STATEMENT OF EX~lPTION
FROM THE DEFINITION OF SUBDIVISION
WHEREAS, CHARLES CURTIS ~VE~ and his wife
ANNE SLAVENS are the owners of a parcel of land
located in Pitkin County, Colorado, more particularly
described as :
Lots Q, Rand S, Block 35
East Aspen Additional Townsite, and
WHEREAS, the applicants' single family residence
is on Lot S and Lots Q and R are vacant, and
WHEREAS, applicants have requested an exemption
from the definition of subdivision for the purpose of
conveying Lots Q and R to a third party, and
WHEREAS, the Aspen Board of Adjustment, at its
meeting on November 4, 1976, granted to applicants a
variance from the strict application of section 24-12.7
of the Aspen Municipal Code authorizing them to transfer
Lots Q and R as one parcel and to retain Lot S as a
separate parcel, and
WHEREAS, the Aspen Planning and Zoning Commission,
at its meeting held December 14, 1976, determined that
an exemption from the definition of subdivision is
appropriate and recommended that the same be granted,
and
WHEREAS, the City Council has determined that
the proposed division of Lots Q and R from Lot S is
not within the intent and purpose of the subdivision
ordinance set forth in Chapter 20 of the Aspen
Municipal Code,
THEREFORE, the City Council of the City of Aspen,

Colorado does hereby determine that the proposed
division of Lots Q and R, Block 35, East Aspen
Additional Townsite from Lot S, Block 35, East Aspen
Additional Townsite is not within the intents and purpose
of the subdivision ordinance, and does, for such reason
grant an exemption from the definition of subdivision
for such action,
PROVIDED, HOWEVER, that the foregoing exemption
shall not be deemed to relieve or exempt Lots Q and R
from any park dedication fees which may be due upon
the issuance of a building permit for construction

was considered and approved by the Aspen City Council at
its regular meeting held Monday, December 27, 1976, at
which time the Mayor, STACY STANDLEY, III, was authorized
to execute the same on behalf of the City of Aspen.
