808 - Insubstantial Plat Amendment
DATE: August 7, 1992
SUMMARY: The Applicants wish to amend the condominium plat to
reflect the enclosure of four balconies which has occurred over
several years and has not been reflected on a revised plat. This
proposal qualifies as an insubstantial plat amendment, and shall
be approved by the Planning Director.
APPLICANTS: The Aspen Alps North Condominiums, represented by Pam
Cunningham, General Manager
LOCATION/ZONING: 700 Ute Avenue. The 18,000 s. f . site is zoned L/TR
(Lodge, Tourist Residential).
BACKGROUND: The four enclosed decks are on the west side of the
building facing the gondola and Little Nell ski run. Recordation
of an updated condo plat is not required by the City, but the
Applicant took the advice of staff and is processing the revised
plat for the benefit of the affected homeowners. Please see
Attachment "A".
REFERRALS: On 7/22/92, Planning staff met with City Engineer Chuck
Roth and Zoning Enforcement Officer Bill Drueding to review the
proposal and compile the referral comments. The following items
were listed:
Engineering:
1) A Mortgagee Certificate is recommended to be included on the
plat but one is not required.
2) Indicate zone district of subject parcel on the plat.
Zoning:
1) The project is outside of the 8040 Greenline review area.
STAFF DISCUSSION: Section 7-1006 A. reads:
"Insubstantial Amendment. An insubstantial amendment to an
approved plat may be authorized by the Planning Director. An
insubstantial amendment shall be limited to technical or
engineering considerations first discovered during actual
development which could not reasonably be anticipated during
the approval process, or any other minor change to a plat
which the Planning Director finds has no effect on the
conditions and representations limiting the approved plat."
The minor expansions (approximately 400 s.f. total) resulting from
the enclosures do not result in increased density or number of
bedrooms. Updating condominium plats are a goal of the Planning,
Zoning, and Engineering Departments. The Planning Director shall
find that the conditions or representations of the approved plat
will not be adversely effected.
RECOMMENDATION: Staff recommends that the Planning Director
approve the Condominium Plat Amendment for Building 800 of the
Aspen Alps North Condominiums (units 803, 804, 807, and 808) to
reflect the enclosure of balconies. The following conditions
should apply:
1) Indicate zone district of subject parcel on the plat.
2) All material representations made by the applicant in the
application shall be adhered to and considered conditions of
approval, unless otherwise amended by other conditions.
I hereby approve the above Condominium Plat Amendment for Building
800 of the Aspen Alps North Condominiums (units 803, 804, 807, and
808) to reflect the enclosure of balconies subject to the above
conditions.

Pursuant to Section 7-1006A of the Aspen Land Use Code and to our
pre -application conference with you on April 14,1992, the Aspen
Alps North Condominiums hereby apply for an "Insubstantial
Amendment to an Approved Subdivision", the purpose of which is a
minor change to the condominium plat for Aspen Alps North
Condominiums.
The Applicant is Aspen Alps North Condominiums, 700 Ute Avenue,
Aspen, Colorado, (303-925-7820). The agent for the the applicant is
Pamela M. Cunningham, General Manager, who can be reached at the
above address and telephone number. A legal description is attached
as exhibit A.
Four owners of units (803,804,807,808) in Aspen Alps North have
enclosed their balconies: three enclosures occurred prior to
establishment of procedures for such enclosures, one enclosure went
through established City and Condominium procedures. (See attached
map)
1. The City Attorney, Fred Gannett, determined that each of
the Aspen Alps Condominiums were seperate complexes.
2. The lot size and FAR for Aspen Alps North is sufficient to
incorporate these enclosures.
3. The enclosures comply with the underlying zoning.
4. 100% of owners in Aspen Alps North have given written
consent of these changes.
5. A new plat is herewith submitted for City review and
approval.
