Meeting was called to order by Mayor Eve Homeyer at 4:10 p.m. with Councilmen Ross Griffin,
Ramona Markalunas, Jack Walls, Francis Whitaker, City Attorney Albert Kern, Finance
Director Dennis Veeder and Student Representative, Margo Dick.
Minutes Councilman Whitaker moved to approve the minutes of February 14th and 15th as prepared
and mailed by the City Clerk. Seconded by Councilman Markalunas. Ail in favor, motion
carried.
Mayor's Deed- Mayor's Deed~ Leigh Wilson and Treva Thomas - Councilman Walls moved to authorize the
Wilson & Mayor and City Clerk to execute the deed as submitted. Seconded by Councilman Griffin.
Thomas Roll call vote - Councilmen Griffin aye; Markalunas aye; Walls aye; Whitaker aye; Mayor
Homeyer aye. Motion carried.
Swimming Pool Proposed~swimming pool rates and schedule were submitted. Councilman Griffin moved to
Rates & adopt the rates and schedule as submitted. Seconded by Councilman Markalunas. Roll call
Schedule vote - Councilmen Whitaker aye; Walls aye; Markalunas aye; Griffin aye; Mayor Homeyer
aye. Motion carried.
West Aspen West Aspen Filing #3, Lot 3 Annexation petition was submitted. City Clerk reported the
Filing, #3 annexation has been reviewed by the Planning and Zoning Commission who recommend annex-
Lot 3 Annex- ation. Charles Gilkey, City Engineer, reported this one lot was le~t out of the open
ation space annexation since the owner was unreachable. Further reported this is a vacant lot.
Councilman Griffin moved to authorize the City Attorney to prepare the resolution and
ordinance for consideration at the next meeting. Seconded by Councilman Markalunas.
Councilman Whitaker stated if this is annexed prior to development the City will lose
money on the water tap fee. Suggest an annexation fee be charged which would apply to
capital improvements.
Councilman Walls pointed out the reason for the lower tap fee in the City is to encourage
annexation. Mayor Homeyer pointed out the City would .get the building permit fee. Mr.
Gilkey stated the administration'is working on some definite evaluation figures for*'
Council as relates to annexations.

Jv~R. Williams property annexation petition was submitted and resolution calling for a
public hearing due to only 50% of the landowners applying for annexation. Landowner not
~ signing is Holy Cross Association. City Attorney Kern stated by law when only 50% sign
J. R. Williams for the annexation, a public hearing is required by the City Council. Planning and Zoning
Property Commission will have to review this annexation. Mr. Kern further pointed out Holy Cross
Annexation could petition for an election under the law. Mentioned to Council was the fact that!t~s
property is applying for rezoning in the County this date of PUD-AR2. If the zoning is
granted with conditions, and the area is annexed, the City would be required to follow
the conditions set down by the County.
Resolution #2 Councilman Walls moved to read Resolution #2, Series of 1972. Seconded by Councilman
J. R. Williams Griffin. Roll call vote - Councilmen Griffin aye; Markalunas aye; Walls aye; Whitaker
Property nay; Mayor Homeyer aye. Motion carried.

WHEREAS, a petition for annexation to the City of
Aspen has been filed in accordance with Section 139-21-6 of
the Colorado Revised Statutes 1963, as amended,
AND WHEREAS, the area seeking annexation is des-
cribed as follows:
A tract of land situated in the N~SW~ of
Section 7, T10S, R84W of the 6th P.M.~ Pitkin
County, Colorado, more particularly described as
follows:
Beginning at a point whence the center
quarter corner of Section 7, T10S, R84W of the
6th P.M. bears N.59°57'54'' E.1042.64 feet; thence
S.27°51'48"W. 404.48 feet; ~hence S27~51'48'' W.
3 feet more or less to the North Annexation. line
established by document recorded in Plat Book 3
at Page 284/288 of the Pitkin County Records,
thence Westerly and Northerly along said North
Annexation line to a point from whence a line to
the SW corner of that certain tract of land con- ~_~

ning.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City'of Aspen, that:
It finds that the annexation petition substantially
complies with Section 139-21-6, Colorado Revised Statutes, 1963,
as amended, and that the City Council will hold a hearing on

the proposed annexation complies with Section 139-21-3 and

Council agreed to hold a study sessiom next MOndaY, March 6th a 5:00 p~m. to review the
capital improvements program.
Councilman Griffin stated the unused water rights in the Salvation Ditch should also be
discussed.
Councilman Walls moved to adjourn at 5:30 p.m., seconded by Councilman Whitaker~ Ail in
