STATEMENT OF EXEMPTION
FROM THE DEFINITION OF A SUBDIVISION
WHEREAS, provisions of Section 20-19(b) of the
Aspen Municipal Code provide that following the receipt of a
recommendation from the Planning Commission, the City
Council may exempt a particular division of land from the
definition of a subdivision set forth in Section 20-3(s) of
the Code, when in the judgment of City Council such division
of land is not within the intent and purpose of subdivision
regulation, and
WHEREAS, pursuant to Section 20-19(b) James H.
Ward and Faylis R. Ward have requested such an exemption for
the condominiumization of existing improvements on
Lot 9, Block 1, Snowbunny Subdivision,
WHEREAS, the Aspen Planning and Zoning Commission
had its meeting held February 22, 1977, recommended approval
of such request, and
WHEREAS, the City Council has determined that the
proposed condominiumization is not within the intent and
purposes of subdivision regulation,
NOW, THEREFORE, the Aspen City Council, pursuant
to authority granted in Section 20-19(b) of the Aspen Municipal
Code,does hereby determine and declare that the condominiumization
of the existing improvement on Lot 9, Block 1, Snowbunny
Subdivision, Pitkin County, Colorado, is without the intents
and purposes of Chapter 20 of the Aspen Municipal Code, and
does hereby waive the enforcement of the city subdivision
regulations with respect thereto,

PROVIDED, however, that:
(1) the owners shall
first pay a park dedication fee pursuant to Ordinance
No. 63 (Series of 1976) in the amount of $1,562.84, (2) shall
include in the condominium declarations or map filed for
record with the Clerk and Recorder of Pitkin County, Colorado,
a restriction that all lease or rental terms in such condominium
shall be not less than six (6) months, except for two (2)
weeks at the Christmas and New Year holiday each year, and
except during the summer period from Memorial Day to Labor
Day, and, (3) that the declarations shall contain a first
right of refusal to the tenants of said condominium units to
purchase the occupied unit upon the same terms and conditions
as may be received by the owners, upon the first sale of
such units.
DONE THIS 28th day of March, 1977, by the Aspen
City Council at its regular meeting held on said date.

This is a request by James and Faylis Ward for subdivision exemption
to condominiumize an existing duplex located on Lot 9, Block 1,
Snowbunny Subdivision.
The Engineering Department has reviewed the request and recommended
approval with no conditions.
The Planning and Zoning Commission recommends approval conditioned
upon a minimum 6 month lease requirement.
The Planning Office recommends approval subject to payment of the
Subdivision Dedication Fee which is($2,205.~a minimum lease restric-
tion of six months; and a first right of refusal at market value be
given to the existing tenants. Jon Mulford, a resident of the duplex,
will purchase his living unit and Mr. Ward intends to continue renting
the other half to the present tenant.

APPLICATION FOR EXEMPTION
FROM SUBDIVISION REGULATIONS
Request is hereby made on behalf of James H. Ward
and Faylis R. Ward, the applicants, pursuant to Section 20-l9(a)
of the City of Aspen Subdivision Regulations for an exemption
from the definition of the term "Subdivision", with respect
to the following real property:
Lot 9, Block 1, Snowbunny Subdivision,
City of Aspen, State of Colorado.
Exemption in this instance would be appropriate since
the proposed division is of an existing duplex. A division or
subdivision of a single lot with an existing duplex structure
creates conditions where strict compliance with the subdivision
regulations would impose undue hardship upon the applicants.
If an exemption is granted, the owners of the property will
have a common interest in the land and there will be a
condominium declaration and maintenance agreement recorded
which will not increase the land use i~pact of the property.
The granting of an exemption will not be contrary to the intent
and purpose of the subdivision regulations, the Durposes of
which are to assist in the orderly, efficient and integrated
development of the City of Aspen, and to insure proper

distribution of population, coordinate the need for public
services, and to encourage well-planned development. The
granting of the exemption will result in no change in density
nor will it result in any other adverse impact on city planning
goals.

WARD SUBDIVISION EXEMPTION
Description: Lot 9, Block 1, Snowbunny Subdivision, City of
Aspen, State of Colorado, known as 1243 and 1245
Bunny Court.
Land Area: 10,666 square feet platted as Lot 9, Block 1,
Snowbunny Subdivision.

Improvements: One-story frame duplex constructed in 1963,
concrete foundation, no basement, wood exterior,
built-un roof. Each side contains two bedrooms,
living room, kitchen, dining area and one and one-
half baths. East side has additional enclosed laundry,
storage, sauna and shower.
Past and Proposed Occupancy: The applicants lived in the east
side of the duplex with their family until three
years ago. Since that time both sides of the duplex
have been rented to tenants from time to time. The
present tenants in the west side of the duplex have
resided there for two years, and have an option to
purchase the west one-half when condominiumization
is approved. The east half would continue to be
managed on a long term rental basis. Neither the
applicants nor the optionees object to a covenant
or restriction requiring long term rentals of a
minimum of six months.
Utilities: Water, sewer, gas and electricity are separately
metered to the two units of the duplex, and no
changes in service are contemplated.

I have your note of March 2, 1977, stating that you believe
the present value of the Ward lot is $50,000.00, rather than
the $40,000.00 figure indicated by the Goodheim survey.
Information from the assessor's office indicates that the
square footage in the Ward lot is 10,666, compared to 17,100
square feet in the Roosevelt lot (Lot 15, Block 1, Snowbunny
Subdivision) with which you are comparing it. Given the
very high prices of Aspen residential lots, I think it is
fair to value them on a per square foot basis for comparative
purposes, and the Roosevelt-Ferrell transaction would
indicate a price per square foot of $3.04. That figure
applied to the Ward lot would give an indicated value of only
$32,434.00.
Jim Ward is out of town and I cannot get an immediate
reaction from him. I would appreciate it, however, if you
would send me your formula calculations for the Park Dedication
fee based on values of $40,000.00 and $50,000.00 so we know
how many dollars difference you are talking about.

I have had evidence recently that similiar duplex lots in the Snow-
bunny area have sold for $52,000 (Lot 15, Block 1 in January of 1977).
I think that the value of the Ward property is approximately $50,000.
If this is not agreeable to Mr. Mulford, we could have James Mollica
look at the property. I would like to point out that land has been
appreciating at about 8% per month for the last three or four months.

Enclosed find a copy of an appraisal prepared by Brian
Goodheim, indicating present market value of the lot at
$40,000.00. It is my understanding that you will use this
information to compute the park dedication fee. I would
appreciate having the results of the computation as soon
as possible.
You indicated that the Ward nnplpx condominium would come
before the City Council for consideration on Monday,
March 14. Please advise as to the probable time that Jim
and I should be present.

Re: Ward Duplex Subdivision Exemption
Dear Hal:
Jim Ward will be out of town until about March 3, and I would
appreciate it if this matter were scheduled with city council
after his return.
Please send me a copy of the most recent city ordinance
dealing with park dedication fees as they may apply to the
condominiumization of an existing duplex. Earlier I received
a proposed ordinance from Karen Smith which appeared to elim-
inate the park dedication fee on existing duplex structures,
but apparently that ordinance was not adopted in the form
which I had seen it.
I would appreciate it if you would send me a copy of the
minutes of the February 22, 1977, planning and zoning
commission meeting containing the recommendation of approval
on this condominiumization as soon as they are available.
Finally, please send me a sample of appropriate language for the
six month minimum rental restriction and an indication of where

RESOLUTION EXEMPTION FROM THE
DEFINITION OF SUBDIVISION REGULATIONS
WHEREAS} James Ward has made application for
an exemption from the definition of subdivision regulations
pursuant to Section 20-10 (c) of the subdivision regulations,
and
WHEREAS} the request is to allow condominiumization
of a proposed duplex on already platted Lot 9, Block 1 of
Snowbunny Subdivision, and
WHEREAS} the Aspen Planning and Zoning Commission
has reviewed said request and finds that the design require-
ment of 20-7 of the subdivision regulations have been met,
NOW THEREFORE BE IT RESOLVED} that the Aspen
Planning and Zoning Commission exempts said duplex on Lot
9, Block 1, Snowbunny Subdivision from the definition of

suggested that Planning put together such
a chart.
Johnson moved for a resolution for an extension
of 6 months of Ordinance 19 with adoption of
density, F.A.R., and parking recommendations.
Seconded by Jenkins; all in ~avor.
The Ward duplex is an already built duplex
located on Cemetary Lane. He is requesting
an exception to the definition of subdivision.
Schiffer stated that he did not qualify for
an exception in that he did not fall under
the sp~cial circumstances for an exception.
He did qualify for an exemption.
Barnard moved t,hat an exemption be granted
from the defini-tion of subdivision under Sec. 20-10 (c)
in that the property is on platted lots and blocks
and that it does satisfy all the design requirements
of Sec. 20-7. Jenkins seconded. All in favor.
Applying for an exemption from the definition
of subdivision under Sec. 20-l0(c) because they
are on platted lots and blocks.
Vagneur is abstaining from discussion and vote.
Donna Baer stated that they met all the necessary
requirements except that of access. She stated
the possibility of access from the Rio Grande
around thc back of the Court House bct\<een the
shed and into the alley from the west;,The Planning
Office would suggest exemption with the condition
that a deed of easement be submitted for Planning
files before a building permit be issued.
Johnson moved that aD exemption be- granted under
Sec. 20-l0(c) because the property is on platted
lots and blocks and did satisfy design requirements
on the condition that they obtain ~n access casement
from the County and present a copy of the Deed of
Easement to the PILlnning Department pr,ior to issuance

Re: Ward duplex sale - Exemption
from City subdivision regulations
Ladies and Gentlemen:
We represent Mr. and Mrs. Jim Ward, the owners of a duplex
situated on Lot 9, Block 1, Snowbunny Subdivision. This duplex
was built in 1963, some 10 years before the passage of Ordinance 4,
Series of 1973, which changed the definition of subdivision to
pick-up condominium interest divisions and other similar divisions.
One side of the unit has always been occupied by the Wards and the
other side by their tenants. They now wish to sell an undivided
interest in this property, subject to existing restrictive covenants
and a fairly common Aspen device entitled an "Occupancy, Use and
Maintenance Agreement". This amounts to having two owners of the
duplex, each entitled to the exclusive right of occupancy of one-
half the unit. There is absolutely no change in terms of land use
or the impact of the existing duplex on community facilities, such
as water, sewer and other services.
The County has recently concluded that a similar sale of un-
divided interests in two existing duplexes in Mountain Valley
subdivision should be exempted from the definition of the term
"subdivision" in the Pitkin County Subdivision Regulations. We
are requesting that you recommend a similar exemption of the Ward
sale from the City regulations under the following portion of
Section 20 - 10 of the Aspen Municipal Code;
"...exemption from the definition of a subdivision set
forth in Section 20-2(a) hereof may be obtained under
the following conditions:...

(b) FOllowing receipt of a recommendation from
the Planning Commission, City Council may exempt a
particular division of land from the definition of a
subdivision set forth in Section 20-2(a) when, in the
judgment of the City Council, such division of land
is not within the intent and purpose of this Chapter 20."
It is submitted that the intent and purpose of Chapter 20 is to be
able to review and somewhat control the impact on community resources
of proposed developments, and that this sale will have virtually no
additional impact on these resources, since it will merely change--
an owner-tenant situation to an owner-owner situation.
We would appreciate your serious and early consideration of
our request for exemption so that any sale is not unduly delayed
by the question of the applicability of these subdivision regu-
lations.
