ALBON February 28, 1979 TBLBPHON'B (BOO) 921S~J986 Planning and Zoning Commission City Hall 130 South Galena Street Aspen, Colorado 81611 Dear Members: This is an application by M and B Company, a Partnership, pursuant to Section 20-19 of the Aspen City Code, as amended, for an exemption from the definition of the term "subdivision" for the condominiumization of the victorian Square Building located on the corner of Hunter and Hyman in the City of Aspen. The principals in the M and B Company are Stephen Marcus, Ronald Garfield, and Andrew Hecht. As is described in more detail on the Condomin- ium Map which is submitted as part of this application, the applicant desires to divide the building into seven (7) condominium units. Presently Unit 1 on the first floor and Units 2, 3, and 4, which comprise the entire second floor of the building, are occupied by the law offices of Garfield and Hecht. Unit 5 is occupied by the Arctic Circle, Unit 6 is occupied by Transwestern Realty Company and Unit 7 is occupied by Pocket Toys. The applicant contemplates no change in the occupation of any of the units as a result of this condominiumization. The applicant submits that since this is merely the subdivision of an existing building, and since no changes are required as a result of that subdivision, to require that the applicant proceed through the entire subdivision procedure would deprive the applicant of the reasonable use of his property. Furthermore, the applicant submits that the exemp- tion is necessary for the preservation and enjoyment of a substantial property right. Finally, the applicant submits that since, as stated above, this is merely the sUbdividing of an existing structure, there will be no increase in density as the result of the granting of this exemption, and therefore, ,...~._--_.,..,. ....""'" ....., Planning and Zoning Commission February 28, 1978 Page Two the granting of the exemption will not be detrimental to the public welfare or injurious to other property in the area. The applicant thanks you for your consideration in this matter and respectfully requests your approval of the application. Sincerely, ~~.
