Meeting was called by Mayor Robert Barnard, Councilmen Werner Kuster, Carl Bergman and
Clyde Clymer for 8;30 a.m. for the purpose of approving parking leases.
Mayor Barnard called the meeting to order at 8:45 a.m. with Councilmen Werner Kuster,
John Benninghoff, Clyde Clymer, City Attorney Albert Kern and City Administrator Leon
Wurl. Also present Attorney Phil Roan from Westminster.
Parking Lot Three leases were submitted by the City Attorney relating to parking lots as follows:
Leases 4 lots between Hi-Country Lumber and Dr. Crandall's office; 3 lots next to Design Pri-
marily; 2 lots next to the Wheeler Opera House. Administrator Wurl reported he is still
negotiating on the 5 lots south of Guido~s Swiss Inn.
Leases require payment by the City of $25.00 per lot per month. Length of the lease would
be from approval date to the middle of April, 1969.
Administrator Wurl recommended the City only plow the parking lots and consider a daily
rate of perhaps 50¢ per car, per day.
Mayor Barnard suggested stickers be sold at Cit~ Hall to be placed in the back window
of automobiles with the dates stamped on the sticker for the time which has been paid
for.
Mr. Wurl also reported the 3 locations which leases have been prepared for, will accom-
modate 100 cars. With the 4th location, could accommodate 200 cars.
Councilman Carl Bergman arrived.
Administrator Wurl stated the location next to Design Primarily has been offered as year
around.
Councilman Bergman made a motion to approve the leases for parking lots from Zoline, Shaw,
Dingilian and Aspen Grove-Charles Urschel properties and authorize the Mayor and City
Clerk to sign the leases. Seconded by Councilman Clymer. Roll call vote Councilmen
Bergman aye; Kuster aye; Benninghoff aye; Clymer aye.
Contempt Action Attorney Roan outlined what would take place in court this da~e at 10;00 a.m. Francis
F. Whitaker vs Whitak~r' vs City of Aspen and Sam Lum City Treasurer. CivilAction 3900 - Contempt.

Councilman Benninghoff questioned if a settlement could be considered.
Attorney Kern explained he had talked with Mr. Whitaker who had requested the City drop
its appeal on the sales tax, pay his attorney's fees and damages and it turn he would
drop any attacks on the Gross Receipts Ordinance and would not press damages against the
Finance Director for closing his shop. Kern had discussed this with the Mayor and two
Councilmen who stated they~would only agree to drop the appeal on the sales tax if Whi-
taker would agree to drop the contempt action, not attack the Gross Receipts Ordinance
and not press damages.
Attorney Roan stated Mr. Whitak~shdpnwasaglosed for approximately 15 minutes.
Mr. Kern also stated Mr. Whitaker would not agree to go along with the offer made by City
for settlement.
Adjourn Councilman Kuster made a motion to adjourn at 9:20 a.m., seconded by Councilman Benning-
hoff. Ail in favor, meeting adjourned.
