Meeting called by Mayor Barnard~ C0uncilment Kuster~ Bergman and Clymer.~- Sidewalk Sidewalks~ Dunning Construction - Councilman Kuster moved to pay Dunning Construction Estimate $13~2~7.85 as outlined by the City Engineer under pay estimate ~2. Seconded by Councilman Clymer. Roll call vote - Councilmen Ctymer aye; Benninghoff aye; Kuster aye. Metro Sanitation Sanitation District -- Councilman Kuster stated he was quite upset with the'way in which District the Sanitation District is tearing out trees etc. along the r~er on east Hopkins Street. City did not construct a temporary bridge at the time of the detour of Highway 82 at this location because 6f tearing out trees. Councilman Benninghoff made a motion the City write a letter of censure to the Metro Sanitation District and call to their attention the fact that much money~ time and effort has been spenz by citizens and the City to preserve the natural look of vhe river and the district is deliberately destroying this natural look. Seconded by Councilman Kuster. Roll call vote Councilmen Kuster e' e' - ay ~ Benninghoffay ~ Clymer aye. Council also instruct such a letter be also senv ye Mr. ~. M. Clark who is building to the south of this location on vhe river. Letter of request from the Metro Sanitation District was submitted ye Council. The District outlined the following sveps ~o be taken when cutting City streevs: 1) Contractor requesv a permit; 2) Submit pland and ~pecification; 3) Cooperave with the city concerning the location of other utilities; -) District responsible for one year after installation for compaction of back fill and repaying of the street surface; 5) District not obligated ye pay street cut fees~ 6) In lieu of the street cur fees~ the contractor will replace the street surface ye its equivalent original condition~ CouncilLstated they disagreed with items ~ and 6 as relates to paved streets. Administrator Wurt stated they would be crossing on Neal Avenue and down by the brige on Mill where there isr~aving. The rest would be dirt streets. Councilman Clymer moved ye require the Metro Sanitation District ~o follow the items as listed 1 through 6 as relates ze dirt streets; for hard surfaced streets~ the City will be responsible for items ~ and 6. Seconded by Councilman Benninghoff. Roll call vote e' Councilmen Benninghoff aye; Kuster ay ~ Ctymer aye. Nomination Nomination Petition - City Clerk reques~ Council approval as required by law~ of-the Petition standard nomination petition issued by Hoeckel's. Councilman Kuster moved ye approve Hoeckel's Form #854 C. T. nomination petition. Seconded by Councilman Benninghoff. Ail in favor~ motion ~arried. Ordinance #26 ORDINANCE ~j26~ SERIES OF 1969 - REFERENDUM PETITION - Copies of the Mayor's vevo and reasons Referendum 'ere previously ~istributed to Council. Petition Councilman Kuster moved ye over-r~de the Mayor's vevo of Ordinance ~26, Series of 1969. Seconded by Councilman Benninghoff. Roll call yore - Councilmen Clymer nay; Benninghoff nay~ Kuster nay. Motion not carried~ Ordinance to appear on the ballov for the November election.. Pitkin Iron Pitkin Iron Mine Corporation - Sanitation Plant Mayor Bernard reported last week he Mine Corp. traveled ~o Denver ye testify along with Mr. Ryan objecting to the installation of a Sanitation sanitation plant up Castle Creek. Judge ruled no~ to issue a temporary in~unction because at this time there is no affluent thav can be shown going into the river. Attorney Clgrk representing the City feels the City would be in a better position to go to court against the mining company and sue for damages to the City's waver supply. (Having to build another clarifier vo provec~ the water)' Further reported while testifying the opposing attorney brough~ into evidence a letver signed by the City Sanitarian Koenig approving the plant. This show that the right hand Jo~snot always know what the left hand is doing when other departments are writing letters of this nature. To sue for damages now~ the City would have a better came in the future. Publicity & Promotion RSA - Health and Sanitation -'Administrator Wurl reported this budget represents 53~ of the amount allocated by the RSA a~d additional as relates to City expenses in this department.
