Meeting was called to order by Mayor Robert BarnaMd at-3:55 p.m. with Councilmen
Werner Kuster, John Benninghoff, Clyde Clymer and Administrator Leon Wurl.
The accounts payable were given to Councilman Benninghoff to check.
Councilman Kuster made a motion to approve the minutes of March 28th and April 1st
as m~iled. Seconded by Councilman Clymer. Roll call vote - Councilmen Benninghoff
aye; Kuster aye; Clymer aye.
Pub - Decision Public House Bar - Councilman Clymer made a motion that the "Pub" liquor license be
suspended for 30 days but the total 30 days be held in abeyance 30 days probation
period. Seconded by Councilman Benninghoff.
Councilman Clymer stated the reasons for the motio.n was although the Manager paid for
his fine, believe the owner of the establishement - Mr. Swales - should get his
knuckles rapt. If any serious problems arise during the 30 day probation period, license
will be suspended. This will also be noted during renewal time for liquor licenses.

Hodge-Oliver Hodge-Oliver Building Permit - Mayor Barnard pointed out additional things have come
Bldg. Permit to light since the Planning and Zoning's approval of this pez-mit.

Regular Meeting Aspen City Council April 15, 1968
Councilman Kuster reported he had had a call from the Speaker of the House, John building
Vanderhof, who requested to know what is being done about the sanitation problem moratorium
in Aspen. Also mentioned the $1,000 fine levied against the City for polluting the
Roa~ing Fork River and killing the fish. Councilman Kuster further reported he had
looked into the problem, 3 water samples taken near and at the opening where the
sewage falls into the Roaring Fork were submitted,pictures submitted and reports
from the State Health. .Also read correspondence directed to the Sanitation District
from Frank Rozich technical Secretary of the Water Pollution Control Commission
relating to :the present sanitation plant being overlOaded~
Councilman Kuster stated he would have. to make a report to the State by the end of
the week and request what Council wished to do about the matter.
Mayor Barnard pointed out the~Council is charged with the responsibility of the healtl
safety and welfare of the people of the City.
Discussed the temporary measures that could be instigated to alleviate the problem.
Discussed the affect of large project construction on the overloaded district.
Councilman Bergman arrived.
Councilman Bergman reported as Secretary of the Metro Sanitation District, the
District is doing~Rll that is possible at thais time. Presently being held up by
legal red tape. Looking into temporary measures which will have to be a practical
solution not a sloppy arrangement.
Council spoke of their concern if an epidemic broke out in the area.
Councilman Kuster made a motion to instruct the City Administrator to prepare a
Resolution for Council to declare a moratorium on the issuance of all building
permits until the sanitation problem is resolved. Seconded by Councilman Benninghoff

Councilman Kuster made a motion to accept the low bid of the Aspen Times for legal

Sidewalk Overhang request of August Evert - Eart Schennum, Contractor, explained to
~ ~Overhang Council the request is for a 2' overhang over the sidewalk. A plan was shown to Council

ORDINANCE #16, SERIES 1968, AN ORDINANCE AMENDING TITLE VIII, CHAPTER 2, RELATING TO
Ord. #16, EXcava - EXCAVATIONS OF THE ORDINANCES OF THE CITY OF ASPEN, COLORADO was read in full for the

Administrator Wurl reported there is no fee schedule for excavating dirt or gravel
streets in our present ordinance.
Councilman Clymer made a motion to approve Ordinance #16, Series 1968 as read in full

Ord. #17 Water ORDINANCE #17, SERIES 1968, relating to water. Administrator Wurl reported the ordinance is not ready at thiS time.

Ord. #18 Electio OF THE ORDINANCES OF THE CITY OF ASPEN, COLORADO was read in full for the first time
Wards 'by the City Clerk.
Administrator Wurl explained by the passage of the ordinance the City election wards
would be the same as the County's precincts.
City Clerk outlined to the Council the number of registered electors in the new wards.
Councilman Kuster made a motion to approve Ordinance #18, Series 1968 as read in full
for the first time and order same publsihed. Seconded by Councilman Clymer. Roll call

Councilman Clymer made a motion to approve the following polling places for elections:
Polling Places City Hall for Wards 1 and 2, Aspen Community Church for Wards 3 and 4 and the Messiah

Sales Tax Report - Administrator Wurl reported he had not met with the Lodge owners Sales Tax
todate. No conclusioms were made at the joint meeting between the Council and County
Commissioners. Commissioners wished to discuss this further and meet with the Council
at a later date. , ....

Councilman Benninghoff made a motion that City Administrator Leon Wurl be instructed to,~
with the help of the City Engineer, lay out an area in the business district for 2- 2-hour parking
hour parking. Seconded by Councilman Clymer. Roll call vote - Councilmen Kuster nay;
Clymer aye; Benninghoff aye; motion carried.
Administrator Wurl stated the City should give a grace period plus it will take time
to obtain the signs
Golf Course - Wurl reported he has had no world from the owners of the establisked golf course
golf course. Council instructed Administrator Wurl to continue to look into a different
location for a permanent golf course.
Conference Center - Council agreed to hold this in abeyance since there is not a demand conference center
at this time from the people.
Transportation Center - Administrator Wurl stated he is still looking into this and transpo~mtion
would have a report by the next Council meeting, center
Bavaria Park - Wurl reported the School is putting up $1041.00 towards construction Bavaria Park
of the football Field on the park. The Booster Club is checking into whether they
wish to take the concession stand or not. Mr. Wurl reported further the firm of
Schlupp and Ferguson will submit a report at the next meeting of the Council. ~-
Glory Hole - Mr. Wurt reported the Cities application for a grant has been turned down ~lory Hole
for the second time. Grants seem to be going to those projects which benefit the most Park ,,
people.
Councilman Benninghoff request the City fence and grade.this park for a better appearance.
Administrator Wurl read a memo relating to the schooling Sergeant Drehobi attended in
Denver.
Councilman Benninghoff made a motion a Resolution be prepared expressing Councils Drehobl-School
appreciation for Sergeant Drehobls efforts in obtaining.a good grade. Seconded by

Four-Way Stop - Mill and Main. Mr. Wurl reported the State =requires the Cooper Street 4-Way Stop Main
bridge to be completed ~efore considering the 4-way stop. St.
Councilman Benninghoff made a motion to approve the attendance of Administrator Wuri St. Highway Meet.
to the State Highway Meeting in Grand Junction on the 16th of April. Seconded by
Councilman Clymer. All in favor, motion carried.
Administrator Wurl stated he would discuss with the State Highway Department the
construction of the Cooper Street Bridge and report at the next Council meeting.
Deputy Police Magistrate - Administrator Wurl reported Magistrate Meyer will be leaving Deputy Magistrate
the Country on approximately the 18th of April and todate has not appointed a Deputy.
Discussed the people who were interested when the position of Magistrate was filled.
Councilman Kuster made a motion to appoint Lennie Oates as the Deputy Police Magistrate Leonard Oates

Holy Cross -.:Utility Line Easement - Mr. Startup was present and request an easement Utility Line ih
from the transformer pole at the filter plant straight down over t~,~Castle Creek, due Easement

Councilman Kuster made a motion to authorize a utility line easement to Ho%~ Cross
Electric subject ct the approval of the City Engineer and City Administrator. Seconded

· Interski Eigth Interski - Administrator Wurl reported there will be an elaborage parade on
Saturday beginning at 2:00 a.m. opening ceremonies have been changed to Paepcke Park.
~ Parade route as follows:
Beginning at 7th Street and Main east to Monarch, up Monarch to Durant, up Durant to
Garmisch and down to Paepcke Park.
Wurl reported traffic will be allowed to flow while parade is not in progress.
· . Councilman Kuster made a motion to approve the route for the parade. Seconded by
Councilman Benninghoff. Roll call vote - Councilmen Clymer aye; Benninghoff aye; Kuster
aye.
Mayor Barnard reported Mr. Huebinger is making an addition down by the railroad tracks
for which he did not obtain a building permit nor did the plans come before the Planning
and Zoning.
Administrator Wurt stated since this was brought to Mr. Huebinger's attention, by the
Building Inspector, he has obtained a permit.
Discussed the letter Mr. Francis Whitaker is attaching to all his personal payments for
Sales Tax-Whit~ er statements received, stating he i~ deducting the City sales tax from the statement.
Administrator Wurl reported the City has done everything ab~mt of filing a lien.
Councilman Benninghoff made a motion the City begin action against Mr. Whitaker for
collection of the City Sales Tax. Seconded by Councilman Kuster. Roll call vote

Phone Increase Phone Increase - Administrtor Wurl submitted a letter from the Public Utilities
Commission relating to an increase of phone rates of Mountain States Telephone.
Would not affect interstate rates.
Councilman Benninghoff made a motion to instruct Administrator Wurl to send a letter
in opposition to the phone increase within the confines of the City of Aspen. Seconded
by Councilman Clymer. Roll call vote - Conncilmen Benninghoff aye; Clymer aye; Kuster
aye.
Incident reports on bar establishements were submitted to Council.
Council request to see all the incident reports on the Little Bavaria - "Toad Hall"
Little Bavaria to consider the validity of holding a hearing.
Incident Report
3.2 License Letter from King Woodward relating to sign violations was submitted. Council agreed
to follow the ordinance as relates to signs in violation notwithstanding the number
Signs of sings in violation.
Councilman Benninghoff made a motion to adjourn at 5:55 p.m., seconded by Councilman
Ctymer. All in favor, meeting adjourned.
