May 14, 1975
Meeting was called to order by Chairman Spencer Schiffer at 5:00 p.m. with
members Jack Jenkins, Roger Hunt and Patrick Dobie. Johnson was excused. Also
present were Yank Mojo, John Stanford and Bill Kane of the Planning Office.
Chairman Schiffer noted that members had been duly notified
of the special meeting in accordance with the by-laws.
Mojo noted that the proposal was to move a single family
house to Sunnypark Subdivision. He noted .i;hat the house
was presently behind the Charhouse and was scheduled for
either moving or demolition. The area proposed for the
house, near Aspenview ApaJ:tments, was encroaching on the
City's right of way. The planning office had three-fold
concerns: the parking area shnuld be closed off on Park
and the curb cut closed. They should have access in off of
Park Circle with sufficient parking for both the existing
unit and also the proposed one. Also he felt that they.
should agree to join in any future improvement districts. '
He recommended exemption from mandatory PUD.

Schiffer questioned the size of the lot and Mojo
was 13,000 square feet. Mojo se.id it \vas within
R/HF dClfsity. Mojo also noted that it complied
the objectives of the zoning code.

Hunt moved to grant the exemption from mandatory PUD
upon the conditions Mojo proposed. Jenkins seconded.
All in favor, motion carried.
Jenkins moved to adjourn and Hunt second.ed. All in favor,
meeting adjourned at 5:15 p.m.

Family) Zoning District of the City of Aspen. - Presently
there is one (1) residential dwelling on it which has
an attached apartment. The lot contains approximately

who owns said Lot 4 and a one-story frame dwelling which
is presently located on Lots 1,2 & 3, Block 1 Conners
Addition, City of Aspen. (A Building-Permit has been
issued for the construction of a small apartment buil-
ding on the lots in Conners Addition).

We would like to more the old one-story Victorian Dwelling
from Conners Addition unto lot # 4, Sunny Park Subdivision
which has a Mandatory Planned Unit Development designation.

We respectfully request Exemption from the strict appli-
cation of PUD requirements inasmuch as the moving of this
house unto lot 4 definitely can be accomplished within
all present zoning and building restrictions. This lot
has access from two dedicated streets and is served by
City of Aspen Water and is within the Aspen Metropolitan
Sanitation District. .

ASPEN PLANNING AND ZONING RESOLUTION
WHEREAS, the co~gressional Corporation desires
to move a single family dwelling onto Lot #4 of Sunny Park
Subdivision in the City of Aspen, and
WHEREAS, the zoning on said lot is R-MF, PUD,
Residential Mulit-family, Planned Unit Development, and
WHEREAS, said lot is 13,704 square feet and already
occupied by a duplex structure, and
WHEREAS, the Congressional Corporation throught its
agent, Hans Graminger, has agreed to close the curb cut and
remove the parking on Park Avenue and has agreed to provide
access to the lot from Park Circle, and has agreed to provide
on-site parking at the rate of one space per bedroom for all
development, existing and proposed on the lot, and has agreed
to join and waive rights of protest for any future improve-
ment districts that are proposed for the area, and
WHEREAS, at a Special Meeting held at 5:00 P.M.
on Wednesday, May 14, 1975 after proper notice, the Planning
and Zoning Commission determined that the proposed project
meets the objectives and the design criteria of Planned Unit
Development,

NOW THEREFORE BE IT RESOLVED, that the proposed
house move be exempted from compliance with the provisions
of Mandatory Planned Unit Development,

BE IT FURTHER RESOLVED, that the exemption herein
is conditioned upon full compliance with all of the conditions
hereinabove stipulated and may be withdrawn in the event
that the applicant shall fail to comply with the same in
whole or in part.

RE: Sunny Park Exemption from Definition of Subdivision
The Planning and Zoning Commission has forwarded a
recommendation for exemption from the definition of subdivision
for a four unit apartment house at 105 Park Circle. The project
is currently under construction and this exemption is requested
so that the owner, Jeff Costley, can have the certificate of
occupancy issued.
Costley is suffering from some hardship due to the
fact that a building permit issued after a subdivision regulation
amendment required compliance with subdivision for construction
of apartment buildings. The Planning Office felt no objective
of subdivision regulation would be satisfied by requiring com-
pliance with Chapter 20 and, as you are aware, a land dedication
need not be made for construction of a four plex. P & Z recommend-
ed the exemption at its meeting October 21st.

RE: Subdivision Exemption - Sunny Park Apartments
DATE: October. 23, 1975
This is an application for subdivision exemption by Jeff Costley for
Sunny Park Apartments located at 105 Park Cil'cle. The project is
currently under construction and has recently applied for an occupancy
permit from the Bui lding Department, when it \~as discovered that the
building permit was issued in error (see the attached m2n~ from
Cl ayton I~eyri ng) .
Since the project consists of only four (4) apartment units, it is
exempt from open'space dedication requirements of the subdivision
regulations.
The Planning and Zoning Commission on October 21, 1975, recommended
granting the subdivision exemption with tho condition that a subdivision
plat be recorded for the property.
The Planniryg Office feels that no significant public purpose would
be accomplished by processing this project through full subdivision
procedures and recommends granting the subdivision exe\llption. We
sincerely regret that Hr. Costley through no fault of his own has
experienced this unexpected delay in finishing his project.

RE: FOUR UNIT APARTMENT IN SUNNY PARK SUBDIVISION
It has been discovered that' C. V. Associates should
have received subdivision approval before a building
permit was issued; however, no anproval was given due
to pc; haps to the very r'ccent amendment to the
suhdivision regulations.
The sequence of events are as follows:
On April 15,1975 C. V. Associates received PUD
exemption from P&Z.
On April 21, 1975 the new subdivision regulations
went into effect which requires multi-family

The previous subdivision regulations did not re-
quire apartment houses receive subdivision approval
- only condominiums.
Application was made on April 25, 1975 for a four
unit apartment house at 165 Park Circle.

EXEMPTION FROM [)EFINl'J'ION OF SUBDIVISION
WHEREAS, JAMES ;1. COSTLEY hdE: submi.ttcd an application
for an exemption fl.'om the definition of subdivision pursuant to
Section 20-19(b) of the Aspen Municipal Code for the construction
of four two-bedroom apartments on the following described tract
of land located in pitkin County, Colorado, to wit:
The South one-half (1/2) of Lot 6, and the
North Gne-tenth (1/10) of Lot 4, Sunny
Park Subdivision, Aspen, Colorado; and
WHEREAS, the Aspen Planning and Zoning Commission at its
meeting held October 21, 1975, considered said application and
recommended that the requested exemption be granted, and
WHEREAS, the City Council, on review of the matter at
its regular meeting held October 27, 1975, did concur with the
Commission and by motion duly made, seconded and carried determined
that the proposed construction is not within the intents and pur-
poses of subd.ivision regulation,
'fHEREFORE, il: is hereby declared that the proposed con-
struction of the four dwelling units on Lots 4 and 6 of Sunny
Park Subdivision above described, be and hereby is declared to
be exempt from the definition. of a subdivision as set forth in
Section 20-3(s) of the Aspen Municipal Code and that construction
of the proposed improvements may procecd without compliancc with
the provisions of Chapter 20
