Wagner Park Bathrooms 7:15 ADJOURN 0 MEMORANDUM TO: HISTORIC PRESERVATION COMMISSION FROM: DAVID HOEFER, ASSISTANT CITY ATTORNEY DATE: DECEMBER 10, 2000 RE: ALLEGED VIOLATIONS OF DEVELOPMENT APPROVALS -BY RON SCHELLING (OWNER-CONTRACTOR), d/b/a SCHELLING DEVELOPMENT CORPORATION, AT 213 WEST BLEEKER STREET, ASPEN, COLORADO FACTS: On April 26,2000, the Aspen Historic Preservation Commission approved by resolution "An Application for Final Development Review for 213 W. Bleeker Street, Lot G, Block 51, City and Township ofAspen, Colorado." The project, owned by Schelling Development Corporation and represented by Palomino Barth Architects, involved a landmark house and shed located in the west end. The HPC approved demolition of a recent addition to the house, approved restoration of the house to its historic appearance, and approved the construction of an addition between the two buildings. On the positive side, the height of the addition was minimized so that it would not be visible from the front ofthe house, andthe project was to be 400 square feet below the maximum allowable FAR. The application was approved by a 4-1 vote with twenty-one (21) conditions. The first condition noted that on March 22,2000, HPC had approved landmark designation, partial demolition, temporary relocation, variances, and residential design standards. Condition 13 required a demolition plan, as part of the building permit plan set- indicating exactly what areas of the historic house and shed were to be removed as part of the renovation. Condition 14 required a preservation plan, as part of the building permit plan set indicating how any original materials which were to be retained would be restored. "The requirement is to retain/repair all original materials and replicate only those that are to be determined by HPC staff and monitor to be beyond salvage." Condition 20 required the General Contractor and/or Superintendent to obtain a specialty license in historic preservation prior to receiving a building permit. This was done by the owner/contractor Ron Schelling. Both Resolution No. 18, Series of2000 (from April 26% and Resolution No. 11, Series of2000 (from March 22nd~ are attached hereto as Exhibits A and B. The building permit plan set (attached hereto as Exhibit C), as required, reflected the twenty-one conditions (see page Al.OA), a preservation plan (also on page Al.OA), and a section entitled "demolition scope of work," (see page A2.OC). The preservation plan provides as follows: 1. The demolition and construction ofthis project is a historic renovation and is subject to all the historic preservation commission (HPC) conditions of approval identified on the information sheet and all requirements identified herein. 2. No deviations fromthese drawings shallbe allowedwithoutfirstbeing reviewedand approved by HPC staff and monitor. 3. All the existing exterior materials including but not limited to roofing shingles, roll roofing, exposed copper jlashing, copper roof trim, brick fascia and eve trim, soffit material, siding materials, corner boards, windows, exterior window trim, siding trim, siding water table, and all other miscellaneous exterior trim are considered historic and shall not be removed from the building except where identified on the drawings to be removed, salvaged, refurbished and reinstalled in their original locations. 4. Should any materials have to be removedfrom the building in order to avoid damage to them during moving of the building, they shall be removed, salvaged, refurbished and reinstalled on the building in their original location and only upon being reviewed and approved by the HPC staff and monitor. 5. Removal and replacement of any and all materials due to natural deterioration beyond repair shall also be subject to review and approval by the HPC sta#and monitor. 6. Restoration ofthefront gable oftheold houseshallbe based on physical evidence to the extent possible. The proposed construction work identified in the drawings shall serve as a guide only and actual reconstruction shall be based on field examination of the existing framing ofany window openings. No modification or new construction of the existing framing shall proceed until it is reviewed and approved by the HPC staff and monitor. On August 23,2000, the owner/contractor Ron Schelling and his architect Jack Palomino met with HPC Officer Amy Guthrie to review existing conditions uncovered during demolition. They were requesting modifications to the permitted set of drawings. 2 0 The monitor for the project was unable to attend that meeting. Therefore, Amy Guthrie felt that (1) without the monitor and (2) because of the significance of the proposed modifications that she could not approve the changes. She gave directions to the two men to list the requests in a letter that would then be taken to the HPC for review. Before Jack Palomino prepared the letter (see the attached letter of October 11, 2000, which is attached as Exhibit D) and without HPC review or approval, Ron Schelling went forward with the modifications. Roofing, siding, framing and perhaps other elements of the historic house were removed and destroyed without HPC, staff, or monitor approval. Because of the alleged violations of the building plans, the property was red-tagged on or about October 20th. Completion of the foundation has been permitted as a limited exception to the red-tag because of safety considerations. PROCEDURE: Consequently, this matter is now before the Historic Preservation Commission to determine ifthere has been a violation ofthe HPC approvals and, if so, for a recommendation to City Council concerning an appropriate penalty. In addition, pursuant to a separate procedure, the chief building official is conducting an Order to Show Cause hearing which could result in the revocation or suspension of Mr. Schelling's contractor license. 0 For this proceeding, the HPC will have a separate attorney, Tim Whitsett who has been hired to represent and advise the Commission in this matter. Assistant City Attorney David Hoefer will represent the City while attorney Doug Allen will represent Ron Schelling, d/Wa Schelling Development Corporation. Mr. Hoefer and Mr. Allen have agreed to certain "stipulated facts," (see Exhibit E) which will be offered into the record. Four or more witnesses may be called to testify. The witnesses may include: Historic Preservation Officer Amy Guthrie City Planner Fred Jarman Contractor Ron Schelling Architect Jack Palomino Procedurally, Mr. Hoefer will be permitted to ask each witness questions, followed by Mr. Allen, and then followed by questions from Mr. Whitsett and/or commission members. Each attorney and commission member may then ask follow-up questions. At the conclusion of the hearing, you will be required to make findings as to if there has been a violation of the HPC approvals and, if appropriate, recommend a penalty to 0 City Council. Council will make a final determination as to any penalty. 3 0 Concerning a possible penalty, HPC may do the following: 1. Pursuant to Section 26.415.010 of the Aspen Land Use Code, the "Historic Preservation Commission, following notice and hearing, shall (may) prohibit the owner, successor, or assigns from obtaining a building permit for the affected property for a period of five (5) years from the date of such violation. The City shall initiate proceedings to place a deed restriction on the property to this effect to insure the enforcement ofthis penalty." Please note that it is the attorney's opinion that this may be from 0- 5 years. 2. Or in the alternative, you could recommend to Council that a resolution similar in nature (all though not necessarily similar in numbers and conclusions) to a prior case before this Commission be reached. In that case, the following steps were taken: a. The owner was required to submit a remediation plan to the HPC for their review and approval. b. The remedial work was required to be supervised and performed by sub- contractors (or in that case by the owner's architect). c. A weekly plan of action and a progress report were required to be submitted to the Historic Preservation Officer with the City. 0 d. A fine in the amount of $15,000. e. A letter of credit (in the amount of $30,000) sufficient to cover the completion of the historic work. £ The owner was required to write a letter of apology to the community to be submitted to both local newspapers. g. BLEEKER STREET, LOT G, BLOCK 51, CITY AND TOWNSITE OF ASPEN, COLORADO Parcel Identification No. 2735-124-40-005 RESOLUTION NO. 18, SERIES OF 2000 WHEREAS, the applicant, Schelling Development Corp., represented by Palomino Barth Architects has requested final approval for the property at 213 W. Bleeker Street, Lot G, Block 51, City and Townsite of Aspen. The project involves restoring the existing historic structures and creating an addition between the house and outbuilding; and WHEREAS, all development in an "h," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.415.010.C.5 of the Aspen Land Use Code in order for HPC ro grant approval, namely: 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H.- Historic Overlay District or is adjacent to an Historic Landmark. For Historic Landmarks where proposed development would extend into front yari side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot or exceed the allowed floor area by up to five hundred (500) square feet or the allowed site coverage by up to five (5) percent, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. In no event shall variations pursuant to this section exceed those variations allowed under the Cottage Infill Program for detached accessory dwelling units pursuant to Section 26.40.090(B)(2). 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof; and EX"19*VE 11111111111111111111111111 lilli 11111111 111 lilli lili lili 443358 05/16/2000 09:41A RESOLUTI DAVIS SILVI 2 .f 4 R 20.00 0 0.00 N 0.00 PITKIN COUNTY CO 0 WHEREAS, Amy Guthrie, in her staff report dated April 26, 2000, performed an analysis of the application based on the standards, found favorably for the application, and recommended approval with conditions; and WHEREAS, at their regular meeting on April 26, 2000, the Historic Preservation Commission considered the application, found the application to meet the standards, and approved the application with conditions by a vote of 4 to 1. THEREFORE, BE IT RESOLVED: That the review standards are met and HPC grants final approval for 213 W. Bleeker Street, Lot G, Block 51, City and Townsite of Aspen, as presented at the April 26.2000 meeting, as follows: 1. On March 22, 2000, HPC approved landmark designation, partial demolition, temporary relocation, variances, and "Residential Design Standards" and granted the following variances: a 2 foot west sideyard setback variance for the new construction (the old house will maintain an existing non-conformity), a combined sideyard setback variance of 7 feet for the garage and sheet a rear yard setback variance of 10 feet for the shed, a rear yard setback variance of 7 feet for the new addition. a combined front and rear yard setback variance of 15.3 feet for the existing shed, a combined front and rear yard setback variance of 11.7 feet for the new addition. and 0 waiver of one of the required parking spaces. 2. Restoration on the front gable of the old house will have to be based on physical evidence to the extent possible. Framing should be examined to determine the size and location of the original bay window opening. 3. Consider adding a transom window over the front door and discuss whether a turned post and simple porch brackets are appropriate. 4. Clarify whether any original materials remain on the exterior of the historic house. If so, the materials must be retained and restored. 5. Any windows on the old house shall be painted wood rather than clad. 6. Clarification is needed during construcion as to the proposed material for the foundation on the old house. The new finished floor level for the historic house shall be not more than 12" above natural grade. 7. Clarify the material for the new front walk. Concrete, a loose flagstone path, or brick would be most typical of this type of house. 8. Eliminate the proposal to plant aspen trees in front of the old house and reduce the number of shrubs in the same area. Staff and monitors will review and approve a scaled back landscape plan prior to installation. 9. Provide a structural report demonstrating that the historic buildings can be moved and/or information about how the house will be stabilized from the housemover. 10. Provide a bond or letter of credit in the amount of $30,000 to insure the safe 0 relocation of the structures. 11. Provide a relocation plan detailing *how and where the buildings will be stored. Information on all venting locations and meter locations not described in the approved drawings shall be provided for review and approval by staff and monitor when the information is available, prior to their installation. The intention is that these elements be placed in a location that is sympathetic to the historic resources on the site. 13. Submit a demolition plan, as part of the building permit plan set, indicating exactly what areas of the historic house and shed are to be removed as part of the renovation. 14. Submit a preservation plan, as part of the building permit plan set, indicating how any original materials, which are to be retained, will be restored. The requirement is to retainirepair all original materials and replicate only those that are determined by HPC staff and monitor to be beyond salvage. 15. No elements are to be added to the historic house or shed that did not previously eXist. No existing exterior materials other than what has been specifically approved herein may be removed without the approval of staff and monitor. 16. HPC staff and monitor must approve the type and location of all exterior lighting fixtures. 17. There shall be no deviations from the exterior elevations as approved without first being reviewed and approved by HPC staff and monitor. 18. The preservation plan described above. as well as the conditions of approval will be required to be printed on the cover sheet of the building permit plan set and all other prints made for the purpose of construction. 19. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part of the building permit application indicating that all conditions of approval are known and understood and must meet with the Historic Preservation Officer prior to applying for the building permit. 20. The General Contractor and/or Superintendent shall be required IO obtain a specialty license in historic preservation prior to receiving a building pennit. 21. All representations made by the applicant in the application and during public meetings with the Historic Preservation commission shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. C. Designer. The structure is a significant work of an architect or designer whose individual work has influenced the character of Aspen. D. Neighborhood Character. The structure or site is a significant component of an historically significant neighborhood and the preservation of the structure or site is important for the maintenance ofthat neighborhood character. E. CommuniO; Character. Standard: The structure has been demonstrated to be capable of withstanding the physical impacts of the relocation and re-siting. A structural report shall be submitted by a licensed engineer demonstrating the soundness of the structure proposed for relocation. 2. Standard: A relocation plan shall be submitted, including posting a bond or other financial security approved by HPC with the engineering department, to insure the safe relocation, preservation, and repair (if required) of the structure, site preparation and infrastructure connections. The receiving site shall be prepared in advance of the physical relocation. WHEREAS, Amy Guthrie. in her staff report dated March 22, 2000, performed an analysis of the application based on the standards, found favorably for the application, 0 and recommended approval with conditions; and WHEREAS, at their regular meeting on March 22, 2000, the Historic Preservation Commission considered the application. found the application to meet the standards, and approved the application with conditions by a vote of 7 to 0. THEREFORE, BE IT RESOLVED: That the review standards are met and HPC recommends landmark designation and grants conceptual design approval, partial demolition, temporary relocation, variances, and "Residential Design Standards" approval for 213 W. Bleeker Street, Lot G, Block 51, City and Townsite of Aspen, as presented at the March 22,2000 meeting, as follows: l. HPC hereby grants the following variances: a 2 foot west sideyard setback variance for the new construction (the old house will maintain an existing non-conformity), a combined sideyard setback variance of 7 feet for the garage and shed, a rear yard setback variance of 10 feet for the shed. a rear yard setback variance of 7 feet for the new addition, a combined front and rear yard setback variance of 15.3 feet for the existing shed, a combined front and rear yard setback variance of 11.7 feet for the new addition, and waiver ofone ofthe required parking spaces. 2. Any restoration efforts on the old house will have to be based on physical evidence to the extent possible. Framing should be examined to determine the size and location of the original bay window opening on the front gable end. Typically there is only one window under the porch, instead of a pair as shown, and this should be investigated. (These decisions will likely have to wait for the construction phase to be fully resolved) 3. A cut sheet showing the profile of the windows that will be used in the restoration will be required for final, with the goal of choosing a window which reflects a historic double hung wood window. 4. The new front door, porch posts, trim and other detailing for the historic house will have to be addressed at final and W' scale plans will be required. 5. Study the materials for the new addition so that it does not overpower the old house or conflict with the historic shed. 6. Study the number of different window styles on the new addition and consider simplifying the design. 7. A landscape plan will be required for final. The applicant must verify that the project does not require removal of any trees or excavation within the dripline of any trees without Parks Department approval. 8. The applicant must discuss how the house will be stored during excavation at final review. 9. Provide a drawing showing the back (south side) of the old house and the new kitchen windows. Re: Schelling Residence Addition and Alterations 213 West Bleeker Street Aspen, CO 81611 Architect's Job No. 2K-101 Subject Request for HI'C Modifications Fred, On August 23rd, 2000, Ron Schelling and I met with HPC Officer, Amy Guthrie, to review existing conditions uncavered during demolition. These conditions are different from our original assumptions made to complete the permitted set of drawings for the above-mentioned project. We are hereby requesting that HPC consider these requests for modifications to the originally permitted set of drawings in the best interest of preserving the original building and providing a reasonably comfortable dwelling. These existing conditions and request for modifications are as follows: 1. Roofing The existing wood shake roofing on the residence is brittle due to years of inadequate maintenance and should be replaced with new wood shake roofing to match the existing. Amy agrees that this is acceptable as long as the existing metal ridge trim and"ball" ends are salvaged, refurbished and replaced in their original locations. We are hereby requesting that HPC Commission confirm Amy's instruction. 2. Siding During demolition we have discovered that the only area of wood siding origin•1 to the residence is approximately three feet wide by eight feet high. and is located at the Southeast corner of the principal North/South gable This siding was discovered under an existing wall that was permitted for demolition by HPC. The siding in this area of original materials is badly damaged due to initial construction of the now demolished wall. The balance of the siding for the residence has been installed over a plastic vapor barrier nailed directly to the wall studs and appears to be non-original to the dwelling. Fire Damage During demolition we have discovered that the structure of lean-to portion of the 0 residence containing the Kitchen is heavily damaged due to a past fire. Shed Floor Elevation During demolition we have discovered that the finish floor elevation of the existing shed is approximately fourteen inches below the level of the adjacent alley.
