RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION
APPROVING AN APPLCIATION FOR MINOR DEVELOPMENT FOR AN
ADA ACCESSIBLE RAMP AND THE REPLACEMENT OF WINDOWS ALONG
HYMAN AVENUE FOR 501 EAST HYMAN AVENUE, ASPEN ARCADE, LOTS
A, B, C, D, BLOCK 95, CITY AND TOWNSITE OF ASPEN, COLORADO
RESOLUTION NO.23, SERIES OF 2006
WHEREAS, the applicant, Aspen Arcades LTD, represented by Theodore K. Guy
Associates, PC, has requested Minor Development approval for the property located at 501
East Hyman Avenue, Lots A, B, C, D, Block 95; and
WHEREAS, Section 26.415.070 of the Aspen Municipal Code states that no building or
structure shall be erected, constructed, enlarged, altered, repaired, relocated or improved
involving a designated historic property or district until plans or sufficient information have
been submitted to the Community Development Director and approved in accordance with
the procedures established for their review. An application for a building permit cannot be
submitted without a Development Order; and
WHEREAS, the procedure for a Minor Development Review is as follows. Staff reviews
the submittal materials and prepares a report that analyzes the project's conformance with
the design guidelines and other applicable Land Use Code Sections. This report is
transmitted to the HPC with relevant information on the proposed project and a
recommendation to continue, approve, disapprove or approve with conditions and the
reasons for the recommendation. The HPC reviews the application, the staff analysis report
and the evidence presented at the hearing to determine the project's conformance with the
City of Aspen Historic Preservation Design Guidelines. The HPC may approve, disapprove,
approve with conditions, or continue the application to obtain additional information
necessary to make a decision to approve or deny; and
WHEREAS, Sara Adams, in her staff report dated August 30, 2006 performed an analysis
of the application to replace windows on Hyman Avenue based on the standards, and found
that the "City of Aspen Historic Preservation Design Guidelines" were met with conditions;
and performed an analysis of the application to add a ramp to the Galena Street entrance
based on the standards and found that the "City of Aspen Historic Preservation Design
Guidelines" were met; and
WHEREAS, at their regular meeting of August 30, 2006, the Historic Preservation
Commission considered the application after a duly noticed, public hearing, took testimony,
found the application to replace windows on Hyman Avenue to meet the pertinent
standards and found that the drawing submitted on August 30, 2006 for a ramp on Galena
Street to meet the pcrtinent standards with a vote of 5 to 0; and
THEREFORE, BE IT RESOLVED:
That the HPC approves an application to replace windows along Hyman Avenue and an
ADA ramp on Galena Street as proposed on August 30, 2006, located at 501 East Hyman
Avenue, Lots A, B, C, D, Block 95, City and Townsite of Aspen with the following
conditions:
1. The ramp proposed at the August 30, 2006 meeting is approved.
2. The windows and door along Galena Street must receive approval by staff and
monitor before purchase and installation.
3. There shall be no additions or deviations from the proposal without first being
reviewed and approved by staff and monitor, or the full board.
4. The interior corridor of the Aspen Arcade must maintain its function as a circulation
corridor and is not permitted as net leasable space without the necessary approvals
and mitigation.
APPROVED BY THE COMMISSION at its regular meeting on the 30th day of
August 2006.
