, AN ORDINANCE AMENDING TITLE V, CHAPTER 2, OF THE ORDINANCES Ord. #35 OF THE CITY OF ASPEN, COLORADO, PERTAINING TO LICENSES AND DECLARING AN EMERGENCY Liq.Lic.City TO EXIST WAS read in full for the first time by the City Attorney. Councilman Owned Prop. Stapleton made a motion to approve Ordinance #35, Series 1966 as read. in full for the first time. Seconded by Councilman Clymer. The following Resolution was read in full by Administrator Wurl: R E S O.L U T I 0 N WHEREAS, the City Council of the City of Aspen, Colorado desires to pay certain amounts that are now due from theGeneral Fund.of the City, and finds that ~here is not sufficient money available in the General Fund currently to Trans. from effect such payments; Elec. to General AND, WHEREAS, the City Council,finds that it is in the best interests of the City to make such payments, and desires to transfer the sum of $30,000.00 from the Electric Operating Fund to the General Fund to meet necessary expenses; NOW, THEREFORE, BE IT RESOLVED: 1. That the City Clerk and the City Treasurer are hereby authorized and directed to transfer the sum of $30,000.00 from the Electric Operating Fund to the General Fund. 2. A copy of this Re~lution shall be delivered to the City Clerk and the City Treasurer as authority to effect said transfer. DATED THIS 21st DAY OF November, 1966. The following Resolution was read in full by Administrator Wurl: RESOLUTION Assessment Roll WHEREAS, Street paving, curb, gutter and drainage improvements in Street Imp- St. Imp.#66-1 rovement District No. 66-1, Aspen, Colorado, have been satisfactorily completed and have been accepted by the City of Aspen; and WHEREAS, a statement showing the whole cost of said improvements and proposed apportionment of the same on the property in said District has been filed in the office of the City Clerk; and WHEREAS, the City Cpuncil has considered the special benefits accruing to each lot or tract of land in said District by reason of the making of said street paving, curb, gutter and drainage improvements and has determined that the apportionment of the assessments for said improvements as set forth in the following notice, is in accordance with such benefits; THEREFORE, BE IT RESOLVED BY THE CITY OF ASPEN, COLORADO: 54O Regul.,~r__~[gting~ .......... ~?_p_e_n ............. ??mb_e r 21, 1966 1. State Highway Wurl stated he had attended the State Highway Commission meeting in Denver with the Meeting following results. Funds have be~n allocated for the widening of the Cooper Street Bridge and the intersection on O~ig~nal if the City is able to acquire the land. ~ Money has been budgeted to pave 8 miles on Independence, Pass, also indicated .they , would go along with widening of the highway in connection with the Street Improve- J ment for 1967 if this should come to pass. University of Colorado representatives plan to visit Aspen later in the year, Wurl reported. South Annexation - 64% of land area'has signed the petitiions, which includes 56% S. Annex. of the people. Filter Plant- Present plan is to begin running water through the ~la~t November 28th, Filter Plant dedication would be December 10th. Dedication Beck and Bishop Lease - Albert Bishop was present with a counterproposal of $400.00 per month or designate three appraisers which is provided for in the lease. Beck & Bishop Discussed repairs made and those needed. Council instructed Administrator Wurl Lease to select the City's appraiser. Sidewalks - The assessments were submitted to Council, of which will be billed to Sidewalks the people. Snow Removal - Wurl recommended to Council no parking from 2:00 to 7:00 in the business district from Mill to Galena and Durant to Main. Discussed 2:00 a.m. Snow Removal being a hardship on the businesses. Also discussed covering the no parking signs with bags. Council agreed to table this till the next meeting. Curfew Liquor License Renewals -~Councilman Clymer and Stapleton stated there were 5 applications they would like to question, based upon the police reports, sanitation Liq. Lic. reports and credit reports. Renewals Galena St. East - lack of restaurant operation Guido's Swiss Inn on Main Street - license not in use. Sunnie's lack of restaurant license Woodlander - lack of cooperation with Police Department, Tico's lease arrangement iwith the Woodlander. Abbey - in arrears on utility bills. Galena St. East - Sanitarian reported the kitchen is operating, license has been appti~dffor. Sunnie's Sunnie stated the lack of the restaurant license was an oversight on her part. Sanitarian reported that she has applied for her restaurant license. Guido's Swiss Inn - Main Street - Guido reported he would not lease the operation until someone desireable wished to lease the establishement. Abbey - Finance Director Richard Flewelling reported the Utility Department constantly had to threaten the Abbey in order to get them to pay their Utility bills. Water Utilities interprets this as $30.00 per student full capacity which is 300 students. School also stated the City agreed to bili the S~hool inside City rates - no written agreement. Wurl states the City is billing the School on the 2" meter rate instead of the 3" meter as installed.
