The attached letter of application requests subdivision exemption to sub-
divide into hlO parcel, lot 15, Ute Avenue Addition to the City of Aspen.
Lot 15 is currently divided into two parts!by the Aspen Mountain Road which
crosses through the property. The City zoning map shows the westerly por-
tion of lot 15 to be zoned L-l and the easterly portion of lot 15 to be
zoned R-6. Mr. Lyle Reeder is the record owner of lot 17 and holds options
to purchase lot 16. Dean Billings is the record owner of lot 14 and lot
15. If subdivision exemption is granted to this proposal to replat lot
15 into two parcels, Lyle Reeder will exercise his option to purchase the
westerly portion of lot 15 and lot 16 and Dean Billings will retain owner-
ship of lot 14 and the easterly portion of lot 15.
The application was referred to Dave Ellis, City Engineer. After reviewing
the application and making a site inspection, Dave recommended the subdi-
vision exemption request be approved subject to three specific concerns
which the applicant has already met to the satisfaction of Engineering,
At this puint Engineering recommends approval without condition.
The application was referred to the City Attorney, Ron Stock. Ron was par-
ti cul arily concerned with the poss i bil ity of crea ti ng non-conformi ng parcels,
Even though lot 15A will have a square footage in excess of the minimum
6,000 square feet required in the R-6 zone district, it would still be
non-conforming due to the fact that it cannot met the minimum lot width
of 60 feet. At one point, lot 15A \~ould be only 36 feet wide. Lot 15B
would clearly be a substandard sized lot in the Lodge district. Ron
recommends you approve the subdivision exemption request with the following
two specific conditions to be added to the plat:
1. Development on lot 15B is allowable only in connection with lot 16,
Ute Addition to the City of Aspen.
2. Development on lot 15A is only allowable in connection with lot 14,
Ute Addition to the City of Aspen.
The Planning and Zoning Commission reveiwed this request at their regular
meeting on October 17, 1978, at which time they recommended approval of the
subdivision exemption request subject to :the two conditions requested by
the City Attorney appearing on the plat.

Gentlemen,
I hereby request a Subdivision Exemption to subdivide
into two parcels Lot 15, Ute Addition to the City of
Aspen.
The division proposed would be along a line approximating
the center line of the Aspen Mountain Road which crosses
Lot 15 as shown on attached Exhibit "B". The legal
description is shown .cnExhibi t 'C" . The easterly portion
of Lot 15 would consist of approximately 6,323 square
feet thus remaining larger then the minimum building
site requirement. The westerly portion consisting
of approximately 4,349 Square feet would be combined
with Lots 16 and 17 for future development.
The city zoning map shows the westerly portion of Lot
15 to be zoned LODGE ONE and the easterly portion of
Lot 15:to be zoned &-6. It appears that the City of
Aspen may have made a de facto subdivision of Lot 15
when zoning was adopted by splitting Lot 15 into two
different zoning designations.
I am the owner of record of Lot 17 and hold options
which are in Escrow to purchase Lot 16 and the westerly
portion of Lot 15 all located in the ~te Addition
to the City of Aspen. -
A denial of this request would deprive the applicant
and owner of record from a reasonable use of the
westerly portion of Lot 15 which is zoned LODGE ONE.
A subdivision exemption is necessary for the preser-
vation and enjoyment of a substantial property right.
~he westerly portion of Lot 15 consisting of approxi-
mately 4,349 square feet which is a substantial 41%
of the total area of Lot 15. The utilization of the
westerly portion, zoned LODGE ONE, has a substantial
property value as developable real estate when combined
with Lots 16 and 17.

The granting of the subdivision exemption will not
be detrimental to the public welfare or injurious
to other property in the area. The granting of the
exemption would eliminate some future owner of Lot
15 from endeavoring to develop. the westerly portion
of Lot 15 as a mini-lodge. The development of the
westerly portion of Lot 15 in conjunction with Lot
16 and 17 allows for a better designed and operated
lodge in the area.
If this subdivision exemption is granted, I plan to
do the following:
1. Exercise the options to acquire the westerly
part of Lot 15 and all of Lot 16 as soon as possible
2. Remove junk autos and trash from the LODGE
ONE properties promptly upon exercise of the two
options.
3. Undertake a study with the assistance of an
architect to develop plans to build a first class
lodge. The plans would be submitted to participate
in future allocation competition for LODGE ONE zoning
under the Growth Management Plan quota of the city
of Aspen.

A Receipt and Option Contract and Deed executed by
me to se~l tbe western portion of Lot l5,zonedLODGE
OBE, to Lyle Reeder is in escrow at Aspen Ti.tle Company.
The option contract is conditioned upon the City of
Aspen approving a division of Lot 15 wbereby the
western portion can be legally deeded.
Since I am the owner of record of Lot 15 in the Ute
Addition, I support Lyle Reedeta application to divide
Lot 15 in order to allow the LODGE ONE.zoned portion
to be combined with Lots 16 and 17. It is my intention
to retain ownership of the eastern portion of Lot 15
and also Lot 14.
If the City of Aspen grants the subdivision request
for Lot 15, Lyle Reeder will be abl.e to exercise the
option and obtain possession to the western portion.

me to sell Lot 16 to Lyle Reeder is in escrow at
Aspen Title coapany, Aspen, Colorado. The contract
provides for possession to be given upon close of
escrow.
I wish to join in supporting Lyle ..eders Application
to divide Lot 15 whereby the westerly portion zoned
LODGE ORE can be consolidated with Lots 16 and 17.

Mr. Reeder found these conditions satisfactory and is currently working
with City Engineering to satisfy these three concerns. Satisfaction of
these concerns to the satisfaction of the City Engineer should be a con-
diton of your approval.

21, 1978, memorandum to the Planning Office and provided the two conditions
requested by the City Attorney appear on the plat.

engineering department recommends granting of this exemption sub-
ject to three specific concerns, The first would be the granting

be to clarify the ties in the legal description of the parcel.
The final condition would be to prepare a plat in recordable
form with appropriate approval and acceptance certificates show-
ing the subdivided lot together with the new easement.
