SUMMARY:
Miami Fitness Connection, represented by Sue lien Sastoque, has requested a temporary use to
operate a children's Day Camp in the City of Aspen's Tot Lot located on Buena Vista Drive.

REVIEW PROCEDURE:
A temporary use may be granted by the City Council for a period of up to 180 days. An
insubstantial temporary use may be authorized by the Community Development Director.
An insubstantial temporary use is defined as a temporary use that meets the criteria set forth
in Section 26.450.030, is limited to a period of time not to exceed seven (7) days, the impact
upon the immediate vicinity is determined to be minimal, and in the opinion of the
Community Development Director does not require the review and approval of the City
Council.
STAFF COMMENTS:
Miami Fitness has received a Parks Permit for the use of the Tot Lot located at Alta Vista
Drive and Bonita Drive for a period from July 10 through July 28. The applicant paid a total
of $900 for the use of the park for these dates, and has requested the Community
Development Department waive the fees associated with this request. The Community
Development Department may grant a Temporary Use for seven days with a potential seven
day extension.
RECOMMENDATION:
Staff finds that this application meets the applicable review standards for granting a temporary
use and recommends that the Community Development Director approve this request, with
conditions.

EXHIBIT A: REVIEW CRITERIA & STAFF FINDINGS
The Community Development Director may grant a Temporary Use permit when the use
is for less than seven (7) days, and after considering the following criteria:
A. The location, size, design, operating characteristics, and visual impacts of the
proposed use.
B. The compatibility of the proposed temporary use with the character, density and
use of structures and uses in the immediate vicinity.
C. The impacts of the proposed temporary use on pedestrian and vehicular trafflc
and traffic patterns, municipal services, noise levels, and neighborhood
character.
D. The duration of the proposed temporary use and whether a temporary use has
previously been approved for the structure, parcel, property or location as
proposed in the application.
E. The purposes and intent of the zone district in which the temporary use is
proposed.
F. The relation of the temporary use to conditions and character changes which
may have occurred in the area and zone district in which the use is proposed.
G. How the proposed temporary use will enhance or diminish the general public
health, safety or welfare.
The following are Staffs findings in regards to the variances being requested by the
Applicant.
Criteria Considered
The location, size, design, operating characteristics, and visual impacts of the proposed
use.
Staff Finding:
The applicant has requested use of the City of Aspen's Tot Lot Park on Buena Vista
Drive. The temporary use will allow twenty (20) children to attend a day camp between
8:00 am and 4:00 pm July 10,2006 through July 28, 2006. The applicant has received a
permit from the parks department for the applicant to use the park for the day camp.
Staff finds the parks department permit process considered these criteria and finds the
temporary use will not result in excessive location, size, operating characteristics, or
design impacts. Staff finds this criterion to be met.
Criteria Considered
The compatibility of the proposed temporary use with the character, density and use of
structures and uses in the immediate vicinity.

Staff Finding:
The Tot Lot Park includes picnic tables, basketball courts, and playground area. The
camp will only operate on the grounds of the park, and will be used for activities that are
traditional for parks. Staff finds the use will not have significant impacts on surrounding
areas. Staff finds this criterion to be met.
Criteria Considered
The impacts of the proposed temporary use on pedestrian and vehicular traffic add traffic
pat/ems, municipal services, noise levels, and neighborhood character.
Staff Finding:
Staff finds the park will be able to accommodate the increased traffic and parking from
the use. Staff finds this criterion to be met.
Criteria Considered
The duration of the proposed temporary use and whether a temporary use has previously
been approved for the structure, parcel, property or location as proposed in the
application.
Staff Finding:
The proposed temporary use is for a four week duration. The Community Development
Director can only approve temporary uses for a period of seven (7) days, with the
possibility of an extension for seven days. The Parks Department has approved a Parks
Use Permit for the entire period. Staff finds the Community Development Department
can only grant an administrative Temporary Use permit for a period of seven days, with a
seven day extension.
Criteria Considered
The purposes and intent of the zone district in which the temporary use is proposed.
Staff Finding:
The Day Camp will be using the Park facilities in a manner consistent with the intended
use of the Tot Lot Park. Staff finds this criterion to be met.
Criteria Considered
The relation of the temporary use to conditions and character changes which may have
occurred in the area and zone district in which the use is proposed.
Staff Finding:
The Day Camp will be using the Park facilities in a manner consistent with the character
of the park and the immediate area. Staff finds this criterion to be met.

- July 28, 2006, Monday through Friday only. On one Tuesday, however, according to Susan Amelia, they were
transferred to Paepcke Park, due to some entity (not Parks employees) apparently spraying at or near the Park.

2. APPLICANT understands and agrees that Cily of Aspen Ordinance No. 57 (Series of 2000)
estalllishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent
to adetennination of application completeness.
3. APPLICANT and CITY agree that because oflhe size, nature or scope of the proposed project, it
is not possible at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the inlerest of the parties that APPLICANT make payment of an
initial deposit and to thereafter pennit additional costs to be billed to APPLICANT on a monthly basis.
APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he
will be benefiled by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainly
of recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning
Commission and/or Cily Council to make legally required findings for project consideration, unless current hillings
are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full Cees prior t a ination of application completeness. APPLICANT shall pay an initial deposit in the
amount ofs which is for hours of Community Development staff time, and if actual
recorded costs ceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, including post approval review at a rate of $220.00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and
in no case will building permits be issued until all costs associated with case prooessing have been paid.
