HomeMy WebLinkAboutminutes.council.19690411 Special Meeting Aspen City Council April 11~ 1969 Meeting was called by Mayor Robert Barnard, c~uncimen Carl Bergman, John Benninghoff and Clyde ~Clymer for the purpose of considering the Coughenour-Stalder case. Meeting was called to order by Mayor Robert Barnard at 5:10 p.m. in the City Hall Coffee Room with Councilmen Carl Bergman, John Benninghoff, Clyde Clymer and City Adminimtrator Leon Wurl. Coughenour/Stalder Mr. Co ughenour and Mr. Stalder reviewed with the Council past action relating to this case. Mr. Coughenour stated they are negoiating with Mr. Billings for the purchase of his property which would give them the right-of-way needed for the road. Councilman Benninghoff moved to instruct City Administrator Wurl to draft a letter to Coughenour-Stalder, for Council to review on April 14th, requesting the following conditions be met by Coughenour-Stalder: submit engineering drawings of the road- subject to City Engineer, City Attorney and Council approval; proof that the negoiations with Mr. Billings have been consumated; proof the building shall be connnected to and receive a permit to hoo~k up to the Aspen Sanitation District or the Aspen Metropolitan Sanitation District; the litigants shall dismiss all litigation with prejudice; Co ughenour-Stalder shall use their best and continuous efforts to obtain suitable road access from their property through the Aspen Alps property to the Aspen Alps Road; Coughenour-Stalder shall construct a snow melt road 22 feet in width from their property through the steep section of road with a finisb maximum grade of no greater.than 12% and shall maintain such road. If they comply, Council will look favorable on the issuance of a buildig permit. Seconded by Councilman Clymer. Roll call vote - Councilmen Clymer aye; Bergman aye; Benninghoff aye. Councilman Clymer moved to go into executive sessinn at 6:05 p.m.,~seconded by Councilman Bergman. All in favor, motion carried. Councilman Clymer moved to come out of executive session and adjourn the meeting. Seconded by Councilman Bergman. All in favor, meeting adjourned at 6:45 p.m. ~ ~Lorraine Graves, City Clerk
