' ~ Councilman Vare moved to approve the minutes of May llth and 18th as prepared and mailed Minutes by the City Clerk.~ seconded by Councilman Walls.'/All in f~vor, motion carried. Councilmmn Vare moved to approve the minutes and ratify the action of the RSA meeting heid on May 14th as prepared and mailed by t~Recording Secretary. Seconded by Councilman Scott Ail in favor, motion carried. List of Judges and Clerks for the June 16th election were submitted by the City Clerk. Judges & Clerks Councilman Walls moved to approve the li~t of Judges and Clerks as submitted by the City June 16th ~Clerk. Seconded by Councilman Griffin. All in "~/ motion carried ' ' Election ~.a ~or, . Councilman Vare presented a request to use city la~d not designated for park use for showl ings of Aspen arts and crafts. Suggest the land between the fire station and bakery, Attorney Kern arrived. Mayor Homeyer questioned who would be responsible for clean up ~nd dollection of the sales City Land tax. Councilman Vare stated he supposed the Association would be responsible. Further Arts and Crafts reported would like to hold a showing one day a month for three months. Show Coundilman Griffin moved that hte City allow the Aspen Association of Arts and Crafts to have one show on City property located between the fire station and bakery~with the said organization responsible for clean-up, collection of sales tax, etc. revalent to the show. Seconded by Councilman Scott. Ail in favor, motion carried. Councilman Vare to notify the City Administrator fo the date of the show. Brownell Annexation Zoning - Councilman Griffin moved to continue the public hearing on Brownell Annex zoning of the Brownell Annexation until June 8th. Seconded by Councilmna Scott. Ail in Zoning favor, motion carried. Parking Lots - Mayor Homeyer questioned the feelings of Council to leaSe or otherwise Parking Lots obtain open land in the down town area for parking. Discussed different areas in the downtown area and longer term leases and lease purchase of open land. Councilman Whitaker moved to authorize City-Administrator Wurl to negoiate with the Shaws And other for the acquisition of the lots beCween the Opera House and Crystal Palace. Seconded by Councilman Scott. Ail in favor, motion carried. Sidealks, Parking - Administrator'WurI referred to-the motion passed at the last meeting Sidewalks, and suggest not ticketing of the cars but to make a survey of the problem areas, submit Parking a report to Council an make permanent correction of the problem area, i. e. installation of curbs. Discussed conflict between Model Traffic Code and City Ordinance. Councilman Whitaker, City Attorney Kern and City Administrator Wurl to work on this problem. Two Million Gallon Reservoir - Councilman Griffin moved to authorize the Mayor and~City Two Million Clerk to execute the contract with Dale Rea when the land transactions are completed. Gallon Reservoir Seconded by Councilman Vare. Roll call vote - Councilmen Vare aye; Griffin aye; Scott aye; Walls aye~ Whitaker aye. Motion carried. ' Fish - Roaring Fork River r Sanitarian Kinkade reported the.Fish and Game Department has Fish - Roaring determined the fish kill by the Slaughter House Bridge was caused by the planters. Fork River Mr. Kinkade further reported the County ha§ adopted the Air Poilutions Resolution minus Air Pollution the standards which will be determined following the public hearing ~o be held'on June 1st Resolution presently calls for the highest standards, higher than the State regualation. Recommend the City endorse the County air pQllutions as they are now'stated. Coundilman Walls moved the-City endorse the County Resolution on Air Pollution including ti s~andards as presently stated in teh Resolution. Seconded by Councilman Scott. Arthur's Trees - Councilman Scott moved we deny Arthur's request to remove the trees. Arthur's Seconded by Councilman Vare. Ail in favor, motion carried. Trees ORDINANCE #11, SERIES OF 1970, AN ORDINANCE PROVIDING FOR THE ANNEXATION TO THE CITY OF Ordinance #11 ASPEN, COLORADO OF THAT CERTAIN TERRITORY OR REAL ESTATE PARTICULARLY DESCRIBED IN THIS ORDINANCE, LYING OUTSIDE OF, BUT ADJACENT TO THE CITY OF ASPEN, COLORADO: w~s read by tt~l~ only, as agreed by Council on second reading by the City Clerk. Councilman Scott moved to adopt Ordinance #11, Series of 1970 on second reading and order the same published. Second- ed by Councilman Walls. Roll call vote - Councilmen Scott aye; Griffin Aye; Walls aye; Whitaker aye; Vare aye. Motion carried. 1045 Regular Meeting Aspen City Council May 25, 1970 Dog Pound Attorney Kern Submitted agreements relative to dog pound'and pick up of dogS. One agreement Agreements between the G~ty and Luther Albright and one agreemen~ between the City andCounty. Councilman Walls moved to authorize the Mayor and City Clerk to execute the agreements as submitted, conditional Upon the signing by ~he County, of the agreement between'the City and County. Seconded by Councilman Griffin. Attorney Kern reported one agreement ~ePendS on the other, should be executed at the same time, Ail in ~favor, motion carried. Ordinance #13 Ordinance #13, Series of 1970 was read in full on first reading by the City Clerk; AN Personnel ORDINANCE AMENDING cHAPTER 18, TITLEI, OF THE OFFICIAL CODE OF THE CITY OF ASPEN, COLO- RADO, PERTAINING TO .PERSONNEL. Administrator Wurl outlined the basicchanges to the personnel code. Cp~ncilman Scott moved to adopt Ordinance #13, Series of 1970 on first reading, with the exclusion of the emergency clause as read in full by the City Clerk and order the same published. Seconded by Councilman Walls. Roll call vote - Councilmen Scott a~e; Griffin aye; Vare aye; Wails aye; Whitaker aye. Motion carried. Rubey Park Attorney Kern lquestioned Council as to the date for the election of Rubey Park. Council Election request Attorney Kern prepare the necessary ResOlution for the next meeting leaving the date of election blank. Councilman Scott moved the Golf Course Area and Rubey Park land be referred to the Plannin and Zoning Commission for study and recommendation. Seconded by Councilman Whitaker. Ail in favor~ motion Carried, · Smith vs City Attoreny Kern reported on the. case, Smith vs City of Aspen. MotiOn to dismiss and argument~ thereon is shcedu'led .to be heard on June 2nd. Finance Director - Administrator Wurl repo~ted an applicant is in town this date, looks good; mo decision at this time. Planner Planner - Councilman Walls request an executive session be shheduled for the City ~ouncil and County Commissioners to discuss a number of ~items relative to the Planner. Adminis- - trator Wurl to schedule a meeting. Discussed letter from the Pitkin County Park ASsociation relating to maintenance and care of trees. Administrator Wurt reported the City has a working a~gement~]w~th Mr. Pellitier to do the trimming of trees on City property. Council request Administrator Wurl check into inclUding Under the arrangement the grading around the trees and applying liquid fertilize~ Discussed taking care of all trees in the City right-o'f-way i~ the .downtown area. Administrator Wurl to check out the required expense. Golf Course'Land ~ Mayor Homeyer appointed councilman Vare to head a committee to investiga :e the gol~ course land and open space west of the City limits. Councilman Walls rep0rted he has been contacted by residents in the West End about Mr. Hank Pedersen operating a business out of his residence and ~meating a ~nusiance. Admin- istrator Wurl to check outg Employee Housing - Councilman Scott reported his committee came to the conclusion this problem cannot be Solved by the City for all but the City should concern themselves with providing housing for their emPloyees..Perhaps this coUld also include others such as county and quasi gowernmental bodies. Further perhaps to help in this problem, zoning adjustments could be give. Council authorized Administrator Wurl to discuss this with the County.
