Pursuant to Section 20-19 of Chapter 20 of the Municipal
Code of the City of Aspen, TED AND SALLY REEDS hereby apply for
an exemption from the definition of the term "Subdivision" with
respect to the real property described as:
Lots C and D, Block 22
City and Townsite of Aspen,
Pitkin County, Colorado
The applicants submit that the exemption in this case would be
appropriate.
The application involves subdivision of an existing
duplex. The owners of the property will have a common interest
in the land and there will be a condominium declaration and
a use maintenance agreement applicable to the property which
does not in any way increase the land use impact of that property.
The applicants submit that such an exemption in the instant case
would not conflict with the intent and purpose of the subdivision
regulations which are directed to assist the orderly, efficient
and integrated deve1~ment of the City of Aspen; to insure the
proper distribution of population; to co-ordinate the need for
public services; and to encourage well-planned subdivision.
In the present application those considerations will
not be disturbed with respect to this property inasmuch as the
building is already in existance, and there would be no change
in density which is in line with prevailing contemplated or
desired population density on this property.
We would greatly appreciate your consideration of this
matter at your next regular meeting.

DATE: May 13, 1977
Attached for your review is the estimated Park Dedication fee for
the Reeds Duplex Subdivision Exemption. Cheryl Stickney has sub-
mitted, as proof of the market value of the land, a copy of the
receipt and option contract showing a land valuation of $30,000.00
for the duplex. This figure appears to be quite low for a duplex
site in Aspen. The valuing of the building at $90,000.00 and the
land at $30,000.00 appears that it may have been by mutual consent
of buyer and seller to establish a higher base for the building
depreciation.
Ms. Stickney will probably call you regarding this, as she appears
to be suddenly in a hurry to finish this case.

STATEMENT OF SUBDIVISION EXEMPTION
WHEREAS, the provision of Section 20-19 (b) of the
Aspen Municipal Code provide that, following receipt of a
recommendation from the Planning Commission, the City Council
may exempt a particular division of land from the definition
of a subdivision set forth in Section 20-8(s) of the Code,
when, in the judgment of the City Council, such division of
land is not within the intent and purpose of subdivision
regulation, and
WHEREAS, pursuant to said Section 20-19(b) , TED AND
SALLY REEDS have requested such an exemption for the condomi-
niumization of the existing improvements on
Lots C and D, Block 22, City
and Township of Aspen, Pitkin
County, Colorado and
WHEREAS, the Aspen Planning and Zoning Commission, at
its meeting held October 5, 1976, recommended approval of such
request, and
WHEREAS, the City Council has determined that the
proposed condominiumization is not within the intents and
purposes of subdivision regulation,
THEREFORE, the Aspen City Council, pursuant to the
authority granted in Section 20-19(b) of the Aspen Municipal
Code, does hereby determine and declare that the condominiumi-
zation of the existing improvements on the aforementioned
property, is without the intents and purposes of Chapter 20 of
the Aspen Municipal Code and does hereby waive the enforcement
of the City subdivision regulations with respect thereto.

Seller agrees that the dishwashers, ranges, ovens, hot water heaters,
furnaces, carpets and drapes which are a part of this contract as set
forth above are valued at $10,000.00, the land at $30,000.00, and the
uilding at $90,000.00.
IIC. It is understood between the parties that purchasers are forming a
partnership to purchase the property. In order to do this, purchasers'
will need 60 days from the date seller accepts and delivers this con-
tract to close. In the event purchasers have escrowed 85% of the
$23,000.00 payment by fifteen days before Closing and request extension
by that date, the Closing may be extended to no later than ten days.
Any further extensions will be in the sole discretion of seller.
110. In the event purchasers cannot close and all extensions have lapsed and
seller sells the property to another purchaser for the same or a better
price within 120 days of the date hereof, then seller shall return
purchasers option money. "Sells" means (a) closes on a sale, or (b)
signs a purchase or receipt and option contract within the time period
with a deferred closing.
llE. At or before Closing," purchasers' shall nominate the individual or ent-ity'
which will take and hold title to the property.
IIF. Purchaser shall keep and obtain property insurance upon the premises in
the amount of at least 80% of the value of the improvements, and shall
name sellers as an additional insured. (Minimum amount carried shall be
$80,000.00)

llG. Purchaser shall send seller a tax receipt each year showing that the
taxes have been paid.
,1lH. Seller shall send purchaser each year on or before January 39 of each
year excluding 1977, a statement showing the amount of principle and
interest paid.
Ill. Purchaser shall prepare all documents of conveyance and shall submit
said docu:ents to seller far approval seven days ,before Closing.

lLJ. Sellers shall have the use of the garage attic for one year.

STATEMENT OF SUBDIVISION EXEMPTION
WHEREAS, the provision of Section 20-19 (b) of the
Aspen Municipal Code provide that, following receipt of a
recommendation from the Planning Commission, the City Council
may exempt a particular division of land from the definition
of a subdivision set forth in Section 20-8(s) of the Code,
when, in the judgment of the City Council, such division of
land is not within the intent and purpose of subdivision
regulation, and
WHEREAS, pursuant to said Section 20-19(b), TED AND
SALLY REEDS have requested such an exemption for the condomi-
niumization of the existing improvements on
Lots C and D, Block 22, City
and Township of Aspen, Pitkin
County, Colorado and
WHEREAS, the Aspen Planning and Zoning Commission, at
its meeting held October 5, 1976, recommended approval of such
request, and
WHEREAS, the City Council has determined that the
proposed condominiumization is not within the intents and
purposes of subdivision regulation,
THEREFORE, the Aspen City Council, pursuant to the
authority granted in Section 20-19(b) of the Aspen Municipal
Code, does hereby determine and declare that the condominiumi-
zation of the existing improvements on the aforementioned
property, is without the intents and purposes of Chapter 20 of
the Aspen Municipal Code and does hereby waive the enforcement
of the City subdivision regulations with respect thereto.
