Special Meeting Aspen City Council February 13, 1967
GALENA STREET EAST - Liquor Violation
Meeting was called to order by Mayor Robert Barnard at 5:05 p.m. with Councilman
Stapleton, Kuster, McEachern, Clymer, City Attorney Gaylord and City Administrator Leon ~-~
Wurl.
Letter from s Mr.,Thompson was read by Mayor Barnard requesting charges made by Officer Municiapl
Husted against his son were unjustified and request they be dismissed. Court
Administrator Wurl to check out.
Report of violation and letter to Mr. Fleisher of Galena St. East from the City of Aspen ~alena St. East
were marked as exhibits for the City.
Report of Violation submitted by John C. Philpott, State Liquor Enforcement Officer was
read by Mayor Barnard. Letter of notification of the hearing to be held, as sent to
Mr. Donald Fleisher from the City Attorney, was read by Mayor Barnard.
Mr. Philpott introduced the arrest record and two photos taken upon arrest by the City
of Aspen Police Department on each party and ID's.
Mr. Philpott was sworn in by the City Clerk as a witness for the City.
Mr. Philpott stated on January 20, 1967 at approximately 10:20 p.m. three other officers
and himself entered Galena St. East. Noticed many young persons whose ages were
questionable. Began to check ID's upon which a number of parties left. Did apprehend
2 parties both age 18. Both girls charged with drinking under age in Pitkin County
Court, also using false identification. Both plead guilty of both charges and were
found guilty and fined.
Introduced arrest report and documents used to gain entrance and pictures taken by the
Aspen Police Department upon the night of arrest.
There was a man at the door checking identifications. Pictures showed quite a contrast
between the pictures taken the night of arrest and the picture on the identification.
Did not see Mr. Fleisher in the Club. Could not determine as to which waitress served -~
the drinks. The beer was confiscated and used as evidence in County Court. Presently
being held in the Aspen Police Department property room.
Mr. Fleisher stated he could not be sure these were the same ID's as sued for identifica-
tion at the door. The checker at the door has a very strict system he must follow.
The form to follow in checking ID's was submitted to Council and marked as exhibits
for Galena St. East.
If a person has presented a false identification and has been picked up for it, he
might not actually disclose this ID but another one.
Mr. Fleisher stated he was in the Club at 9:00 p.m. and the remaining three hours of
the evening. In the pattern of entertainment the band goes on the stage on the hour
and off quarter to the hour. Many people leave and come between quarter to and the
hour.
No one is allowed in the Club after 9:00 p.m. under 21 years of age. Checker is
changed at 7:00, 8:00 and 9:00. Emergency exit can only be opened from the inside.
Mr. Philpott stated this was not the first violation, 2 similar violations in the last
4 months.
Mr. George Wilson checker ~or Galena St. East was sworn in by the City Clerk. Stated
he had worked in 7 establishments similar to Galena St. East and this Club has the
firmest checking~ system he has ever seen.
There being no further questions, Council agreed to consider the evidence and render a
written decision at a later date.
Councilman Stapleton moved to adjourn at 5:40 p.m., seconded by Councilman Kuster. All
