Location: Applicants' Request: Referra 1 Comments: City Attorney "As provided in Section 20-19(b) following receipt of a recom- mendation from the Planning Commission, the City Council may exempt a particular division of land from the definition of subdivision when, in the judgment of the City Council, such division of land is not within the intent and purpose of the subdivision chapter. It is my opinion that boundary adjustments such as that set forth in the application should be exempted from the subdivision definition. In this respect the application should meet the requirements of the lot line adjustment criteria being proposed by the Planning Department." Engineering Department "Having reviewed the above application and made a site inspec- tion, the Engineering Department has the following comments: 1. The applicants should be required to submit a final plat for signatures and recordation indicating the shifted lot line. The plat should be submitted prior to council and include the following: a. Old and new lot lines. b. Location of existing structures. c. City irrigation ditch in adjacent right-of-way. d. All adjacent property owned or under option by the applicants. 2. The lot line shift would not appear to affect development rights on either parcel with the exception of F.A.R. and bedroom counts. Parcel 1 is potentially subdividable although, again, the lot line shift does not affect this." Planning Office Review: The house on Parcell is non-conforming in that the side yard is within 10 feet of the present boundary. There is not a 30 foot front yard either. Adjusting the boundary as requested will form an adequate side yard setback. Therefore, it decreases the non-conformity slightly. This lot line adjustment conforms with Section 1 of Ordinance No. 37 (Series of 1981). Thomson Ladies and Gentlemen: This letter is an application for an exemption from the definition of subdivision pursuant to Section 20-19 of the Municipal Code of the City of Aspen in order to permit a boundary line adjustment as between the two parties above named. J.R. Sturgis is the owner of parcell, and the Thomsons as Joint Tenants are the owners of parcel 2, as shown on the enclosed "Boundary Adjustment Map". The adjustment to the boundary line will adjust the property interest of the respective parties based upon an existing fence line which has constituted the historical practical boundary as shown on the boundary adjustment map attached hereto. To the best of the knowledge of the parties, the fence has been in place for a substantial period of time. It is the desire of each of the parties to have the boundary adjusted to the new boundary line. Both of the properties are situate on Roaring Fork Road and comprise portions of the Aspen Company Subdivision platted in the late 1940's. Each of the parcels are situate within the R-15 residential zone under the City's Zoning Code which requires a minimum of 15,000 square feet per residential dwelling unit. After the adjustment request, the properties of both of the parties will contain substantially in excess of the 15,000 square foot minimum.
