STATEMENT OF EXEMPTION
FROM THE DEFINITION OF SUBDIVISION

WHEREAS, EDWARD W. MORSE III is the owner of a parcel of
land located in the City of Aspen, Pitkin County, Colorado,
more particularly described as:
A tract of land located within the NWtSWt in
Section 7, ~ownship 10 South, Range 84 West of
the 6th Principal Meridian, Pitkin County,
Colorado, being the southeasterly corner of the
property granted to Edward W. Morse III in the
deed which is recorded in Book 293 at Page 873,
Pitkin County Clerk and Recorder's Office. The
property is more fully described as follows:
ileginning at a point, said point being S49038' 48"E
1342.23 feet from the west t corner of Section 7,
Township 10 South, Range 84 West of the 6th
Principal Meridian; tience S05041E 29.66 feet;
thence S84019'W 14.44 feet; t~ence N20016'E
32.99 feet to the point of beginning.
WHEREAS, the applicant has requested an exemption from the
definition of subdivision for the purpose of deeding this property
as described to the City of Aspen; and
WHEREAS, the Aspen Planning and Zoning Commission at its
meeting held November 7, 1978, determined that an exemption
from the definition of subdivision is appropriate and recommended
that the same be granted; and
WHEREAS, the City Council determined that the subdivision
resulted in a boundary line transfer and the property above-
described merged with the City of Aspen's Mill Street right-
of-way as such was not within the intent and the purpose of
the subdivision ordinance set forth in Chapter 20 of the
Aspen Municipal Code.
THEREFORE, the City Council of Aspen, Colorado, does
hereby determine that the proposed subdivision resulting from
applicant's transfer of the above-described property to the
City of Aspen is not within the intent and purpose of the
subdivision ordinance and does, for such reason, grant an
exemption from the definition of such action.
