AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING SUBDIVISION
EXEMPTION FOR THE CONDOMINIUMIZATION OF THE VANDEUSEN DUPLEX
WHEREAS ,
pursuant to section 7-1007 of the Aspen Land Use
Code, a condominiumization is a Subdivision Exemption by the city
council; and
WHEREAS ,
Ed and Diana Van Deusen have submitted an
application for the Condominiumization of their duplex located at
1006 E. Hyman #A & B, lots K, L, and M Block 33 East Aspen
Addition; and
WHEREAS,
the Engineering Department, having reviewed the
application has made referral comments; and
WHEREAS ,
the Building Department has made the required

the Planning Office, having reviewed the
application pursuant to Section 7-1007,
and reviewing the
referral comments from Engineering, recommends approval with the
follmdng conditions:

SUMMARY: The applicant seeks condominiumization of a duplex at
1006 E. Hyman. Pursuant to section 7-1007 of the Land Use Code,
conversion of an existing development shall be reviewed and
approved by the City Council. When this building was constructed
a duplex was a permitted use in the RMF zone without use
restrictions. Condominiumization requires restricted leases,
notification of existing tenants, and payment of an affordable
housing impact fee or the provision of employee housing and a
building inspection. The housing impact fee for the two 3
bedroom units is $16,100 ($8,050 per unit.) In addition to the
Subdivision Exemption, the Attorney's Office requires that all
land use applications "placing burden upon or limiting the use of
private property" be by ordinance.

Engineering: Jim Gibbard has forwarded the following comments:
1. The applicant needs to agree to join a special improvement
district, if one is ever formed.
2. The applicant needs to submit a drainage study, done by a
registered engineer, to the Engineering Department for review
before approval.

BUILDING DEPARTMENT: The duplex was inspected as required by
code on January 15, 1990. (Attachment "B")
STAFF COMMENTS: The applicant has addressed the requirements of
Section 7-1007 for comdominiumization, those being:
1. written notice to tenants of condominiumization, giving
tenants first right of refusal to purchase their unit.
2. restriction of rental to 6 month minimum leases, with no more
than 2 shorter tenancies per year.
3. acknowledgement of the Affordable Housing Impact requirements,
calculated to be $8,050 per unit, or deed restriction of the
units according to the requirements of the Housing Authority.
4. the required inspection by the Building Department.
RECOMMENDATION: The Planning Office recommends the approval of
the condominiumization with the following conditions:
