February 10, 1969 Meeting was called to order by Mayor Pro rem Kuster at 4:00 p.m. with Councilmen Carl Berg_'l man, Clyde Clymer, City Attorney Albert Kern and City Administrator Leon Wurl. The accounts payable were given to Councilman Clyde Clymer to check. Minutes Councilman Bergman moved to approve the minutes of January 24th and 27th as prepared and mailed by the City Clerk. Ord. #3 ORDINANCE #3, SERIES OF 1969, AN ORDINANCE AMENDING TITLE IX, CHAPTER 2, OF THE TAXATION Cigarette Tax AND REVENUES PERTAINING TO AN INCREASE IN THE CIGARETTE TAX was read in full for the first time by the City Clerk. Councilman Clymer moved to adopt Ordinance #3, Series 1969 on first reading as read in full and order the same published. Seconded by Councilman Bergamn. Roll call vote Counc£1men Bergman aye; Clymer aye; Mayor Pro tem Kuster aye. Ord. #4 ORDINANCE #4, SERIES OF 1969 AN ORDINANCE REPEALING TITLE III, CHAPTER 5, RELATING TO THE Bldg. Inspec- DEPARTMENT OF PUBLIC WORKS AND AME~IDING THE NAME OF THE DEPARMENT OF PUBLIC WORKS TO THE t~r DEPARTMENT OF BUILDING INSPECTION AND PROVISIONS RELATING TO THE APPOINTMENT OF CHIEF BUILDING INSPECTOR AND DEPUTY BUILDING INSPECTOR was read in full for the first time by the City Clerk. Administrator Wurl reported this would take the Building Inspector out from under the superwision of the City Engineer and let the City Engineer devote more time to engineering. Councilman Bergman moved to adopt Ordinance ~, Series 1969 as read by the City Clerk on first reading and order the same published. Seconded by Councilman Clymer. Roll call vote - Mayor Pro tem Kuster aye; Councilmen Bergman aye; Clymer aye. School Zone Mr. & Mrs. James Dodge were present and request the City ask the State Department of High- ways to make a study and recommend to the City what can be done in regard to the school zone on Main Street. Mrs. Dodge reported this latest incident where a child was hit has not been the first time,, and even adults have a difficult time crossing Main Street. A report from the Police Department was submitted showing the number of hours spent patro- ling the school zone and number of,tickets issued. Report also showed out of 82 tickets issued in the school zone, 64 were ZG licenses or persons who work in Aspen. Councilman Bergman made the following suggestions: underground or over pass for pedestri_ aris, a light the children can control, bumps or lowering the speed limit. Councilman Clymer stated he would go for the push button light, since he had been in favor of a stop light on Main Street for three years. Also stated the pedestrian has the right-of-way and this should be inforced. Councilman Bergman made a motion to instruct Administrator Wurl to consult with the State Department of Highways and request the State make a study and recommendation in regard to the problem of the school zone on Main Street. Councilman Bergman made a motion Lodge License to approve the rooming house license for 1969 to the Hillside Lodge. Seconded by Council- man Clymer. Holloway, & Appeals Charles Collins and Earl Schennum for 2 year terms on the Board of Examiners and Appeals. Bldg. Vi~la- Building Violations Administrator Wurl submitted a memo reporting that Aspen Square and tions Bob Stevens were fined $300. in Police Magistrate's Court. Continental Inn and Mr. Uhl- felder were granted continuances and this will be coming up on the 19th of February. Atto~n neyKern reported all potential violators except for Hibberd have been served. Legislative Legislative Proposals - Administrator Wurl submitted a memo and discussed with Council Proposals bills affecting the City. Administrator Wurl recommended the City oppose the following: House Bill #1085 dealing with Metropolitan Councils of government. House Bill #1001 relating to the disposition of unclaimed and abondoned funds for property.. Two measures dealing with the State collection and redistribution of sales and excise taxes. Senate Bill ~15 relating to the forming of districts. $72 R~gular Meeting Aspen_C~.~ounci! February 10, !969 Councilman Bergman made a motion to instruct Administrator Wurl to oppose the measures as Legislative outlined by his recommendation and so notify the legislators and others. SeConded by Proposals Councilman Clymer. Roll call vote Councilmen Bergman aye; Clymer aye; Mayor Pro Tem Kuster aye. Administrator Wurl recommended the City support the following measures: HCR #1006 relating to the total exemption of the ad valorem tax on property owned by per- sons 65 or older. HCR #1104 amendment to the constitution providing for credit of 25% against taxes on prop- erty owned by persons 65 or over. #1086 allowing an extra month for the Commissioners to levy the property tax. Administra- tor Wurl reported the League is working on an amendment to this bill giving the same allow ~nce to Cities. William Dunaway request the City support Senate Bill #40 relating to the protection of fishing streams. Councilman Clymer made a motion to go along with Administrator Wurl's r~commendation as to the bills he favors and Senate Bill #40 and instruct Mr. Wurl to so notify the state legislators and others. Seconded by Councilman Bergman. Roll call vote - Councilmen Bergman aye; Clymr aye; Mayor Pro rem Kuster aye. Senate Bills #75, #81, #86, #87 and #88 relating to water. Administrator Wurl request no recommendation be made on this at this time and until further information is received relating to the full.~_ex, tent of these bills. Discussed control Meeting Place of liquor outlets - Gity and State. Letter from the Chamber relating a thank you to the City for its cooperation during Win- Winterskol terskol. Semi annual report of the police Pension Fund was submitted by the City Clerk. Police Pen. Attprmoy Kern reported he had received a letter from Leo Rowland relating to an automobile Rowland- being moved from his premises by the City. Mr. Kern stated he had answered Mr. Rowland's Auto letter. Mre. Kern also reported he had sent a letter to the Council requesting it appear for a Coughenour private session with Mr. Coughenour and Stalder in the Council room on Tuesday at 4:00 Stalder p.m. Mr. Kern also reported as relates to Mr. Whitaker that he had sent a letter to Mr. Whit- Whitaker aker and his Attorney, Mr. Gross, stating the City's positon concerning Herron Park,.the City would follow the Pitkin County Park Association's recommendations and also the amount budgeted for this park which is $758.00, not including labor and trucks. Mr. Kern reported Mr. Whitaker wishes to sit tight on the $2,000 for the park. Mr. Wurl stated that to raise the funds for Herron Park to $2,000, the City would not be able to follow the recommendations of the Pitkin County Park Association for the other City parks. Attorney Kern also stated to Mr. Whitaker that the figure is not known at this time as to just how much revenue from the City-County Sales Tax will be used on this park. Mayor Pro Tem Kuster asked City Attorney Kern is he had the report requested by Council relating to Mr. Whitaker's reported actions while living in Carmel, California, and the circumstances surrounding, his leaving that city. Attorney Kern reported he did not have the report, but Mayor Barnard had presented some information to the Council at the last meeting. Mayor Pro Tem Kuster referred to a letter printed in the Aspen Times, signed by Mr. Sam B. Colburg stating the reasons Mr. Whitaker left Carmel as "he did not like the change in the life of the town. In fact a Town Life has disappeared and the Care, Feeding, and Bedding Down of the Tourist is the whole damn thing." The Mayor Pro Tem commented as to why a person to concerned about that city becoming tourist oriented, that he felt compel- led to leave it, only to move to a city almost entirely dependent on tourism and involved himself in city government that must concern itself with the visitor. Regular Meeting Aspen cit~ CQuncil February 10, 1969 Mr. Kern reported as relates to the tax., Mr. Gross has filed motionS in the Supreme Court. Mr. Kern would like to know the City's position before filing a brief. If an agreement can be reached, there would be no necessity for spending fUnds for a brief, time involved and oral arguments. Mayor Pro Tem Kuster stated a full Council should be present before making a decision on this. Councilman Clymer made a motion to pay the bills as submitted by the Finance Department. Seconded by Councilman Bergman. Roll call vote - Councilmen Bergman aye; Clymer aye; Mayori Pro Tem Kuster aye. Councilman Clyme.r questioned if~Mother's Tea Parlor could legall~ under the City's ordin- ance, operate from a truck. It was pointed out that our ordinace pertains to trailers, not trucks. Council instructed Attorney Kern to draft an amendment to this ordinance so that this situ- ation does not happen. Mayor Pro Tem Kuster made a motion to adjourn at 5:15 p.m., seconded by Councilman Bergman. All in favor, meeting adjourned. raine Graves, City Clerk.
