Meeting was called to order by Mayor Robert Barnard at 4:45 p.m. with Councilmen Carl
Bergman, Clyde Clymer and City Administrator Leon Wurl.
The accounts payable were given to Councilman John Benninghoff to check. (See late
arrival)
Purchase and Sale, Abbey - Ail forms required by the City were submitted to Council,
Abbey Council reviewed the file and was found to be in order.
Purchase & Sale
Councilman Bergman made a motion to approve the aPplication for purchase and sale of the
liquor license held by the Abbey. Seconded by Councilman Clymer. Roll call vote -
Councilmen Bergman aye; Clymer aye; Mayor Barnard aye.
Councilman John Benninghoff arrived.
Towing Bids Towing Bids - Administrator Wurl reported one bid was received from Lew's Wrecker Service
in the total amount of $65.00.

RESOLUTION #24, SERIES 1968 was read as follows by the City Clerk:

WHEREAS, the City CoUncil for the City of Aspen has held its general meetings
on the first and third Monday of each month; and Change in Council
WHEREAS, it is more practical and beneficial in dealing with the business Meeting Dates
affairs of the City to hold meeting~of the City Council on the second and fourth
Monday of each month;
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Aspen, Colo-
rado hereby establish the second and fourth Monday of each month, at 3:30 p.m.,
as the date and ~ime for the general meetings, commencing November, 1968. Such
City Council meetins shall be held in Council Chambers at City Hall of the City
of Aspen, Colorado.
Councilman Benninghoff made a motion to adopt the foregoing Resolution ~24, Series 1968.
Seconded by Councilman Bergman. Roll call vote - Councilmen Clymer aye; Bergman aye;

Luhnow Request - Alley - Mr. Luhnow stated previously he had requested from the City that
they vacate the alley between himself and the 2 condominiums. Now would like to request Alley-Glory Hole
the City move the dead end alley over one lot which is still in Mr. Luhnow's ownership to
the east. Would also like to request Mr. Luhnow have the use of the entire alley.
Councilman Benninghoff made a motion to table this request until full Council is present.
Seconded by Councilman Clymer. Roll call vote - Councilmen Bergman aye; Benninghoff aye;
Clymer aye.
Foot Race - Administrator Wurl reported Mr. Callahan would like to close off Mill Street Foot Race
and the Highway for a short time during the foot race to be held on November 3rd.
Councilman Bergman made a motion to approve the closure of Mill Street and the Highway on
the plan as submitted for the foot race. Seconded by Councilman Clymer. Roll call vote
Councilmen Benninghoff aye; Bergman aye; Clymer aye.
Reports City Administrator:
Sanitation Meeting - The Water Conservation Board authorized their engineer and attorney
to negotiate with the Aspen Metro.. Board on all disputed matters between the two boards. Sanitation Meeting
Railroad - The County Commissioners agreed to ask that the land be deeded to the County
with a deed held in escrow back to the railroad in the event that they wanted to re-build Railroad
the railroad.
Statue - Ten Commandments - Administrator Wurl reported it has been suggested to him that
the City turn this over to the Park Association for recommendation. 10 Commandments

Councilman Clymer made a motion to turn this request over to the Park AsSociation for their
recommendation. Seconded by Councilman Benninghoff. Ail in favor, motion carried.
Sales Tax Question - Councilman Clymer suggested that all ads bear the wording of who to
call if the citizens have any questions. It was also suggested that a booth be set up at Sales Tax
the school carnival to answer questions and give out information relating to the tax.
Also poll watchers to get people out to the polls.
Administrator Wurl suggested Council meet with the Commissioners and decide how they might
want to handle this. Administrator Wurl to schedule meeting.
Street Cuts - Mayor Barnard pointed out some contractors are not doing the cuts properly,
also contractors have materials stored on the street; permits are issued without paying Street Cuts
(charged). Building Department not staying on top of these things. Ordinances are not
being followed.
Suggested actions were: set up a fine system for those cuts which go over the time limit;
look into these violations at the time of renewal of licenses for contractors.
Council instructed Administrator Wurl to look into a fine system on a graduated basis for
violations of street cuts.

Regular Meeting Aspen City Council October 21, 1968
Reg. Warrants Registered Warrants Administrator Wurl requested permission to raise the limit from
$50,000 to $75,000.
Mayor Barnard pointed out that there is a misunderstanding as relates to the City's
overdraft. City has approximately 17 accounts at the Bank. In considering overdrafts
the Bank does not consider all accounts, which are not all overdrawn, but considers
each account individually.
Council questioned if Resolutions could be prepared previous to paying the bills so
that money can be transferred to cover the bills for each account.
Councilman Clymer made a motion to raise the ceiling on registered warrants to ~75,000.00.
Seconded by Councilman Benninghoff. Roll call vote - Councilmen Bergman aye; B&nning-
hoff aye; Clymer aye.
Mayor Barnard made the announcement that Attorney Albert Kern has agreed to accept the
Appointment of position as City Attorney at the rate of S25.00 per hour. Mr. Kern has requested
City Attorney Kerr to meet with the Mayor and Council before making it final. Ail three Councilmen
present voted in favor of Albert Kern.
Councilman Benninghoff made a motion to appoint Attorney Albert Kern as City Attorney
for the City of Aspen subject to meeting with the Mayor and Council and outlining
the requirements of the position. Seconded by Councilman Bergman. Roll call vote -
Councilmen Clymer aye; Benninghoff aye; Bergman aye.
Dump - Administrator Wurl reported the fence has been completed, now require a road.
Dump Two mean dogs have been offered to the City.
Discussed putting in a trailer temporarily for the dump maintenance man, and buiid
the duplex next year.
Administrator Wurl also reported the City Hall is down one more permanent employee.
Minutes - Councilman Clymer made a motion to approve the minutes of October 7th and
t4th as mailed. Seconded by Councilman Bergman. Roll call vote - Councilmen Benning-
hoff aye; Bergman aye; Clymer aye.
Discussed the different Municipal League Proposals relating to Police Pensions,
Municipal Human Rights, Cable TV, County Governments, Municipal Home Rule.

Special Meeting Aspen City Council October 28, 1968

Meeting was called to order at 3:45 p.m. by Mayor Robert Barnard. Councilmen Carl
Bergman, Werner Kuster, Clyde Clymer, Attorney Albert Kern and City Administrator Leon
Wurl.

OF THE ORDINANCES OF THE CITY OF ASPEN, COLORADO, PERTAINING TO THE LEVYING OF TAXES, Levy - 6 Mills

Councilman Bergman made a motion to adopt Ordinance #40, Series of 1968 on second
reading and order the same published. Seconded by Councilman Clymer. Roll call vote -

Centre of Aspen - Purchase and Sale. Ail forms required by the City were submitted by Centre of Aspen
the City Clerk to the Council previously for review. All in order. Liquor License
Councilman Bergman made a motion to approve the transfer of liquor license for the Centr,
of Aspen. Seconded by Councilman Clymer. Roll call vote - Councilmen Bergman aye;
Kuster abstain; Clymer 'aye.

Attorney.
Councilman Kuster moved that the results of the ballots were uanaimous for Albert Kern,
therefore, the City of Aspen appoints Attorney Albert Kern as City Attorney for the
City. Seconded by Councilman Ctymer. Roll call vote , Councilmen Bergman aye; Kuster
aye; Clymer aye.
Attorney Albert Kern was sworn in by the City Clerk as City Attorney for the City.
Teen Center - Administrator Wurl reported a total of $3,800. was received in donation Teen Center
for the Teen Center. Approximate total of 400 people attended the benefit dinner at
the Pomegranate~~
Councilman Kuster moved to adjourn at 4:00 p.m., seconded by Councilman Bergman. All
in favor, meeting adjourned.
