Meeting was called to order by Mayor Eve Homeyer at 4:05 p.m. with Councilman Ned Vare,
Fitzhugh ScottlII, Jack Walls, Francis Whitaker, City Attoreny Albert Kern and City
Manager Leon Wurl. Also present Finance Director Dennis Veeder.
Minutes Councilmm~ Walls moved to approve the minutes of July 27th as prepared and mailed by the
City Clerk. Seconded by Councilman Scott. Ail in favor, motion carried.
Court House County Commissioner, J. Sterling Baxter was present to speak with Council on the Court
Annex House Annex. Dr. Baxter informed Council twp sites are presently under consideration;
behind the courthouse and to the west of the courthouse. Dr. Baxter request Council's
feelings of future expansion of the City Hall and perhaps incorporating same behind the
Courthouse and forming ~ civic center. In this case would put the annex to the west of
the courthouse.
Councilman Griffin arrived.
Councilman Comcowich arrived.
Dr. Baxter stated the annex would include law enforcement agencies of the City and C~unty,
driver's licensing, jail, underground entrance and parking for the use of the law enforce-
ment agencies, storage and perhaps a large meeting room. Undecided at this time whether
a second floor is required. Plans for the build%ng will include possible expansion to a
second floor.
Council to review for consideration at the next meeting.

Building itorium located on the Paepcke property near Hallam Lake. Dr. King further outlined the
problems of parking, traffic congestion and property belonging to the University of
Colorado. Referred to the Planning an~ Zoning Commission and Board of Zoning Adjustment.

1-70- Mr. Sam Caudill was present and request Council give consideration of a resolution i-70
relating to 1-70 and Glenwood Canyon or Cottonwood Pass. Highway
Discussed recommendation of no four-laning in Glenwood Canyon or ~Cottonwood Pass. Mr.
CAudill stated he is on the Governor's seven man committee ~ to review 1-70 and the committe
desires to take the Cottonwood Pass as they feel it would be a disaster to go through
Glenwood Canyon. Do not feel this can be done. ~
Councilman Scott moved to resolve: (1) that the City Council favors the designation of
Glenwood Canyon as a national scenic highway; (2) that the City Couneil~favors there
being no Interstate 70 project in Glenwood Canyon (3) if Interstate 70 has to go through
Glenwood Canyon that:the~State Highway Department cOnsider Cottonwood Pass as an alternate
route and (4) the City COuncil favors~the ~designation of that part of Highway 82 between
Twin Lakes and Aspen as a national scenic highway. Seconded by Councilman Whitaker.
Comments were made that it would not be realistic to tunnel an Interstate Highway down
to 2 lanes through the Canyon; the present 2 lanes have done the damage, another 2 lanes
will not ruin the canyon. Over Cottonwood Pass will bring more traffic into Aspen; and
Cottonwood Pass will have to be improved to matter which way the Interstate goes.
Further comment this will probably set a precendent of ecology considerations in planning
highways. .... · ' : :

City Attorney Kern reported the sale and use of model rockets is permitted under the Toy Rockets
State Statutes, model rockets do not fall under the City ordinance on fireworks.
Mr. Clymer recommended to Council, the Council pass an ordinance not allowing model
rockets to be set off in the City in the congested areas.
Councilman Comcowich moved that since the era in which we live focuses attention on
scientific enthusiam for rocketry, that the City Council give permission in accordance
with our ordinances to permit the sale and use of toy rockets as defined in the State
Statutes as an interim measure until such time as Council amends the ordinances to
properly express its wishes. Seconded by Councilman Vare. All in favor, with exception
of Councilman Whitaker voting nay. Motion carried.
Council instructed City Attorney Kern to draft an ordinance prohibiting the use of toy
rockets in the commercial zones of the City.
Sidewalk Saturday , Mr. Steve Herron of KSNO was present and request permission of Council Sidewalk
to hold a sidewalk Saturday on the 14~h of August. Chalk will be used by children and Saturday
adults to draw pictures on the sidewalk between Carl's Pharmacy and The Wooden Nickel.
Mr. Herron reported he had contacted all the business owners and there is no objection.
Councilman Vare moved to allow Sidewalk Saturday to take place starting at 11:00 a.m. on
August 14th. Any mess created will be Cleaned by KSNO or the adjacent property owners.
Seconded by Councilman Scott.

Councilman Comcowich moved to approve the RSA minutes, regular meeting and special meeting RSA Minutes
and ratify the bids fOr improvements. Seconded by Councilman Girffin. All in favor, motiom
carried.
Councilman Vare moved to approve the accounts payable subject to .Councilman Comcowich's Accounts
examination. Seconded by Councilman Scott. Roll call vote Councilman Vare aye; Payable
Comcowich aye; Griffin aye; Scott aye; Walls aye; Whitaker aye;,Mayor Homeyer aye. Motion
carried.
List of Judges and Clerks for the elections to be held on August 25th and September 1 was Judges & Clerks
submitted by the City Clerk. Councilman Walls moved to approve the designation of judges
and clerks for the up-coming city elections. Seconded by Councilman Griffin. Ail in favor,
motion carried.
No~se Control - Report was submitted~ by Chief Ritchey. CounCilman Whitaker moved that a Noise Control
nozse control ordinance be prepared based on deci~a~ of 80 on the A scale. Seconded by
Councilman Griffin. All in favor, motion carried.
Budget Reports - Manager Wurl reported reports for the water and electric had previously Budget
been submitted, revenue reports would be out this week, Reports
Alley Paving - Breakdown of the bids received were submitted by Manager Wurl. Manager Wurt Alley Paving
recommend the low bid of Blacktop Paving in the amount of $9,375.10.

Blacktop Paving Councilman Comcowich moved to accept the low bid of Blacktop Paving in the amount of
Alleys $9,375.10. Seconded by Councilman Griffin'. Roll call vote - Councilmen Griffin aye;

Motion carried.
Annexation Annexation Policy - Council agreed to take an agressiv, e stand on annexations and instructed
~ Policy Manager Wurl to submit at the next meeting proposed boundaries outlined on a map and an
outline.
Parking Hazardous Parking - Re.port Was submitted by the City Engineer outlining the most hazardous
off-street parking a ..
teas, the Aspen Clinic, Nugget Lodge, Aspen Laundry, Aspen Auto Parts
and Guido's.
Sidewalk Council discussed a sidewalk district this year and possible inclusion in the district of
District the sidewalk next to the Crystal Palace and along the east side of Wagner Pa~k.
It was repo~ted the street between the Nugget and Clinic is 100 feet wide. Discussed the
grate in the sidewalk area at the Aspen Laundry.. Manager Wurl to discuss removal of same
with the Aspen Laundry.
Councilman Comcowich moved that Council table consideration of the problem areas and have
the ordinance prepared at this time. Seconded by Councilman Scott. Attorney Kern reported
Ordinance #14, Series of 1970 did correct the problem of this type of off-street Parking.

Mayor instructed Manager Wurl to submit estimates to Council on correcting the problem
at the Aspen Laundry, Aspen Auto Parts and Guido's. Discussed wheter corrections in
whole or in part of all violations w~ould be made, and in what order.
Election Election Commission - Attorney Kern explained to Council there is no provision in the
Commission Charter for early appointment of the other two members of the Commission. Presently the
Commission consists of the City Clerk only. There is no reason for not appointing the
other two members if Council so desires, although ~his would not be in the spiri~t of the
Charter. City Attorney submitted to Council outline of the procedures under the Colorado
Election Laws of 1965 and the Home Rule Charter for the establishment of proof of
residency where residency is in question. Mr. Kern further explained to Council, if
Council desires to establish additional procedures, this is accomplished by ordinance.
~ Council questioned what could be included in an o dlnance..Mr. Kern stated perhaps drivers

license,_ ownership of property, rent receipts, vehicle license, etc.
Councilman Walls moved to instruct City Attorney Kern to investigate and ascertain other
ways the City can implement additional procedures to further establish residency qual-
ifications. Seconded by Councilman Whitaker. All in favor, motion carried.
ORDINANCE #17, SERIES OF 1970, AN ORDINANCE AMENDING CHAPTER I OF TITLE 2 ENTITLED CITY
PLANNING COMMISSION PERTAINING TO THE NUMBER OF MEMBERS, QUALIFICATION OF MEMBERSHIP,
TERMS OF OFFICE AND POWERS AND DUTIES OF THE COMMISSION; AND HEREBY DECLARING AN EMERGENCY
TO EXIST, was read by title only, as establimhed by Council on first reading by the
City Clerk.
Councilman Comcowich moved to adppt Ordinance #17, Series of 1970, on first reading and
as an emergency ordinance not be published. Seconded by Councilman Walls.
Council agreed to set August 17th as the second reading on the ordinance.

Board Attorney Kern questioned Council's feelings on the structure of the Board of Zoning
Structure Adjustment and the Board of Examiners and Appeals. Council agreed to table this item until
the next meeting.
Attorney Kern informed Council, he has been asked to investigate right to determine
standards on bonding of contractors for the Board of Examiners and Appeals.
Vendor's Ordinance - Tabled.
l = Magic Pan Magic Pan, Liquor License - Attorney Kern informed Council final approval by Council is
Liquor not necessary. Only exception is the Building Inspector who will have to issue a
License certificate of occupancy before the building can be used.
Mayor Homeyer request all Councilmen work together for the passage of the two up coming
City elections, Rubey Park and the 1% Sales T~x. Discussed off street parking for Rub~y
Park.
Council request the City Manager and City Engineer submit to Council the specifications
now being used by the City for the patching of street cuts.
Councilman Whitaker recommend, Council concurred, that an answer be sent to Mr. Prosence
of the State Highway Department regarding his letter of August 4th.

Councilman Whitaker moved a letter be sent to Mr. Prosence of the State Highway Department
acknowledging planners coming to work for the RegionalService Authority and Regional
Planning Commission will be~coming up and will study the highway and request a copy of the
minutes of the State Highway Commission held on July 3rd, wherein funds for Highway 82
next to Aspen have been moved to the Carbondale end of Highway 82. Seconded by Councilman
Scott. Ail in favor, motion carried.
City Clerk Graves to so request a copy of the minutes.
Council agreed to hold an executive session on August llth at 5:00 p.m. to discuss
applicants for the vacancies on the Planning and Zoning Commission.
Mayor Homeyer request Council's feeling on holding a reception for the new planner. Council
man Comcowich to discuss this with the Chamber of Commerce tO see if they would sponsor
this reception.
Councilman Walls moved to adjourn at Y:O0 p.m.,~ seconded by Councilman Whitaker. Ail in
favor, motion carried and meeting adjourne&.

Corrections to City Council Minutes of Au~st 10th
Councilman Whitaker moved that a letter be sent to Mr. Prosence acknowledg~g his letter
of Au~st 4th and informing Mr. Prosence of the appointment of our regional planner who
will be contacting Mr. Prosence relative to the Highway, the formation of a regional
planning commission and request a copy of the State Highway M~utes of July 3rd wherein
funds for four lanlng of A~en-West Project were transferred to the Carbondale end of
Highway 82, Seconded by Councilman Scott. Ail i~ favor, motion carried.
