FROM THE DEFINITION OF SUBDIVISION
WHEREAS, DALE and BEVERLY MARS are the owners of a parcel of land
located in Pitkin County, Colorado, more particularly described as:
Hallam Addition, South 35' of the North 79' of Lots
16, 17, 18, 19 and 20, Block 99.
WHEREAS, the applicants have an existing duplex located on Hallam
Addition, South 35' of the North 79' of Lo-t-s-16, 17, 18, 19 and 20, Block
99, and
WHEREAS, applicants have requested an exemption from the definition
of subdivision for the purpose of subdividing the existing duplex through
condominiumization, and
WHEREAS, the Aspen Planning and Zoning Commission, at its meeting
held December 14, 1976, determined that an exemption from the definition
of subdivision is appropriate and recommended that the same be granted, and
WHEREAS, the City Council determined that the subdivision of
the existing duplex through condominiumization is not within the intent
and purpose of the subdivision ordinance set forth in Chapter 20 of the
Aspen Municipal Code,
THEREFORE, the City Council of Aspen, Colorado does hereby
determine that the proposed subdivision of the duplex located on Hallam
Addition, South 35' of the North 79' of Lots 16, 17, 18, 19 and 20,
Block 99 by it; condominiumization is not within the intents and purpose
of the subdivision ordinance and does, for such reason grant an exemption
from the definition of such action,
PROVIDED, HOWEVER, that the foregoing exemption shall not be
deemed to relieve or exempt the subdividing of the duplex situated on
Hallam Addition, South 35' of the North 79' of Lots 16, 17, 18, 19 and
20, Block 99 from any park dedication fees which may be due, and

upon the restriction of rental of said condominium units to periods of

APPLICATION FOR EXEMPTION
FROM SUBDIVISION REGULATIONS
Request is hereby made on behalf of 'IR. DALE MARS and
BEVERLY MARS (hereinafter referred to as applicants) under Section
20-19(a) of the Aspen, Colorado, Subdivision Regulations, for an exemption
from the definition of the term "Subdivision" with respect to the real
property described as:
Hallam Addition
South 35' of the North 79' of
Lots 16, 17, 18, 19 and 20, Block 99
It is submitted that an exemption in the case would be appropriate.
The application involves subdivision of an existing duplex. A
subdivision of one lot with a duplex on it creates conditions whereby
strict compliance with subdivision regulations would deprive the
applicants of the reasonable use of their land. If an exemption is granted,
the owners of the property will have a cori mn interest in the land and
there will be a condominium declaration and maintenance agreement
applicable to the property rich will not in any way increase the land
use impact of the property. An exemption in this case will not conflict
with the intent and purpose of the subdivision regulations which are
directed to assist the orderly, efficient, and integrated development
of the City of Aspen, to insure the proper distribution of population,
to coordinate the need for public services, and to encourage well planned
subdivision.
The granting of this application will not undermine the intent
of the subdivision regulations as it is clearly within the area intended
for exemption under 20-19. The building is already in existence, and
there will be no change in density which is presently in line with the
desired population density for the property.
The applicants would appreciate your consideration of this
application at your next regular meeting.

DATE: December 9, 1976
This is a request for subdivision exemption by Dale and Beverly Mars to
condominiumize an existing duplex located in Hallam Addition, South 35'
of the north 79' of Lots 16, 17, 18, 19 and 20, Block 99. The applicants
are willing to restrict use of the units to minimum six month leases
with two short term rentals allowed per year. The City Engineer has no
comments.
The Planning Office recommends approval of the subdivision exemption
provided the six month leasing restrictions are applied to the units.

Meister duplex substantiates the value of $35,000 for parts of
Lot 16, 17, 18, 19 and 20, Block 99, Hallam Addition to the City
of Aspen. This value is acceptable to me.

Re: An "Opinion of Value" for the Kaufman -Meister Duplex,
Park Dedication Fee, Parts of Lot 16, 171, 18, 19 and 20
Block 99, Hallam Addition to the City of Aspen.
Dear Mick;
Pursuant to the request of Mr, Gideon Kaufman, I have
personally examined the subject property, have gathered and
analyzed applicable market data for the purposes of estimating
Fair Market Value of the subject site if vacant.
The subject site contains approximately 4,375 square feet and
is presently improved with a two story duplex residence and
limited site improvements. The site is presently zoned R-6,
Residential which allows for the development of a single family
residence on 6,000 square feet and the development of a duplex
on 9,000 square feet.
However, the subject was improved prior to this zoning classification
and therefore is considered a substandard lot and the existing
duplex may remain.
In this analysis the land is valued as if free and clear of the
existing duplex and available for development of a duplex.
Your appraiser has gathered and analyzed the most recent sales of
duplex properties and on a preliminary basis, adjusted these sales
for their location, views, size, and topography.
The following sales are the most recent vacant duplex tracts which
have taken place in the Aspen area:
Sale #1, Lot 4, Snowbunny Subdivision sold in January 1977 for
$52,000. It contained approximately 15,000 square feet with
level Lerrair. and excellent views of the surrounding mountains.
Sale #2, Lots M, N, and 0 of Block 8, Aspen, sold in December
1976 for $75,000. This site is level, south facing with
excellent views of Aspen Mountain ski area. It contained
9,000 square feet. It was located in a very desirable area.
This sale can be developed with a duplex structure.
MasonryMORse Sale #3, Lot 10 Filing 1 West Aspen Subdivision sold in August
INCORPORATED 1976 for $42,500. This sale contained approximately 16,000
square feet, was located on the golf course, level and had
WinOFR(O excellent views of the surrounding ski areas.

After analyzing these most recent sales on a preliminary basis
and considering the subject's crowded location, substandard size
and minimum setbacks, your appraiser selects near the lower range
of value as applicable for dedication purposes.
It is my opinion that the Fair Market Value of the subject site
if vacant as of February 11, 1977 would be:
Thirty Five Thousand Dollars
$35,000
This opinion is offered in letter form at the request of the client,
however, I have sufficient data contained in my files to prepare
a formal appraisal report if necessary at a future date.
I hereby certify that I have no present or future contemplated
interest in the subject property and that my fee is in no way
contingent upon the valuations set out herein.
