STATEMENT OF EXEMPTION
FROM THE DEFINITION OF SUBDIVISION
WHEREAS, M & B COMPANY, a partnership, is the owner
of a parcel of land located in Pitkin County, Colorado, more
particularly described as:
North half of Lots A, B and C,
Block 100, City and Townsite
of Aspen, Pitkin County, Colorado
WHEREAS, there exists on said property a structure in
which the applicant wishes to create separate interests without
parceling the land on which said structure is situate; and
WHEREAS, there has been made an application for
exemption from the definition of subdivision for such conveyance
of interests pursuant to Section 20-19 of Chapter 20 of the
Aspen Municipal Code; and
WHEREAS, the Aspen Planning and Zoning Commission, at
its meeting held April 10, 1979, has determined that such
exemption is appropriate; and
WHEREAS, the City Council has found the proposed
division of interest in the existing structure to be without
the intents and purposes of subdivision regulation.
THEREFORE, the City Council of the City of Aspen does
hereby determine that the proposed division of interest in the
structure situate on the above -described land is without the
intents and purposes of subdivision regulation, and does, for
such reason, grant an exemption from the definition of
subdivision for such action.

RE: Victoria Square Condominiumization - Subdivision Exemption
DATE: April 19, 1979
The attached letter of application requests subdivision exemption for the
condominiumization of the Victoria Square office building located on the corner
of Hunter and Hyman Streets. The applicants seek to divide the building into
seven condominium units. "Presently unit one on the first floor and units two,
three and four, which comprise the entire second floor of the building, are
occupied by the law offices of Garfield and Hecht. Unit five is occupied by
the Artic Circle, unit six is occupied by Transwestern Realty Company and unit
seven is occupied by Pocket Toys." This subdivision will result in no increase
in density and there are no residential units involved.
The application was referred to the City Engineering Department. Dan
McArthur, Assistant City Engineer, comments, "After reviewing the improvement
survey for the above mentioned project and having made a site inspection, the
Engineering Department recommends that the exemption be granted approval."
Ron Stock has reviewed the application and has recommended your approval
without condition. The Aspen Planning and Zoning Commission reviewed the
application at a special meeting held April 10, 1979, at which time they
recommended approval without condition.

Dear Members:
This is an application by M and B Company, a
Partnership, pursuant to Section 20-19 of the Aspen City
Code, as amended, for an exemption from the definition of
the term "subdivision" for the condominiumization of the
Victorian Square Building located on the corner of Hunter
and Hyman in the City of Aspen. The principals in the
M and B Company are Stephen Marcus, Ronald Garfield,
and Andrew Hecht.
As is described in more detail on the Condomin-
ium Map which is submitted as part of this application, the
applicant desires to divide the building into seven (7)
condominium units. Presently Unit 1 on the first floor and
Units 2, 3, and 4, which comprise the entire second floor
of the building, are occupied by the law offices of Garfield
and Hecht. Unit 5 is occupied by the Arctic Circle, Unit 6
is occupied by Transwestern Realty Company and Unit 7 is
occupied by Pocket Toys. The applicant contemplates no
change in the occupation of any of the units as a result of
this condominiumization.
The applicant submits that since this is merely the
subdivision of an existing building, and since no changes are
required as a result of that subdivision, to require that
the applicant proceed through the entire subdivision procedure
would deprive the applicant of the reasonable use of his
property. Furthermore, the applicant submits that the exemp-
tion is necessary for the preservation and enjoyment of a
substantial property right. Finally, the applicant submits
that since, as stated above, this is merely the subdividing of
an existing structure, there will be no increase in density as
the result of the granting of this exemption, and therefore,

the granting of the exemption will not be detrimental to the
public welfare or injurious to other property in the area.
The applicant thanks you for your consideration in
this matter and respectfully requests your approval of the
