Lot 15 is currently divided into two parts'by the Aspen Mountain Road which crosses through the property. The City zoning map shows the westerly por- tion of lot 15 to be zoned L-1 and the easterly portion of lot 15 to be zoned R-6. Mr. Lyle Reeder is the record owner of lot 17 and holds options to purchase lot 16. Dean Billings is the record owner of lot 14 and lot 15. If subdivision exemption is granted to this proposal to replat lot 15 into two parcels, Lyle Reeder will exercise his option to purchase the westerly portion of lot 15 and lot 16 and Dean Billings will retain owner- ship of lot 14 and the easterly portion of lot 15. The application was referred to Dave Ellis, City Engineer. After reviewing the application and making a site inspection, Dave recommended the subdi- vision exemption request be approved subject to three specific concerns which the applicant has already met to the satisfaction of Engineering. At this point Engineering recommends approval without condition. The application was referred to the City Attorney, Ron Stock. Ron was par- ticularily concerned with the possibility of creating non -conforming parcels. Even though lot 15A will have a square footage in excess of the minimum 6,000 square feet required in the R-6 zone district, it would still be non -conforming due to the fact that it cannot met the minimum lot width of 60 feet. At one point., lot 15A would be only 36 feet wide. Lot 15B would clearly be a substandard sized lot in the Lodge district. Ron recommends you approve the subdivision exemption request with the following two specific conditions to be added to the plat: 1. Development on lot 15B is allowable only in connection with lot 16, Ute Addition to the City of Aspen. 2. Development on lot 15A is only allowable in connection with lot 14, Ute Addition to the City of Aspen. The city zoning map shows the westerly portion of Lot 15 to be zoned LODGE ONE and the easterly portion of Lot 15 to be zoned R-6. It appears that the City of Aspen may have made a de facto subdivision of Lot 15 when zoning was adopted by splitting Lot 15 into two different zoning designations. I am the owner of record of Lot 17 and hold options which are in Escrow to purchase Lot 16 and the westerly portion of Lot 15 all located in the Ute Addition to the City of Aspen. A denial of this request would deprive the applicant and owner of record from a reasonable use of the westerly portion of Lot 15 which is zoned LODGE ONE. A subdivision exemption is necessary for the preser- vation and enjoyment of a substantial property right. The westerly portion of Lot 15 consisting of approxi- mately 4,349 square feet which is a substantial 41% of the total area of Lot 15. The utilization of the westerly portion, zoned LODGE ONE, has a substantial property value as developable real estate when combined with Lots 16 and 17. 1w. aw -WNW-"- polo-,
