HomeMy WebLinkAboutminutes.council.197111301240 Special Meeting Aspen City Council November 30 1971 Special Meeting called by entire Council to consider the liquor license transfer of the Gondolier to Gepetto's. Mayor Homeyer called the meeting to order at 5:05 p.m. with.~Councilmen Scott Nystrom, William Comcowich, Ross Griffin, Ramona Markalunas, Jack Walls and City Attorney Albert Kern. Attorney Leonard Oates representing the applicant stated this is a purchase and sale by Richard Fitzgerald and Nick Gust to T & E Restaurant Corporation. Mr. Topol, one of the stockholders, was present at the m~eting. Further informed Council. the operation will be managed this winter by Mr. Fitzgerald who has had experience with this restaurant in the past as an owner. Mr. Topol will take over the management next spring. For the winter season, menu will consist of Italian food at moderate price range. The premises will be leased with an optiQn to buy. City Attorney Kern questioned who the previous leasee was, Mr. Oates stated Mr. Lombardi and Mr. Longo. Further questioned when ,the previous leasee defaulted on their lease. Mr. Fitzgerald explained in April but gave them until about September to work things out. Also stated John ~ayes will be an employee in the restaurant. Discussed the criteria used in considering a new license and transfers of existing licenses. Council stated their concern of the needs of the neighborhood being met when this restaurant has not been opened for~about 8 months. Council furthe~ discussed with City Attorney Kern what can be done when a licensed premi~ goes defunct as relates to revocation of the license, .in order that quality can be main- tained. Council concluded that once a license has been granted to a premise based on the needs not having been met, that any transfer following the first granting would be auto- matic unless the character of the applicants does not meet the standards established by the City. City Attorney Kern informed Coun-cil that the only criteria for revocation would be a violation of a stat.e law or violation of a criminal nature of City ordinances. Councilman Griffin suggest the City review these licenses twice a year and when re- viewed in the middle of the year consider revocations and suspensions and at renewal whether they should be renewed~or not. Councilman Griffin moved that the City approve this transfer _of licenses and the renewal for 1972. Seconded by Councilman Comcowich. Roll call vote - Councilmen Nystrom aye; Comcowich aye; Griffin aye; Markalunas aye; Walls aye; Mayor Homeyer aye. Motion carried. City Attorney Kern informed Council the Police Department is just abo~t out of traffic tickets. Prior to the printing of new tickets would like an indication from Council if they desire to adopt the 1971 Model Traffic Code which has just been received. Council concurred to have Attorney Kern prepare an ordinance to adopt the new code. Councilman Griffin moved to go into executive session to discuss a pending law suit. Seconded by Councilm~n Nystrom. Ail in favor, motion carried. Councilman Griffin moved to reconvene into special session and adjourn. Seconded by Councilman Nystrom.
