Special Meeting Aspen City Council March 19, 1969
Special meeting called by Mayor Robert Barnard, Councilmen Carl Bergman, Werner Shaddow Mt.
Kuster and Clyde Clymer for the purpose of considering water service to Shaddow Sanitation-
Mountain Village due to conditions now existing. Water
Meeting was called to order by Mayor Robert Barnard at 5:30 p.m. with Councilmen
Carl Bergman, Werner Kuster, Clyde Clymer and City Administrator Leon Wurl.
Attorney Joe Edwards and Mr. Robert Brougham were p~esent representing the Shaddow
Mountain Village.
Water agreement with the City provides that, "It is understood by the water user
that at anytime that the business or dwelling units served create a public health
hazard, the City of Aspen will immediately terminate water service to said premises,"
Administrator Wurl stated complaints have been received from Mr. Preusch and Mr.
dePagter.
Mr. Edwards request the City leave the water on for two more weeks, will then be
closing down and hoo'king up to the sewer system. The problem of sewage overflow
was caused one morning when the timer was not wor'king properly.
Mayor Barnard stated this is not the first time this problem has happened.
Mr. Edwards explained that the sewage is pumped from a lower tan'k to an upper tan'k.
Last Monday the timer was not working properly causing the lower tank to over flow
and thereby causing the sewage to run down the mountain.
Councilman Bergman questioned why Shaddow Mountain Village did not hoo'k up to the
Sanitation District in November of 1968 when they were allowed to do so. Extension
time was up in February 19.69.
Mr. Brougham stated it was at Thanksgiving Time, the ground was froze and covered with
snow, was almost unfeasible.
Mr. Edwards stated he had tal'ked-to part of the Board members of the Sanitatian
District and they had stated to him there would be no problem in getting an extension
to hook up to the sanitation district.
Councilman Kuster moved that the water be turned off at Shaddow Mountain Village
March 20th at 10:00 a.m. as per the letter of notification. Seconded by Councilman
Clymer. Roll call vote - Councilmmn Bergman aye; Kuster aye; Clymer aye.
Councilmmn Clymer moved to adjourn at 5:55 p.m.., seconded by Councilman Kuster. Ail
in favor, meeting adjourned.
