Clymer, City Attorney Gaylord, City Administrator Leon Wurl and City Engineer and
Building Inspector Roger Mahnke.
The City Clerk submitted to Council the following on the South Side Annexation.
Petitions, Agreements, 4 Original Plats.
South Side The percentage of boundary contiguous 27.8%, percentage landowners~ signed 80 3%;
Annexation percentage of land area signed 86.2%.
Luke Anthony request his letter submitted to Council be read today and also at the
public hearing relating to zoning of the South Side Annexation.
City Attorney informed Council the requirements for annexation should be substantiat-
ed by the City Engineer at the Public Hearing by Resolution.
Where Garmisch Street crosses old Midland right-of-way, this being a public road,
Administrator Wurl expressed the opinion we did not need an agreement signed.
The following Resolution was read by the City Attorney in full:
RESOLUTION
WHEREAS, a petition for annexation, of territ0ry to the City of Aspen was filed
with the City Clerk on January 30th, 1967, requesting annexation of territory
to the City of Aspen, Colorado, which territory is described in exhibit "A" attached
hereto;
AND WHEREAS, the petition and the documents attached thereto meet the statutory
requirements of the State of Colorado;
NOW, THEREFORE, BE IT RESOLVED that the said petition for annexation shall be and
the same is hereby accepted and ordered filed, and that notice over the signature
of the City Clerk of the City of Aspen shall promptly be published for hearing to be
conducted on Monday, March 6, 1967, at 3:30 o'clocR p.m., according to law.
Councilman Stapleton moved to adopt the foregoing Resolution. Seconded by Councilman
McEachern. Roll call vote ~ Councilmen Stapleton aye; Kuster aye; McEachern aye;
Clymer aye.
Report on violation of possession and false ID's at Galena Street East was submitted
Galena St.East by John C. Philpott, State Liquor Inspector with the recormnendation the Council
Violation hold a hearing.
City Attorney stated whenever you have a written notice of violation filed the
Council must investigate.
Councilman Stapleton moved tohold a public hearing February 13, at 5:00 p.m. on the
violation by Galena Street East. Seconded by Councilman McEachern. Councilman Kuster
abstained. Ail remaining Councilmen in favor, motion carried.
Letter from Tallmadge, Tallmadge, Willson and Lamm was submitted to Council relating
to Street Improvement #67-1 bonds.
~ump - Council discussed with Attorney Stewart, representing the Christensen Brothers
Dump the liens against the property. Mr. Stewart stated he was unaware of the liens until
December 1966. Also stated the Christensen Brothers are willing to live up to the
agreement, would like theCity to make the dump payment in the amount of $14,000 now.
Discussed incumbrances on the property ;and obtaining releases. Mr. Stewart stated
this would take 30 days to obtain at least.
Discussed the Countys wish the land be free and clear before paying their share of
the dump cost~ Council agreed to talk with~the County.after the Cities problem with
the Christensen Brothers is resolved.
Councilman McEachern moved that the payment to Christensen Brothers in the amount of
$14,000 be withheld till such time as the City is presented with merchantable title.
Seconded by Councilman Stapleton. Roll call vote - Councilmen Kuster aye; McEachern
aye; Staplton aye; Clymer aye.
Rio Grande and Denver Railroad - Administrator Wurl submitted letter addressed to
~ D&RG RR the railroad from the City listing representatives to participate in a closed meeting
on the long range plans of the railroad.

Discussed the City becoming this involved. D&RG Railroad
Council agreed Administrator Wurl should represent the City at the meeting but the ~
letter should not be written by the City.
Council agreed the Planning and Zoning Commission should fit the zoning for the
South Side Annexation with the Master Plan. Zoning

Sinclair Station - Wurl stated the owner would like theCity to reimburse him for repairs
made when Sewer pipe was damaged during installation of the curb and gutter. ;inclair St~ ion
Wurl to check with the State Highway and McCune Construction on installation of the
curb and gutter. Damages in 'the amount of $470.00.
Councilman Stapleton made a motion to adjourn at 6:25 p.m. seconded by Councilman
McEachern. Ail in favor, meeting adjourned.
