Meeting was called to order by Mayor Eve Homeyer at 5:05 p.m. with Councilmen Edwin Vare,
Ross Griffin, Eitzhugh Scott III, Jack Walls, Francis Whitaker, City Attorney Albert Kern,
City Manager Leon Wurl and Finance Director Dennis Veeder.
Business Business License - Ordinance #25, Series of 1970 was submitted to Council by Attorney
License Kern for review. Attorney Kern reported the ordinance on first reading would have to be
introduced at a regular meeting.
Discussed one time sales and those organizations which are tax exempt. Council request
Albert Kern, Attorney rewrite the ordinance to exclude non-profit organizations and one
time sales.
Noon Whistle Noon Whistle - Manager Wurl request this item be tabled until the next regular meeting
when Council can meet with a representative of the Fire Department. Council concurred.
Council Priorities - Tabled until the next regular meeting.
Opera House Leases - Manager Wurl explained the Chamber has not subleased to the Aspen
Association but have permitted them to use the area in which the addressograph machine
was placed and also utilitze area in the storage room. Mr. Odier of the Chamber reported

to Mr. Wurl, the Chamber permitted the Association to use the space since the two Opera House
organizations work is interrelated. Mr. Wurl reported the Association says it is a non- Lease
profit organization. Their'functions are designed to offer the skier, a package plan.
Councilman Scott moved to authorize Francis Whitaker~to explain to the Chamber Directors
the City's general feelings about our lease with the Chamber and proposed change of~the
Chamber's lease for subleasing. Seconded by Councilman Vare. Ail in~ favor, motion
carried.
Council agreed they did not feel the Aspen Association falls under the City's policy of
leasing space to community oriented organizations.
Transportation Report - Planning and Zoning Commission and Transportation Committee will Transportation
be meeting on Friday, December llth. Report
City Market Trash Problem - Manager Wurl explained on December 4th Mr.~Kinkade set a City Market
deadline of December 15th for City Market to get rid of the temporary enclosure for Trash Problem
trash and installation of a permanent enclosure.bMr. Whitaker suggest the temporary
enclosure be dog proofed.
Open Space - Attorney Kern.gave abrief report on. the meeting on negoiations with Tipco. Open Space
Tipco was presented with the City's appraisal of the property. Total property less sub-
divided acerage approximately $3,500,000. Tipco offered to lease the property at $250,000
per year for a period of~10 years with option to purchase at $5,000,000.00. Alternatives. ~
were discussed.
Manager Wurl reported Lot 38 of the appraisal should be excluded is not owned by Tipco.
Water rights were not appraised. Tipco stated negoiations will have to be consumated this
year to satisfy their accountants and tax deduction.
Herb Bartel reported he had indicated to the Nature Conservancy that he would keep them
informed. Questioned them as to specific comments of their involvements on the negoiations.
they could not give an answer until they had checked with their attorney.
Councilman Walls moved to go into executive session at 6:00 p.m., seconded by Councilman
Griffin. Ail in favor, motion carried.
Councilman Walls moved to resume into regular session and to adjourn. Seconded by
Councilman Griffin. Ail in favor, meeting adjourned at 7:25 p.m.
